Indefinite Leave to Remain (ILR) is a type of immigration status granted to non-British citizens, allowing them to live, work, and study in the UK without any time restrictions indefinitely. It is often referred to as "settlement" and is a significant step towards obtaining British citizenship.
Remember you can lose ILR/Settled status; if you lose it because you have been away from the UK for too long you may be able to get it back via Returning Resident Application, for more information read our Blog post about this here: gsnimmigration...
    1. ILR Eligibility Criteria:
To apply for ILR, an individual must meet specific criteria, which vary depending on their visa category. Some of the common categories through which people can apply include:
    • Work visas: (e.g., Skilled Worker visa, Tier 2 visa) after five years of continuous residence.
    • Family visas: (e.g., spouse of a British citizen or someone with settled status) after 5 years of continuous residence.
    • Long residence: If a person has lived in the UK for 10 continuous years legally.
    • Refugees or persons under humanitarian protection, typically after 5 years.
    • Other specific routes include investor, innovator, and entrepreneur visas.
    2. Continuous Residence Requirement:
The individual must demonstrate that they have been continuously living in the UK during the qualifying period.
    3. Knowledge of Life in the UK and the English Language:
    • Applicants usually need to pass the Life in the UK test, which tests knowledge of British culture, history, and laws.
    • They must also prove their proficiency in the English language unless they are from an English-speaking country or have specific qualifications.
    4. Benefits of ILR:
    • No time limit: Once granted, there are no restrictions on how long the individual can stay in the UK.
    • Work and study: ILR holders can be employed or be self-employed and study in the UK without restrictions.
    • Access to the NHS: They are generally eligible for public services such as the National Health Service (NHS) and, in some cases may be able to access the public funds (ask job centre for details).
    • Pathway to British Citizenship: After holding ILR for 12 months, individuals may be eligible to apply for naturalisation as a British citizen, provided they meet the criteria. Or if the applicant is married to a British Citizen they can apply for British Citizenship straightaway.
    5. Conditions of ILR:
    • ILR can be lost if the individual leaves the UK and stays outside for more than 2 years. In such cases, they would need to apply for a "Returning Resident Visa" to re-enter and regain ILR.
    • ILR does not grant the same rights as British citizenship.
    6. Application Process:
    • The application is made online via the UK Home Office website.
    • Applicants must provide necessary documentation, such as proof of residence, employment, and meeting the eligibility requirements.
    • There is a substantial fee for applying for ILR.
    • Processing times is usually six months but can be shorten if eligible and purchased super priority service (within 24 working hours.
