I’ve been 90% TDIU (not permanent) for the past few years and just last week I got a letter from the evidence intake center saying I’m permanent now along with commissary privileges and dependent education… didn’t say anything about champva… given I’m 100% TDIU P&T even though my scheduler rating is 90%, does this now get my family Champva along with all other P&T benefits?
It comes down to how willing and able you are to do some homework and learn the rules. If you have some moxie, you can DIY. The appeal avenues are multiple - use them all to push as far as you can by yourself. When you’re exhausted, look for free help, it exists. After that, finally, hire help. Speed is not job 1, (except for submiting Notice of Intent to File) don’t get worn down. Persistence is what carries the day. You only need one ‘yes’.
I would think that 2 additional benefits of having representation would be: 1-when an HLR see’s a reputable law firm in the “represented by” block that is going to affect how they review/approach the appeal. 2-the attorney will be better equipped verbiage wise, to talk during the informal phone conference during the HLR process.
The greatest law firm in the nation for veterans my case is over 12 years old after 30 years in aviation and almost 2 years in the red zone my anxieties just couldn't manage that type of environment anymore without self-medicating when Chisholm Chisholm and Kilpatrick took my case all of a sudden everything's happening as far as I'm concerned if there's any back pay they can have it all what they do for veterans is important especially if you've been through extreme traumas and of course you made mistakes but the extreme traumas without question moved you in that direction but you still own the mistakes recovery is a hard thing to do people places and things that's why I don't do hud vash you got to call it what it is cheap apartments also corroborates your neighbor being a drug user or a dealer I've been living on the streets or in the woods for a long time but if you're going to fight the VA and this Law Firm accepts your case that's a really good thing because even the bva told me that Chisholm Chisholm and Kilpatrick usually wins
In November of 2023, the BVA issued a decision granting me TDIU. It's half way through May of 2024, and nothing. I have received nothing. Every time I call the VA, I get a different person and a different explanation as to why.
Naw it's front the date of Intent to file was submitted. Pur in your intent to file on VA.gov ASAP. You can submit you file within that year and get back pay to your intent to file date if you win.
I won my CUE appeal with the help of an attorney. Do not ever file an appeal without an attorney. Yes they get a percentage of your benifits but it is well worth it vice filing it on your own. It could be denied or not having awarded you everything that you may have claimed. I'm 100% P&T with Aid and Attendance. Couldn't have done it without my attorney.
Allegy approved for 0%. I didn't do a x ray scan of my nasal cavity to show half of it is blocked. Do I do an appeal or file for an increase? This is for burn pit. And I was approved for 0%.
Yes get a Lawyer, I did not and that was a mistake. I had to get my DD214 fixed first. That is with the department of the Army. Took 6 years to do that. The department of army is a two step process, first you have to ask them to look at it. They have a board that will look at it and say, yes or no. If they say yes they open it up ( DD214 ) and then you tell them what you want think is wrong with your discharge papers. I told the Army board about 6 issues, they gave me 5 out of 6 and they told me why I did not get the one on my DD 215 ( yes a DD215 ) then I had to start all over with the VA. hehehe 8 years with no Lawyer. I finally got to see a Judge ( face to face) with help from a department of veterans California advocate. WAY TOO MANY LOOP HOLES. GET HELP BEFORE YOU FILE ANY PAPERS. it’s hard to go back and fix a mistake that you did or you documented.
Not a good idea, without Lawyers to HOLD THE VA to the LAWS they tend to ignore you'd be crazy to NOT hire a great Law firm...yea it will cost you about 30% but as they say 70% of Something is better than 100% of NOTHING. My question to the Lawyers is this. If a Veteran appeals and wins then has to pay the lawfirm their fees is it possible to SUE the VA because they usually have NO REASON for a denial and make stuff up, so why couldn't a Veteran recover their legal fees as well?

Wait a cold minute. Retroactive payments are possible? Going back to when I separated? I thought it was based on when I filed!
