There is no historical proof, that this legion actually existed. But I like to believe that they did.
Very few things in history are subject to proof (rather than inference to best explanation based on evidence), but I get your point. Even the evidence may not be that conclusive. Frankly, I'd have to study the matter more to form a really informed view on how likely their existence is.
