- How to remove a hijacker from your Amazon product listing and how to report a violation using Brand Registry.
If you are selling on Amazon then at some point your FBA product listing will get hijacked by another seller.
When my product got hijacked I struggle to find a tutorial that showed how to use Amazon's brand registry to report a violation, so I decided to put together this video to show the steps that I took to get the hijacker removed from my product listing.
What is a Hijacker & Why is it possible?
• Hijackers are other sellers that use your private label product listing to sell their generic product on Amazon
• Unfortunately this is possible as Amazon owns all product listings and allows multiple sellers to sell from any listing
• Amazon allow multiple sellers to list against any product providing they are selling the exact same product
• Private label products do not have any additional protection unless you are brand registered
How to Prevent Hijackers
• Add your private label brand (logo) to your FBA product and packaging and ensure it is visible in all product photography
• Customise your product so that it isn’t identical to any other listing and is different to generic versions of the product
• Consider bundling additional item(s)
• Monitor all of your listings (I use Helium 10 “ALERTS”) - this lets me know as soon as a hijacker has won the buy box so I can act immediately
What to do if your listing gets Hijacked?
• The first step every Amazon seller should take (if you have lost the Buy Box) is to reduce your price to below the hijackers, this will usually allow you to win back the buy box.
• By winning back the buy box this reduces the risk of a customer receiving a lesser product from the hijacker as people will continue to buy your product (this reduces the risk of receiving a negative review)
• If you are BRAND REGISTERED (this requires a Trademark) then you should report a violation using Brand Registry.
• If you are NOT BRAND REGISTERED then send a “Cease and Desist” letter/email (template below) and report a violation via Seller Central (you may have to buy the product first so you can upload photos showing how the hijackers product does not match the product listing)
CEASE & DESIST TEMPLATE:
It has come to our attention that your Company is using the BRANDNAME brand and violating the BRANDNAME trademark to sell products on the Amazon.co.uk marketplace.

The BRANDNAME brand has trademark protection and is part of the Amazon Brand registry.
Our company is the exclusive distributor and the owner of the brand. We have never granted permission to your company to sell our brand nor have we sold you inventory for resale.
Amazon does not allow unauthorized selling of products as it makes Amazon liable for allowing copyright and trademark infringement. In addition, products sold under a listing must match that listing EXACTLY.
Amazon’s typical response to such cases is “...We are writing to let you know that we have removed your selling privileges, cancelled your listings, and placed a temporary hold on any funds in your seller account...”
This will serve as your legal notice to cease and desist all further actions described above.
You are hereby instructed to comply with this letter immediately or will report this to Amazon Seller Performance and Amazon Brand Registry.
You have 24 hours to comply or we will report you.
BRAND REGISTRY RESPONSE:
“Thank you for submitting your notice of infringement. We cannot take action on your report for the reasons listed below
Amazon respects a manufacturer's right to enter into distribution agreements for its products. However, violations of such agreements do not constitute intellectual property rights infringement. As the enforcement of these agreements is a matter between the manufacturer and the retailers, it would not be appropriate for Amazon to assist in enforcement activities.
We only process one intellectual property (IP) complaint at a time. In order to ensure quality and quick resolution of your notices, we will only process the specific complaint type you have chosen on the Report Infringement or "Report a Violation" forms (such as patent, trademark, or copyright). If you have additional IP concerns, please submit additional notices of infringement."

I can also confirm that method 2 works like a charm. I just managed to kick hijacker off my listing using method 2. Cheers for that mate!

Hey Darren, we're in Australia and sell in the US. Were hijacked for the first time today, so I went looking for a solution. Found yours, implemented it and Boom, sorted in under an hour :) Happy days. Have now created an SOP for hijackers! Cheers...Oh,BTW, if you're not brand registered, it's time to be.

Many thanks. I was so frustrated that i could not get this hijackers out of my own branded listing. This solution still works, it takes about 24 hours to get an answer.

Hi Darren, just wanted to say a thank you. Used your 2nd message to remove the highjacker as i was brand registered and Amazon removed them within 30 minutes!. This a week after receiving the same failed response you got. Great content and help once again!
That's the part that's confusing to me. Was the second message you sent some kind of appeal to the first failed response or did you submit a new violation report? I'm brand registered, and got the same BS response from Amazon.

Such a big company amazon why don't they provide a Human customer service to solve seller's issues like 1 to 1? Brand business sellers comes to amazon with a big plan and expectations, and they bloody play with them with their robotic customer service. :) Very helpful video Darren as always. thanks

Hi Michael, when you are getting your UK trademark for your brand name, you also need to specify the products and their categories. For Amazon, does that list of products matter, or they just care that you have a trademarked brand name (and you do not need to include all of the products you are selling on Amz when filing the TM)?

You are a lifesaver Darren! I never usually comment on RUclips videos, but this deserves the comment and like. I had the same issue as you to start with (Brand registry method), then I used your new simplified method and it worked within 10 minutes too!
I have a question though if you wouldn't mind answering. This seemed to kick the seller off on my UK listing, however, they are still on my EU listings. Although the Trademark is a UK one, can this be used in any way to remove the hijacker from my EU listings?

Hey Darren. Great video, lots of really useful information here. Have added to my favourites for future ref. Do you have a video/advice on what to do if the listing itself is taken over by another seller? Where they are some how able to change listing images/brand name/title etc. Apparently to hijack the reviews and ranking position. Do you know how they are doing this and how i can get it undone. This was through the official UK Trademark body: trademarks.ipo.gov.uk/ipo-apply
I don't have a US Trademark so wouldn't be able to offer advice on that.

Brand Registered Seller here, requesting urgent support:
My product listing has just been hijacked, the product itself is generic but packaging itself is branded with my trademark and I am brand registered. Last time I reported a hijacker on one of my products Amazon removed the whole ASIN and I basically had to re-list and start again, I really cannot afford for this to happen again. How do I report this to Amazon and ensure that the same thing does not happen again? The product the hijacker is selling and based on shipping times I assume is coming from China. It is not FBA and estimated delivery is one to two months. As such, I cant exactly order one and wait for it to arrive and take photos to show that the packaging does not match (also my packaging does not appear in the photos, will this be an issue?).
Any advise would be greatly appreciated. Thanks in advance.
