  • Asking for a prenup (prenuptial agreement) can be an exceedingly scary ask. To your partner, a prenup may seem like a way of telling them that you’re planning for a future divorce. But, in reality, it could be the thing that secretly saves your marriage. The everyday American knows very little about the prenuptial agreement and has gotten most of their information from movies, reality TV shows, and hearsay from friends and relatives. We wanted to know the truth about prenups, so we invited attorney Aaron Thomas on the podcast.
    Aaron Thomas has a wide range of experience in family law, divorce law, and anything that comes from legally joining (or separating) a couple. He knows how difficult divorce cases can be and saw the same mistakes repeated by couples. The lack of communication over finances, minimal planning (if any at all), and wishful thinking led to more and more couples seeking separation shortly after marriage.
    Now, Aaron and his team work with couples to form strong prenuptial and postnuptial agreements so that they have a rock-solid financial foundation to stand on when dealing with the daily joys and struggles of marriage. Aaron argues that the prenup may be the most important step in mitigating a divorce and that the protection of a prenup goes far beyond wealth.     If more people understood what a prenup did and didn't do, more people would want one... I'm a single lady in my 40's, and I wouldn't get married without one. I don't care if the guy is rich or not, I want to be sure what I have is protected. It's not that I'm rich, but I've worked very hard to have what I have in retirement accounts, get out of debt and and recently start making small investments. Plus, I believe in being fair and being upfront, so noone is stressing about what if's or feel like they need to hide things especially from their spouse.

    The "planning to get a divorce" argument is weird. You wear a seatbelt, lock your doors, etc, to be secure, not because you PLAN to have a crash or get robbed.

    This was a great episode! If you guys ever have Aaron back on the show. A question I have is how is "giving" handled on a prenup or if it's even included. Specifically giving to help family members and/or taking care of parents.

    Your vehicle and estate a prenup protects also. Anything that you had before you even met them or got on your own is yours

    why this double standard where the state's standard-prenup doesn't require any informed consent but any actual explicit contract has to pass a much higher bar for informed consent? Any explicit contract is more informed-consenty than the legal defaults.

    Unfortunately, getting a spouse who does not want to do counseling into counseling accomplishes nothing. It's just leading a horse to water. If you could somehow contract on willingness to discuss things, far fewer divorces would happen.

    Imagine you’re in love and he talks you out of getting married, only for him to get married years later 😂 I would be heated

    And why are you getting married in the first place? Prenups are a bandaid on what is likely a bigger problem. Expecting the state to enforce one contract over another, especially in Ma, is foolhardy at best. Rules change by the week and judges are completely unpredictable

      Well marriage has legal provisions you can only get through marriage. This kind power of attorney, custody, etc. Beyond that, the religious and / or romantic commitment that comes with it is something to aspire to for most, man and woman included. It's just that modern society has bastardized the sanctity of marriage with all the commercialization and legalese of it, and these days marriage is typically a losing proposition for men especially.

    prenup is worthless for 3 reasons , she can claim i dont read it or i dont understand it or he forced me to sighn, good luck with her, there is only 1 solution and its 100% safe , DONT GET MARRIED

      I'll double down on your comment and say that a prenup is dangerous. If you disclose all your assets to your future spouse and her parents, you could be be signing your death warrant, especially if you're a passport bro.

      That's why you want to have her represented by a good lawyer, and make sure that she explicitly says that she consents.

      @@jcorey333 I don't think the consent part matters in a third world country. You tell me where all your assets are, their value and locations, and I'll sign the consent saying I won't touch them. 😂
