  • A black man on a city bus saw another man sexually assaulting a fifteen-year-old girl. He fought him off, and was handcuffed for his trouble. Cenk Uygur, Grace Baldridge, and Hasan Piker, hosts of The Young Turks, break it down. Tell us what you think in the comment section below. tytnetwork.com/...
"Twenty-one-year-old rapper and activist Moise Morancy was riding the Q53 bus home when he noticed another passenger forcing sexual advances on a teenage girl. He intervened, confronting the man directly, and prevented the him from doing further harm. But when the NYPD arrived on the scene, Morancy was detained along with the girl’s assailant.
According to Gothamist, Morancy had just wrapped up his mixtape recording when he caught the Q53. It was then that he noticed 36-year-old Pablo Levano issuing unwanted caresses to a female teenage passenger. On his Facebook page, Morancy details the encounter…
Morancy struck Levano in the face, knees, and neck as a means of self-defense. And though he was detained, after answering questions about the incident, a sergeant released him at the scene. Levano, on the other hand, has been charged with forcible touching.
“Shortly after this black police officer who was the sergeant opened the door, congratulated me, and ordered to release the handcuffs,” Morancy explains. “To see a black man in a position of power right the wrongs gave me a little bit of hope for the NYPD.”
Morancy has been subjected to racial profiling before, so he was relieved to-ultimately-be treated fairly at the hands of the police.
“I forget [the sergeant’s] name, but I want to say ‘thank you,’” Morancy toldPIX11. “He said, ‘You’re a hero,’ and shook my hand and said, ‘I was you 20 years ago’...[T]hat touched me.””*

No need for the cuffs. Talk to witnesses, take the mans demeanor into account, analyze the situation and you'll see this guy is not a threat. Also, was he legally under arrest or just placed in handcuffs? An officer can use restraints during an investigation without placing someone under arrest. I personally wouldn't have used cuffs as the guy seemed very cooperative and non-threatening, but we have the benefit of hindsight here, where the responding officers did not. Admittedly: kind of dickish though.

Ive experienced both, Kids from the burbs are all bark, but city kids might actually bite. Kids today are out of control and unfortunatly (sigh) many are black kids. Im from a tough mixed neighborhood full if Italian, blacks, jews, latins, irish, and Russians, city kids are just different regardless of race.

This lesson then gets reinforced regularly. How to behave when the police stop you, what to do if a "Karen" attacks you or calls the police on you etc. Believe me most black peoples have many more decisions to make in split seconds all their lives. The issue was that regardless of his intent it was still assault. He put his hands on the other guy, so they had to charge him with assault as well. However, in court he can claim self-defense. In NYS you CAN make a citizen's arrest and the law says that you are allowed to use physical restraint to stop a serious crime. However, It seems like its more a legal defense for the courtroom than something that can be determined by the police on the street.
Patrol officers do not have the authority to exercise such large discretion and interpret the law themselves. However, a CO can exercise that discretion and the responsibility would be on them.
That's why the Sgt released him later on but the responding officers still had to arrest him.
This was not in any way an abuse by the NYPD. They were doing their job. It's just that regardless of intent they have to go by the letter of the law and discretion and reasoning are issues for the court to determine.

BLACK, WHITE, BROWN, BLUE, DEM, REP, VP, PRES, MOM, DAD, DAUGHTER, SON, ALLY, ENEMY...when/if ANY of them commit CRIMINAL acts...they should be arrested. And that MIGHT make 'AMERICA GREAT AGAIN!

I saw a man beating a woman as she was trying to run away from him, in her hands she was holding a screaming and crying 4 year old boy. He was punching her in the back of the head, gingerly walking behind her screaming insults and vulgarities at her while she struggled to run from him with a heavy small child in her arms. I got out of my car and told him to hit me, I told him that when he did I wouldn't be running away from him. He ran his mouth for a while but ultimately wouldn't do anything so that I could legally defend myself. A few seconds later he got into a fight with my ex bf and then we all ended up getting arrested. I was charged with assault and battery with a dangerous weapon.
I pushed for a trial to call the DA's bluff and they dropped the charges. I knew no jury would convict me because he was beating a woman holding a small child, and male or female most people would have loved to have had the courage to do what I did. My ex ended up taking probation, which he had to pay $50 a month for. $50 a month for saving a woman and a child from an abuser.
The fact that I actually have that arrest on my record for the rest of my life in the state of Massachusetts is one of the reasons I moved to a new state.
I am a white female and I was put in a jail cell for over 24 hours and threatened with 2 years of prison for ultimately defending the life of a 4 year old child, as his welfare was my main concern.
I honestly don't know if I would intervene again as fucked up as that sounds, to me because of what was done to me. I don't know that even with this weight of hesitation over my heart that I wouldn't act again, because that is the kind of person I am. I'm just not sure of what I would do if faced with a similar situation.
Sometimes people don't have time to call police during an attack and have to (wo)man up to right a wrong, but an overly punitive criminal justice system in terms of self defense or defense of another person seems insane in these circumstances.

This is the reason why I am afraid to help strangers now. I would get involved in the past but just like this black man, I was criminalized by the cops. Luckily my neighbor (who's a sheriff) came on the scene that day and knows I've never engaged in any criminal activity so he helped free me from those handcuffs. I wasn't even put in the system yet so I'm glad about that. But it's crazy because I was helping an elderly white woman when this 30 something year old Latino guy stole her wallet from her purse. I sprinted to the thief and pinned him down (I'm a 5'6 African American girl and he was 5'3 according to the police) so I was able to tackle him and take the wallet back while male bystanders restrained him till the police came. And I gave the wallet back to the elderly woman. The woman even told the police I helped her but the police didn't wanna listen until someone I knew helped free me. Honestly, I love to help people but as an African American in this country, I think it's best for me to mind my own business from now on. I'm sorry but if your child is getting kidnapped, you better hope a white privileged man is there to save the day... because that white man won't be arrested with question. It's the truth.

You also don't see how many whites are harassed by the cops as often either. Does nothing for railings. If a cop instantaneously feel it is necessary to cuff the blk person based off the stats you gave that's not a justification. It reflects poorly on the individual.

He was not arrested, he was released at the scene. Putting someone in cuffs is not an arrest, its a temporary detainment.
He was cuffed (temporarily) because they need to defuse and assess the situation. They didn't know that he was protecting someone, they just knew that he was beating someone up. So they cuff him and the other person to keep them both under control while they question people and figure out what happened. Then they released him, because he did nothing wrong.

I have seen it in court, and can name actual cases and judges. One thing you guys are missing is the fact that no matter how many times we all fight for justice, ignorant individuals will always be around and put a stink in society. As a black man, I focus on how these things operate. I've been teaching for about 15 years and in 2020 I was assaulted by a student. I responded by re moving the student from the classroom safely. I put two fingers on his sweater, not even touching his physical body and safely walked him out of the classroom. The principal fired me. He also wrote a false CPS report. I reported his false report to the police with evidence. They eventually took the report and put it on file, but the police officer was friends with the principal and tried to stop me because he didn't know or understand the penal code I referred to. Many times it doesn't matter if we are in the right. It's how the systems are set up. Many of the school districts and teacher commissions seem to operate like independent states. They don't even know the law. After the incident, I became a non certificated legal expert. LOL. Being Black especially, we have to think on our feet because Black people are Behind Enemy Lines. And everyone else is also subject to the police who are not always competent within their profession. We have to out smart them because identifying their disfunction and incompetence is never enough.
