Applied concept of Constitutional morality: CJI Chandrachud recalls verdict in Delhi vs Centre case

  • Addressing a conference on Contemporary Judicial Developments in Kolkata, Chief Justice of India DY Chandrachud on June 29 explained the concept of “constitutional morality”.
    “The thing we are going to discuss is constitutional morality… Constitutional morality is not found anywhere in the Constitution…The Constitution uses the expression, ‘morality’ but does not uses ‘Constitutional morality’… Morality in article 19 (II) and article 19 (IV) is a restraint on the rights of the citizens…At one level constitutional morality is found in the preamble values… I was one of those who applied this concept of Constitutional morality when I wrote the judgement in the first round of the battle between NCT of Delhi and Union of India about six or seven years ago,” said CJI.

    Mr.CJI constitutional law not only applies to centre but to delhi also and you and S.C.judges should think of national security and people safe . The freedom expression for you just to give warning and leave them freely as the person does the mistake repeatedly and other people too does.Hence Morality of judges should also maintained.

      Rights are more important than physical security..........because when in the name of physical security, state squires more and more power by taking away the rights of the people, the state itself becomes a threat to security. Any person who criticises or complaints is either jailed or threatened.

    Only big talks on morality. Some examples -
    1. Most of the SC and HC justices are not uploading their property returns. For them it's not mandatory while for other government officials, the same is mandatory.
    2. In any other countries of the world, the collegium system of selection of judges by judges is not there. How can you deny that Bhai-Batijavad, and political connections don't dictate such appointments and that such a system don't encourage mediocrity?
    3. Even on holidays, simultaneously two SC benches could be there in the evening just to nullify HC order and provide relief to Tessta Setalvad.
    4. The case related to electoral bond was filed with the SC sometime in 2018. You allowed the system to continue and could managed time to flex your muscles just before the 2024 election. Any hidden agenda?
    5. There are several pending cases related to post poll violence subsequent to announcement of 2021 assembly election results in West Bengal. Who will provide justice to the victims and when?
    6. You people offered Jnan when Nupur Sarma made some reference from one's holy text but don't find anything wrong when some leaders of DMK made objectionable remarks against Hindus.
    There are many more such incidents...

      All the systems for appointment of the judges are bad including the collegium. But, collegium is the best among all bad ideas. Govt should have no role in appointing judges. Suppose an andhbhakt appeared in neet exam and the paper gets leaked . Andhbhakt goes to court against the govt, but sadly andhbhakt gets no respite as the judge is appointed by the govt😂....now what will an andh bhakt do

    Please reserve this lecture for post retirement. Corrupt leaders and influential lawyers easily can manage earliest date for argument hearing, even followup date also. Tell me any middle class or poor peoples can access this facility

    I like when our judges taking about constitutional morality but
    They should think is our judiciary able to do basic work? If not then such lectures are stupid 😂😂😂.
    Its like SBI employee giving lecture on importance of time 😝😝😝😔

    Honourable cji articulated insightful talks.Highlight is that judiciary is to adress common citzens contemlorory pressing problems,is paramount.This apart, most of judicial process at various levels is not understable. So impactful events, may be vividly circulated in local languages.

    CJI you hv no moral grounds to give such lectures, may be your post retirement
    Your performance as CJI has been dismal and you hv advocated Bail for Jail
    And shud be ashamed that you still hv 84 thousand cases pending in SC
    Productivity if your judges is zero and you favour only Sibal and Sanghvi
    Stop lecturing

    I think in this defined and undefined, superiority of logic, the judiciary forgets that they have to just take decisions in the context of well-being and justice. If this is not written, then this should be the principal for our judicial system.
    Instead of making it complicated to look appealing to the mind, law should only work for well-being, rehab, justice and liberation of lives around.

    Morality in constitution is a strange coming from Chandrachud the CJI . He is complicating the term confusing the people. He is going round and round. He is very dangerous for the existence of the country He is undermining the governance. Chandrachud try to confuse to your judicial work.
