      Here’s how it should have gone:
      ‘I don’t understand…’
      -That’s why you have the right to be represented by an attorney. As a judge, I have to inform you of the charges and range of penalty. If you can’t understand such simple informations, you need to ask an attorney or read the state’s code of law. I am your judge, not your law teacher. We will see you the 27th at 1:00 PM. In the meantime, it is up to you to decide how to defend yourself or to file for an appointed attorney.

    These idiots always go on and on with "I have the right to understand the nature and cause of the charges" No. You don't have that right. The 6th amendment gives you the right to BE INFORMED of the nature and cause of the charges. Understanding the charges is not a right. No one can force you to understand. You've been informed of the charges, you have the right to not understand them, get a lawyer.

    • @bugbread

      Even if it were a right, it wouldn't make a difference. Rights are not obligations. You have the right to remain silent. This doesn't mean you can't talk. You can choose to talk. Likewise, even if you had a right to understand, once the court has given you a clear explanation in accordance with the 6th Amendment, if you choose not to understand, that would be fine. It wouldn't mean the court would have to explain again, it would just mean you weren't exercising your right, just like talking after being read your Miranda rights.

    • @inmyshoeswheelsoptional9848
      @inmyshoeswheelsoptional9848 3 месяца назад

      Agreed. But I think it's more compared to other judges she has been a lot harder on them. At least she actually did somewhat arrest him in the end to = consequences. Even tho really it was the cops who made that decision. Imo she & other judges are afraid of being in trouble etc because technically they're saying legal stuff (even tho it's not actually true technically they are "trying" to argue a legal point in the eyes of the law/courts) so I think they're afraid it'll show on the person's record that the judge put them in contempt of court for trying to state their legal rights (again it's literally the opposite of that & we all know that. But there's not really a legal precedent yet for this in American or other countries courts, & because of that they have to be careful like they would anything else like this, even tho nothing else has ever been like this in that it's legal talk but literal BS) imo should make it even more of a priority for the courts to put laws into place but also 1 of the judges really needs to make an example out of 1 of them for this type of thing (maybe someone who's about to retire if they're so afraid of being in trouble for it? Tho imo i think the system and ppl will actually be relieved if they did it) so that there is finally a precedent for it in the court systems so they can finally do what they want to ACTUALLY do about this waste of time & tax $ this causes. Even just a law about wasting time by asking the same argument over again would fix this imo..
      But because of this I actually think what she did was EXTREMELY smart on her part due to the above concerns she had. She literally passed it over to cops(keep forgetting what court cops are called) to make the final decision to arrest him legally meaning she didn't make the ruling herself (but in a sneaky way she did which was very smart on her part to avoid concerns about the above. even tho we all know she won't get in trouble for doing it herself, it's the tiny maybe. But yeh SUPER smart and imo I hope this causes a precedent for other judges or just gives them this as an example of how to get around their concerns to finally be able to put these ppl where they should be, when they start to do this bs.

    Why was she so reluctant to have the deputies take him into custody? Most of these fools change their tune once they are behind bars, even if just for the night. So, save Kansas a lot of hassle, hold him overnight and see if he "understands the nature and the cause". (sigh) Oh, and run his ID with Homeland Security to see if he's a veteran (or worse yet, still in the service). I'm guessing he got that uniform from some thrift store because he saw his name on it.

    Law talk with Mike should have trademarked this whole thing, he’d be the leader of the Fezzes by now
