The dems keep forgetting that there is a process in place for dealing with sitting Presidents that are alleged to have committed a "high crime or misdemeanor", and that process is called impeachment.
Step 1: the House has investigate the alleged crime and then vote to impeach the sitting President for the alleged crime.
Step 2: the Senate conducts a trial based on the evidence the House has collected against the sitting President. If the Senate finds him not guilty then he can't be tried in a civilian court for the alleged crime (double jeopardy). If he is found guilty, he can be removed from office.
Step 3: Then, and only then, can he be indicted in a civilian court for the alleged crime and stand trial. In this way the Senate acts as a form of grand jury for the alleged crime.
Since Trump was impeached by the House, tried by the Senate and found not guilty of any of the events around J6, including attempting to overturn the election results, none of those cases in the lower courts should ever have been brought. Remember, the Georgia case hinges on him questioning the results of the election, and the Smith case in NY hinges on his allegedly interfering with the election process, but the reality is that one of the duties of a sitting POTUS is to ensure the elections were run fairly and legally. If he saw what he felt were inconsistencies in the election, then it was his duty & responsibility to question the validity of the election results, just as many other past Presidents that had their party lose the election have done. In short, the dems are prosecuting Trump for carrying out his legal and constitutional duties.
The dems also have need to worry, because if the SCOTUS decides that Presidents lose all immunity once they leave office, then that will leave Bill Clinton, Obama, Bush, Biden and every democrat President moving forward, open to criminal prosecution the second they leave office. Do they really want that?
