Contrary to popular belief the police have no legal duty to defend you or your property. Remember that next time a gun grabber says the police will come and take care of the home intruder.
That's not entirely true. They are responsible for your safety if you are in their custody and they have a responsibility to make a good faith attempt at keeping people safe when they are present. What they can't do is to guarantee someone's safety just because they called 911.

I am sick and tired of the phrase "qualified immunity" being thrown around like a blanket. That's one of those things that should be applied only under the most strict scrutiny, after being articulated in open court as to WHY the person in question should be granted that protection.

The concept isn't terrible on its face. Public officials should be able to do their jobs in good faith without being sued every time somebody gets hurt feewings. The problem is when their actions are obviously not in good faith or they should have reasonably known they were violating the law.
With Trump, they brought charges first. With these cops, they don't even investigate if a crime was committed.
An investigation would show that this was murder with trump, it very clearly demonstrated that there was no reason to think trump did anything wrong.

I have a job (not first-responder related) that deals with qualified immunity. Knowing that if I'm doing my job correctly and to the best of my ability, I don't have to worry as much about the people I deal with in the job daily suing my ass into poverty or worse _because_ I'm trying to do my job _the way it's supposed to be done_ takes some stress out of the equation. Not that there isn't still stress enough to go around... but every little bit helps.

The cop waited outside at Sandy Hook too and nobody bothered to even life flight or allow ambulances access to over 20 of those patients, anywhere else even code blue patients...no pulse, believed to be dead, are at least worked on and some attempt is made short of a full decapitation, a highly decomposed body or buried body before a coroner is brought in to do the death declarations. Stinks pretty badly in those and many more cases.

Duran deliberately did not announce that he was police. He admitted that this was his usual tactic where he would knock and then listen ‘for any response or noises. He had no business knocking on the airman’s door. Duran should be charged with murder.

Normally they prefer to stand on the knob side of the door, but this wasn’t possible due to the house being at the end of the hallway with no means of escape if the officer sustained fire.

I knocked on a friends door who was expecting me, and he had a gun in his hand. I never felt it was justified to use deadly force on him, nor did I feel entitled to him not having a gun on him in his own home.

You might be excited to hear though, that there are binary Glock slides that do have a Glock 18 style selector lol

I think considering the facts of the case, it’s murder. But the defense will argue that he “reasonably feared for his life”, if they even charge him. A jury might convict him if you get the right crowd. I think you’re right about him drawing and stepping to the side would be reasonable, but ultimately he let his fear take control of him, which is something we see from cops far too much these days.

I’m not sure about charges in this case, but there’s no reason to answer the door with gun in-hand. I think going to the door with the weapon concealed is a much better approach, or at least in an open-carry holster. Having a hand on a firearm gives the officer little response time. Exercising gun rights requires a working frontal lobe-unless you want to end up on Brandon Herrera’s channel.
I agree totally. I think/ hope that ccw holders have thought about how to handle being seen while being pulled over to minimize any misunderstandings. Now maybe this will translate to all interactions with cops while being armed. The gun certainly can complicate interactions with police.

It's complicated, but generally, police may use force to defend themselves or others in the same circumstances as laypeople can. In some states, they may also use force to stop someone fleeing if that person is armed and they reasonably believe that person will harm people.

I put Glock switches in the same category as bump stocks: dumb and useless, but shouldn't be illegal. For that matter, useful things like traditional machine guns should be recognized as protected under the 2A, but that's for another day.
I think i need to do some googling here. I thought IR lasers were for using with NVG's. In the ad he says the ir laser on that cant be seen by them. Am i misunderstanding the IR laser's capabilities and uses?
It's a ranging laser. It's for passive use with a magnified optic. The visible aiming laser is to collimate it with your scope. Then when you put your reticle on an object you can lase that point for distance, but the onboard computer will calculate the firing solution and give you click values for elevation and wind, based on data you can upload from an app on your phone beforehand.

There is no genuine criminal charge I can see after 40 years as a LEO. there is certainly a training issue and I have no problem with the officer being terminated. The position at the door for the officer put him in a tactically inexcusable position. Pressing out while moving and giving a loud command would have been ideal but certainly not guaranteed to have a better result.
As a former LEO I agree. The deputy either was poorly trained or didn't follow his training. I'm inclined to believe it was a lack of training because LE academies are woefully short with a whole lot of information crammed into a short time before popping you on the street, hopefully with a FTO. These kinds of things happen way too often because of a lack of training but it takes money to increase academy training and nobody wants to pay.

The results of the Duran case are unpredictable. Regardless of the legalities, answering the door with a gun in your hand is putting yourself at risk of being shot who may later claim self-defense. On the other hand, answering the door without a gun in your hand can also be dangerous. Life is not always fair.
