    I argued a case before the 7th circuit where he was on the panel. I was representing a whistleblower and the Department of Labor was on the same side as my client. DOL had ruled in my client's favor below. The 7th circuit does not release who will be on the panel until the morning of argument. The DOL attorney almost turned ghost white when he heard that Judge Posner was on the panel. He and the employer attorney seemed quite intimidated by him. He was tough on both sides but judges don't intimidate me. We won the case. I was quite impressed by his sharp mind.

    My former professor at The University of Chicago Law School, this man is positively one of the Top 50 intellectuals walking the planet at present. Fact!

      what he did re. nuisance vs. strict liability is really working out wonderfully for communities like the one I work in in Baltimore where we had a coal terminal explosion or the people in East Palestine, Oh. It's great fun to have to hire lawyers and go up against multi billion dollar companies and prove that the company was negligent as we continue to inhale toxic chemicals...wonderful intellectual hero of our times.

      @@nonamenow3839 Suggesting that Dick Epstein is one of the Top 50 intellectuals living does not prove dispositive that he has been at one time or another on the side (wrong, mind you) of banks, consultancies, assurance and insurance firms arguing some obscure, fiercely-capitalist, anti-regulatory legal theory. So no, these are not mutually exclusive.

      @@bankcounsel I'm talking about Posner, who led us away from strict liability to nuisance re. industrial disasters. What does Epstein have to do with it?

      @@daviddenotaris3176 Actually, I was thinking Dick Epstein because I was on the phone with Dick Epstein. Meant to write Dick Posner. That's the man who's amazingly sharp and who has nothing to answer for. An absolute Laureate of Letters.
