Well done for handling this. One important lesson from hearing yourself being positive and yet not deriving any comfort from that - sometimes, when a friend is suffering, we start throwing all that 'Think positive!' gumph at them, being all patronisingly positive and totally dismissing how bad they feel. What they really need is just someone to listen and say 'Man, that sucks'. So I'll say it; 'Jason my man, damn. All that work, all those Likes and comments lost from the algorithm. Man, that sucks!'

    Couple thoughts:
    1) What probably got you in trouble with the CW was reacting to current-season episodes. You probably wouldn't have an issue if you stuck to waiting till they weren't brand-new.
    2) You were most likely caught up in a sweep of them trying to wipe out all the folks who are just sharing the current season's episodes straight-up.
    3) While Fair Use is still somewhat of a grey area, you can (and should) dispute the copyright claims through RUclips's system (which is a far cry from an expensive & protracted legal battle). Point out in your dispute that you believe what you're doing falls under Fair Use since you're providing commentary on the tricks and adding things like interviews with the magicians to discuss their performances. They may still deny your dispute, but I think you'd be doing yourself, your channel, and your subscribers a disservice if you didn't at least try.

    • @JasonParkerMagic
      @JasonParkerMagic  3 года назад +37

Well I kept it simple for this video... originally I was going to do a whole section explaining the dispute resolution process on here. I tried for one video, they rejected the dispute.... I'm not willing to escalate it further because of the risk involved from there on out. I did dispute 3 other videos because they included magician interviews inside of them... still waiting to hear what they say. But probably they have just hired some company to manage this process and they will make those interview/reaction videos blocked soon. And I'll have to upload the interview portion separately. I did my best to keep this video short enough, but still kinda explain why I'm doing what I'm doing. Also... I spoke with several other magicians who said their videos were claimed as well.... currently the idea is they are trying to work with the producers of Fool Us to get their particular videos white-listed. So I'm definitely trying as much as makes sense... but I have to weigh the risk that too much escalation of the dispute process can raise.

@@JasonParkerMagic I think you should contact claimant (should be stated in notice who is in action, if it's CW or hired company) and ask them why only recent videos triggered it and how would you comply for fair use in the future. I mean normally - they would claim ALL videos as there is no technical difference between them so there must be a reason why they didn't and left it be as fair use.

@@JasonParkerMagic hey Jason. i'm just a random youtube commenter so obviously take what i say with a grain of salt. but a friend of mine who i've known forever has a pretty big following (2mil twitch followers, 500mil youtube views, 500k twitter followers) and you're 100% right about not wanting to escalate the dispute process. some of the other comments telling you to push back hard against the claims obviously aren't familiar with the system. if they reject the initial dispute, there's a 99% chance that pushing it further will do nothing to help you. and as you said in the video, if you try to pursue any legal action, they will just bury you. it sucks, but it is how it is.
i'm sure you already know this (and it seems like you're already doing this), but i think your best course of action would be to poke around the magic community and see if you can find a way to get Penn and/or Teller's ear directly. at the end of the day, The CW owns all of the rights and P&T can't outright overrule them, but i believe Fool Us is one of the highest viewership shows on the network so P&T should have some level of pull.
as a final note, i'd suggest checking out Davie504's channel for some inspiration as you transition your channel structure. his content is completely unrelated to yours, and his personality is a lot different, but his format is very similar to what you want to do (a mix of self-performance videos and reaction videos) and i think there are a lot of concepts you could take and mold to fit your personality and channel direction.
anyway, like i said, i'm just some rando youtube commenter, but i hope at least some of that helps, if you happen to read this.

      @annaclarafenyo8185 3 года назад

@@weedywet The word "liberatarian" is a replacement for "anarchist" designed to remove the stigma from anarchy. It started as a far-left movement in Europe, a splinter group from Marx's internationale, which started with the observation that property rights are always a restriction on liberty.
For example, a person who owns a field can put up a 'no trespassing' sign, thereby limiting my liberty to graze cattle there. When a musician slaps a copyright on my video, they are restricting my liberty to share the music with my friends. A theatre owner prevents me from selling home-made popcorn in their establishment.
So liberatrians wanted to end property enforcement. The idea was that workers would simply take over the place of business and tenants would take over residences.
This is what libertarian meant for decades.
In the 1970s, conservative Americans, looking for a rebrand, borrowed the name "liberatarian" and pretended it means "unrestricted capitalism without government intervention". They liked the name libertarian, but wanted to avoid the whole 'no property' part.
Penn is an American liberatarian, which means he has the same set of nonsensical beliefs-- unrestricted capitalism and government only to enforce property owners claims, not those of the people they oppress.
It is an evil ideology, the one most destructive to the entire human project, and everyone who participated in it is damned.

To be honest (negative stuff first, useful stuff at the end): as someone who has studied US fair use law quite a bit and knows the type of reaction videos you used to make I think that you really were in the dark side of the grey zone, so backing out of that is probably a good idea. At the end of the day with fair use law there is typically a simple question to start with "would the consumer of my new work still have a similar amount of reason to watch the original work". If the answer is a resounding "no" and on top of that you're publishing your work commercially... well lets just say that it probably wasn't fair use. The sum of your episodes basically contained *everything* from the source material. And that's the harsh reality, a lot of your subscribers were here because of liking the source material you were publishing without paying for it. Not to say you weren't giving any additional value, but to me your "fable at the end" construction always felt a bit like a malicious hack to prevent too much of the video being used under a fair use claim. I would be sincerely curious how many people stopped watching before the fable section, but I would bet it's the large large majority. Anyway, more positively, what you could do to make your fair use claim far stronger is to use only the moments of magic (leaving out the intro, any showmanship, any reactions by penn & teller, etc.) and then discuss various techniques to achieve such effects and showing (simpler) versions of it yourself. That way you can retain at least a big group of your fans without the moral and legal issues.

@@JasonParkerMagic If they were edited well, and the right 10% were shown, I absolutely think so. Some performances that are long spectacles, like Shim Lim would not work as well in that format, but acts that have a bunch of setup to a single moment of "ah ha!" would work well. You would have to end up recording more videos than you produced, but at least you'd only have to edit the ones that had a single major moment of magic.
However, Fool Us has done you a bit of a favor in that it has a decent amount that is MADE to cut. You can easily cut the magician intro. You can usually cut the interview with Willow, er I mean Alyson Hannigan, On non-fooling acts you can cut Penn Saying how much he loved the act.
That leaves you being able to show your face reacting at first, and only showing the parts of the magic that are key. I think you can easily do so showing just 10% of the segment. Then you talk about it afterward, and link to the legit youtube links (assuming that the magicians' pages are allowed to show the performance) and still have a mini-interview at the end. I think that you still absolutely have watchable content.

As much as I like the reaction videos, CW probably has a reasonable copyright claim here. Unlike, say, a "review" where a few trailer style snippets of a show might be shown, the reaction videos contain entire sections of the show in their entirety with additional commentary layered over it. They're more like "director's commentary" style versions of the original program than something more in line with simple excerpts.
That's not to say all reaction videos aren't fair use. Basically I suspect the more of the original content that's included in the reaction video the weaker the fair use claim would be.

    • @JasonParkerMagic
      @JasonParkerMagic  3 года назад +1

Yeah they might have a claim... it's hard to say also because I only react to a small piece of the show. Usually one magician per full episode that has 5 performances. Plus I could argue my reactions and transformative commentary.. But yeah... I am using quite a lot of the video. So.... it's hard to say. But not a battle I should be fighting. Giant vs the ant in any case.

I feel like Fool Us is pretty damn cringe: Alyson's awkward, worthless banter (itself cherry-picked from MUCH footage); the embarrassing intro videos; Penn's bad acting when the audience already knows the judges have decided the trick to be a fooler or not; Alyson's realization that the trick is a fooler, and she feigns excitement... gotta admit that Got Talent is somehow even worse (size XL Dunkin Donuts).

Who knows, you might be so famous that P&T will stand in line to perform in your show :)
No investment needed. They do it on the screen. You get a nice Ukrainian girl.
Start it as for beginners. There are more young talents out there, looking for a stage as Covid virus!
    *
Extra twist: Since they have to tell to your friend, how the trick is done, you will have a warehouse of tricks, you can sell undercover. ... for the same guys :)
    *
Extra + : You could have a short interview with them, instead of a quick intro.

You can start with Mago Tomas, 16 yrs old from Spain. They need stage!

Hi Jason. I'm really happy that you have found a way forward. I've really enjoyed the reaction videos, more so that when the way a trick is performed is revealed, which to me just spoils the magic. Obviously, like everyone else, I know that magic isn't real but I can really appreciate the amazing skill behind the performance of the trick. Plus, if even P&T can't figure it out - well, that just WOW!. Take heart, keep going. You provide lots of enjoyment to your fans.

Jeeez - such crappy news Jason.
    Just some random thoughts:
I'm not a legal beagle nor do I have any particular experience with fair use copyright law, but it is possible they came after you on two specific grounds -
    A. You showed the segments in their entirety
    B. The segments shown are from the current season of Fool Us
Perhaps if you edited the FU segments down to the magic act itself and P&T's response and leave out the magician intro and the conversation with Allison? I mean this is the crux of what you are trying to do - show the magic and see if P&T can figure it out compared to your analysis. This might move you back into the fair use envelope. Maybe invest some money and get some advice from a real expert. Perhaps you can float a trial upload using an older P&T video and remove all the fluff? Also, maybe include a link to the CW YT channel of the episode?
I am amazed (and gladdened) that you are maintaining your positivity. That's a big part of your personal appeal - happy that the corporate titans didn't stomp that out of you. Were it me, I'd probably be well into the 2nd day of a 5 day vodka bender by now.
I doubt writing P&T will help. Even if they were willing (not guaranteed), while they may own the material, CW owns the distribution rights under contract. There is little P&T could do.
I don't have much money, but I'll send you $100 so you can continue to eat (at least for a week). Keep on plugging away, think outside the box, stay positive, avoid vodka benders and you'll come out ahead I'm sure.
Looking fwd to your next series of videos.

It's worth to challenge the automated copyright claims via YT. I think what the FU production company did was to have all of the current series red flagged so nobody just blatantly uploaded them. What the algorithm probably didn't recognize was your commentating+reacting which is covered by the fair use act.
If the FU folks had manually challenged that many of your videos (successfully) this channel probably wouldn't exist anymore.

Tbh, if you fought, i'm pretty sure you would win....
There's some thing I read when I recently got a claim on a video that had been up for years - was a short clip from a movie (like a minute long) and full credits, copyright, link to the copyright owner, imdb etc was all provided, and I wasn't even making anything from it.... but they still stuck it...
After investigating, if I was to do it as a reaction, or review it would be allowed.... But the majority of the video has to be your original content, discussing the 'clip'
it helps showing as little as possible... but honestly, if you had the permission from the performers, or just drop Fool-Us an email, i'm sure you'd be fine! :)

I'm totally on board with the new direction of your videos.
That said, I am begging you, to gather the troops, and try to dispute it. It's Fair Use, and on my first YT channel, I got copyright strikes, refuted the strike, got turned down, disputed anyway, and ended up with the video restored. Don't let them bleed you dry, and give up if you HAVE to, if it makes literally 0 sense to continue. But please dispute, stand up, fight back, and if they're really as all-powerful people paint them as, then go ahead and back down. But I think you'd fare pretty well.

This might not be the most popular opinion I got to share - and I do enjoy your takes on FU - but here it goes:
Reaction videos are not fair use. Fair use talks about a transformation - which means parody and the likes. There is no transformation, it just changes from "Fool Penn & Teller" to "Fool Jason Parker". Again, I do enjoy the extra bits you provide, but objectively speaking they aren't enough to stand on their own or transform it from one kind of medium to another. To me, you should still have the right to do it, but the law says otherwise. Even moreso, fighting this tooth and nail might even lead to some precedence that ends up hurting "true" (i.e. less grey) instances of fair use. And now I feel dirty because for the first time in the history of capitalism, a company is actually in the right. :/
I hope you find a good way to progress and I'm sad that we didn't get a video of you reacting to Jandro's third appearance.

I think you will do great with the new strategy. Chris Ramsay does a lot of the sort of thing that you are thinking about redirecting toward, as I'm sure you are aware, and his channel is obviously successful doing it. You are an established and eminently likable personality in the RUclips magic scene at this point, so I'm certain you will succeed with any direction you choose to take the cannel in.
I honestly can't really say that I totally blame FoolUs for wanting to control their content, or the network or whoever (although it does fly in the face of Penn's Libertarian views), but I think it's also a boneheaded move. A fundamental misunderstanding of the new media landscape. You brought nothing but hundreds of thousands of new fans to their show lol. I would watch the show, and your reactions, hand in hand. It really detracts from the show not to have your commentary to look forward to, or any commentary (I'm guessing) from RUclips from his point forward.

  • @kevinwells4986

It's late, I'd like to read all the reactions below - but I'll get to the point. Have you ever reached out to Penn & Teller? You are a fan first of all, if you were to do it like music video reviews (and there are a lot of those) - and you interrupted perhaps more often with insights/commentary, maybe it would not be 'copy right infringement'' per se. I don't know, but I can't see why what you are doing would at all impact their business negatively. I was never planning to buy and own old episodes of Penn & Teller, even though I like them considerably. Without you I probably would not even think of them. I hope you can regain the ability to do your reviews, I truly do. I'll keep watching you, but there always has to be a reason you know. I'm left with the fact that you seem to be a great guy, a pretty good magician, and someone I like to hear from. But your reviews of P&T were fun.

As a software developer who is time and time again trying to figure out a way to escape from the corporate grind (it doesn't matter whether it's a large company or a hip startup - management tends to be cut from the same cloth. And then you have a decent chunk of developers spewing hot air but who are actually more or less clueless.), I can totally empathize...

Sorry to hear about the big hit, but glad you developed a plan and will be continuing the success of your channel. I always look forward to your content. I honestly wondered if the Fool Us train could continue since you were tackling every episode and showing the full acts from the show. This competes with their own channel and the show itself. I personally ignored their postings and would wait for yours to get the added value of your commentary. Side note: having their shows reproduced on RUclips and not under their control probably weakens the value of their syndication rights for the show...so I'm not surprised, just saddened. Good luck with the new content and I'll definitely be watching.
