Melania Knauss (her maiden name) first came to the US in August 1996 on a B1/B2 “tourist visa.” Tourist visas allow someone to stay in the US for six months, but they can’t seek employment in the US during that time. Then on October 18, 1996, she got an H-1B visa for “skilled workers” allowing her to work legally in the US as a model. The problem is that Melania was “paid for 10 modeling assignments between September 10 and October 15” - while she was still on the tourist visa. In other words, she was working on a visa that didn’t legally permit her to work - and thus was violating the terms by which she’d been allowed to come to the US.

Nope it's the about the only piece of legislation he's proposed that's sensible. It should have been done decades ago when the UK, Australia and New Zealand ended the practice. It's a reflection of a bygone era and needs and no longer relative to the requirements of a modern USA. Almost all will never notice any difference. The lure of universal birthright citizenship will end for migrants and associated birth tourism and children of temporary residents will avoid the burden of involuntary US citizenship on their return home. The naturalisation pathway to citizenship will still be available for all those not eligible for birthright citizenship.
Trump would have to pass a new Amendment to cancel the 14th Amendment clause on birthrights, and that's very unlikely to happen. But Trump knows very little about the Constitution and how the U.S. Government works.
Trump thinks he can do anything he wants, and as president he can make others do anything he wants. For him that's how government works, all in the service of him and his desires.
The legal argument is that since Ted Cruz’s mother was an American citizen, he was an American citizen at birth as Children of American citizens are American citizens.
@ If you really want to know just how she became a “citizen” goggle it. She went through no process she was fast forwarded by her gangster thug of a husband They are both pigs and creepy.
If we do not have birthright citizenship, then how would one go about becoming a citizen?! That's what I don't understand - no one is aking what it would be replaced with. SMH
Many countries have made the switch. At the prescribed changeover date, to obtain US citizenship at birth, at least one parent would need to be either a US citizen or a legal permanent resident. All others would have to follow the naturalisation pathway to citizenship. It's not retrospective legislation and only future newborns would be affected.
leave and apply like millions of decent people have done and are doing. there is nothing broken about the immigration system. it has merely been deactivated in favor of open borders.
@@garyyoung3179 OH - so it's not ELIMINATING or doing away with, the birthright citizenship - it would just be limited in the way you describe? Wouldn't that just result in all kinds of fraud, though?! And THAT would require some kind of investigatory and enforcement at every single hospital across the country? Is that even worth it? It's an academic argument, though, as it's codified in the Constitution as total, and that would be an awful heavy lift to change....
@@DickyNuts That is incorrect - it hasn't been "deactivated," for "open borders." That's absurd. There is TONS wrong with the system - in fact, that is the ONLY thing EVERYONE agrees on! lol
@@cpaul9269 It's no different in practical terms to how things operate at present. Most every developed country in the world follows this system. The UK, Australia and New Zealand for example all made the changeover decades ago. It doesn't require any hospital enforcement. Citizenship is only bestowed when a birth is actually registered. Generally, proof of parents status is either required at that point or when you apply for your first passport. So there's no great chnage involved. It's what the parents of US citizens born abroad have to do already. It's a worthwhile change as it fixes a few issues such as the lure of potential anchor babies and the burden of temporary residents' children becoming 'accidental Americans' However you are correct most administrations have not considered it enough of a priority to bother with overcoming the very high hurdle of Constitutional change.
I believe in Birthright Citizenship. If babies born here aren't U.S. citizens, where else would they be deported to that would allow them to enter? Would they live their entire lives in U.S. detention camps?
If you’re born here and not recognized as an American, then what ARE you? A stateless person, with NO rights? And revoke citizenship for those who already ARE citizens? Somebody explain THAT one to me,
If born in the US to a non US citizen or non permanent legal resident you would would still inherit the citizenship of your parents so not stateless and US citizenship would still be attainable through the naturalisation pathway.
Ending birthright citizenship would ultimately set a precedent for just revoking more citizenships in the future. Families that have been here for generations could be booted back to a country they might not even realize they're from
Section 3 of the 14th amendment to the US Constitution - why not enforce it and spare us all from this chaos? Or has the Constitution already been suspended?
Look at you cowards still going with the lawfare. Remember how that worked out when you cowards tried to take Trump off the ballot in Colorado and Minnesota? SCOTUS crushed that garbage. These dirty tactics are what help get Trump elected. Keep it up.
I'm basically a child of the 60s being born in 1956...not the "hippie, drug using 60s" but just "some new and often dramatic, less formal social structures & directions, 60s." I attended elementary school 3-6th grade at William Cullen Bryant Elementary School on the west side of Cleveland, OH. It was during this time, I learned about the very American phenomenon of "the mixing bowl," of ethnicities, (and it was presented as a positive,) it's also where I heard one teacher's opinion that America was more a capitalist country than a democratic country, (pretty accurate point, I'd say, but why I remembered that?) and if I'm not misremembering, it's where (6th grade?) we also learned about the book "1984," by George Orwell. I don't think we had to read it or do a book report on it. I think the teacher just explained to us what it was about during a history or social studies time. Would I have had the very same educational learning experiences if I had been in elementary in the last 10 years? Obviously, public education, and freedom of knowledge in this country is under attack by special interests (primarily religious right) and has been weakened over the last few decades.
No, Trump is a legal US citizen, which makes his kids US citizens. Now, if Trump was illegally in this country and had a kid born on US soil, then yes, we would deport them as they are here illegally. A simple concept yet hard concept to grasp for liberals somehow, as you are all commenting similarly. For being the more educated party, dems sure can't think critically about this. I'd say you're stuck on stupid, all thanks to fake news propaganda
Shout out to “anchor babies”, I think that’s a beautiful term and thing to be. Babies are the future, if you’re born here you are ours and you belong here.
It's a throwback to a past age and no longer relevant to the modern USA. Babies born here would still be able to attain US citizenship through the naturalisation pathway if they didn't meet the requirements for birthright citizenship.
Not if the parent is here illegally. Meaning they are criminally trepassing in the US. It's ok, Trump won't deport just the parents, he'll deport the entire family together, the way it should be.
Outdated and reflective of the needs of a bygone era. The UK, Australia and New Zealand all made the switch decades ago. It's time for the US to catch up with the rest of the developed world.
Can anyone explain the Birthright citizenship issue? Aren't most, if not all American's birthright citizens, including Trump? Wouldn't Trump lose his citizenship as well? The only ones that can be considered to be Real Americans would be the Native Americans since they were here on this continent long before the colonials moved here. So, I'm a bit confused here.
It's not retrospective legislation. It would only affect newborns after the prescribed switchover date. At that point only those with either at least one parent a US citizen or legal permanent resident would acquire citizenship at birth. All others would need to follow the naturalisation pathway to citizenship if it was desired.
Super cool his story… going from working in his folks Chinese restaurant to lawyer and attorney general! Then suing president of US. Only in America folks.
Should be ended and the US catch up to the rest of the developed world. Jus Soli birthright is very much a 'New World' thing almost nonexistent outside the Americas and is reflective of the needs of a bygone era.

IMO, The DON 👱🏾♂️, is not a positive lawmaker. Unless if you're at the least a millionaire ; hold on tight 🤔
Every time Trump opens his mouth, he proves he doesn't qualify for president.
In other words, she was working on a visa that didn’t legally permit her to work - and thus was violating the terms by which she’d been allowed to come to the US.
bro you are an amazing researcher/whistleblower. Milk and cookies for you!
No one is saying that about Melania, but if it was someone else it would be a problem.I believe what is good for the goone is good for the gander.
Yes, I posted that she worked illegally in the US. It was mysteriously deleted.
So did Elon Musk
I wonder if that includes his son. His mother is an immigrant who came here on a very questionable visa and worked in the States illegally.⚖️💰💩🤡
Wouldn’t there have to be a process of amending the Constitution with ⅔ of states approving it?
But he is immune from laws now, SCOTUS will let him make an Imperial Rule that supersedes the Constitution. Think what's next!!!
Ya wanna know what Trump is going to do on his first day? Well he's having a prayer fund raiser, then he gets inaugurated, then he goes to the Whitehouse and watches the inauguration over and over on FOX, and other stations. Maybe he'll get in a quick round of golf
& take a nap, & have a BIG MAC.
He's going to drain writing implements of their ink, signing executive orders and rescinding JoeBs bull dung 🐂💨 policies.
And some McDonald’s hamburgers.
And will be bragging about having the biggest crowd at his inauguration 😂😂
It will be President Musk running our country, because TRUMPTURD is old and tired, playing golf on our dime!
The end of birthright citizenship would mean sending everyone back except first peoples.
Back where?
Most American blacks still don't know where their ancestors came from.
@ I agree. I was trying to point out the absurdity, as are you.
Black Americans cannot be deported either. My family lineage has been here since the nation's inception as captives. We aren't immigrants!
All respect and love to the original peoples the Native Americans who had their land stolen. All praises to my enslaved ancestors who were a stolen people who built these United States for free. Everyone else can get got!
We are all immigrants. Are trump and vance not married to immigrants?
Musk not born in USA either, Vivek parents were immigrants
Black Americans are not immigrants 😊
Black Americans are not immigrants. They were kidnapped and sold to America. Never got paid nor receive grant money like immigrants do sometimes to build wealth. I love all races and learn to respect all cultures. Immigrants chose to run from their homeland to build a better income but black people have been in America since the European.
Big difference between you getting married to someone from another country and them being able to apply for citizenship and a lady running the border pregnant and the kid being a citizen.

Very little? Amend that to ‘nothing’.
Just wait until you learn that the 14th amendment has been incorrectly interpreted.

Thank you Sir for standing up and put a stop to Trump racist agenda.

Doesn't barron trump also a part of birthright citizenship?
No, Trump is a legal US citizen, which makes his kids US citizens. Now, if Trump was illegally in this country and had a kid born on US soil, then yes, we would deport them as they are here illegally. A simple concept yet hard concept to grasp for liberals somehow, as you are all commenting similarly. For being the more educated party, dems sure can't think critically about this. I'd say you're stuck on stupid, all thanks to fake news propaganda
No Barron Trump is an American citizen by birth, though not natural born.
This doesn’t affect me but thank you for standing up.
Thank you, A.G. Tong!
It's unstainable in today's world.

No, you are missing the point but you know that.
@@mleiboldStephen Miller is planning to deport U.S. citizens. Is he missing the point too?
It's not retrospective legislation. It would only affect newborns after the prescribed switchover date. At that point only those with either at least one parent a US citizen or legal permanent resident would acquire citizenship at birth. All others would need to follow the naturalisation pathway to citizenship if it was desired.
Trump wants an excuse to lock up women with their babies and children. He wants them in detention camps we taxpayers pay for. He loves that.
