    I'm not against criminalizing marital rape but there are some things we should consider :
    1. On one hand, sexual intercourse with a woman on pretext of marriage that too with her consent is recognized as rape and on the other hand, we want to criminalize marital rape. Don't you thing these laws are contradictory?
    2.Just by making a law on this is not going to solve the problem, so we must first educate the society about this topic and sensationalize men to treat their wives with respect and empathy instead of looking at them as objects. My point is that.......THE SOCIETY MUST BE READY TO ACCEPT THIS LAW OTHERWISE IT WILL BRING CHAOS!

      Sexual Intercourse with wife with or without her consent is 'not' recognized as rape by law. It's an exception to the definition of rape. That's what has been explained.

      most of those countries have neutral laws, fake cases are punished and the innocent are compensated....but in India all the laws are women-centric and innocents are never compensated...

      @@mairahmalhotra315 Potential of misuse depends on the framing of the law. If the law is framed with bias against men, it will definitely lead to rampant abuse. And every problem does not have a legal solution. Some things should be left to societal change.

    If the wife is not consenting for sex , thats alright. Can the husband got to a prostitute for sex ? Can he develope an extramarital affair (now that adultery was decriminalised)? Can he have more than 1 wife (Polygamy)? Why should the marriage not end up in divorce when the wife is sexually not interested on her husband ?

    Go through all the cases.
    All were allegations of unnatural sex and rape with objects.
    Sex is expected in marriage.
    That is why consensual sex is persecuted if the woman "alleges" that consensual sex was done under the pretext of marriage.
    A marriage stands void in front of law if no sexual intercourse takes place.
    Denial of sex is a ground for divorce.
    See what she says @4:00, it was not plain sex, the woman alleges that she was forced to have sex the day her father died, in front of minor children etc. That is clear cruelty under 498a.

      @@amritpalsingh3293 In the USA, a husband has to pay alimony even if the divorce happened due to wife's cheating, because cheating is not a crime.
      Feminists will sooner or later bring that law in India as well with the help of support of people like us who do not educate ourself on how laws are pushed based on our misinformed opinion.
      Are you ready for that law in India since you support the idea that cheating should not be a crime?

      @@anujkumarrai8450 in USA, investigation is done before arresting a man even on charges of Rape and only if there is prima facie case, the man is arrested. The laws of domestic violence and even sexual attack are gender neutral.

      In USA you have to pay child support to a divorced wife even if the child was born from another man, when the women cheated. Paternity frauds are not punished in USA.

    All those country who have criminalized marital r@pe have gender neutral law.
    India r@pe is not gender neutral, male r@pe is still legal when perpetrator are women .
    First make r@pe law gender neutral then talk about m@rital r@pe.
    1st - men are also victim
    2nd - misuse of biased law is higher as compared to gender neutral

    It's ironical so when it's about marital rape the argument given is it violates Art 14 and all, well it's true it does violates that but then what about making definition of Rape in IPC gender neutral, doesn't that definition not also violates Art 14, but when someone ask about this s/he's criticized by these organizations like it's being unreasonable.

    Thanks to the centre in highlighting the fact that criminalizing marital rape would destabilize institution of marriage. Already when there are so many false cases by women who want to take revenge against their husbands, you give 1 more tool and society will go into anarchy.
    Hope more saner voices come up against criminalizing marital rape.

      Agree. Except that you are putting it very lightly. The issue of false cases against man is a far more important matter the courts can rule on, than adding a marital rape law.

      If the institution of marriage is based on rape and sexual slavery of the wife, then such an institution should not just be "destabilized" but Nuked right at it's core. I am a man and I support criminalization of marital rape. Anti burglary laws are the most 'misused' laws. Does not mean we legalise burglary.

    We are not against the law but misuse of the law will be high in marital rape cases and how to prove rape is another concern in front of law & investigation agencies. There should be a broader discussion about this topic and every concern should be noted so we can come to some conclusion. Now the way Indian society is progressing towards modernization so every concern or issue should be addressed for the wellbeing of society.

      Just on the pretext that it can be misused doesn't mean it shouldn't exist. Plus modernization is a necessity be it in the three sectors of the economy or in the society. Modernization is irreplaceable if the target is growth.

What I want to say is that when someone is getting divorce on the grounds of marital rape it should mean that it is an offence therefore it should be made illegal but still there are lot of ppl who don't believe in marital rape including many high profile politicians which is pathetic.

    If Marital sex is to be crimilazied.
    Would a husband be persecuted if he sees her wife changing clothes or say hugs her without asking her etc. etc. etc.
    Can a husband and wife's relation be taken on par for persecution under outraging the modest of women laws, molestation and laws of such kind?
    Or we are just waiting for the laws to be passed in western jurisdictions.
    Because laws for viyerism, molestation even in the west are not applied to husband.
    in Marriage there is a right over each other sexual lives, that is why adultery is a valid ground for divorce.
    Denial of sex is a valid ground for divorce.

      Those who disagree can chose live-in relationships so the male partner can still be prosecuted under current rape laws.

    I think men are blissful unaware of how the police and courts treat you if an unknown lady even makes a statement against you without any proof. Whether you've even ever met the person or not is immaterial. You go to jail. Period. Evidence furnished by the man is rejected by the investigating officer and he is sent to jail based on the chargesheet. In the framing of charges which takes between 6 months and 13 years, only the charges mentioned in the chargesheet are admitted. It is after the framing of charges that the man can admit hai evidence. It is then based on this evidence many false cases are brought to light by which time the man has lost his sanity and contemplates suicide. Adding a marital rape charge is going to make things much worse at this point and will I deed destabilise the institution of marriage. The law favours a women's word over a man's evidence.

      Yeah but with lot of issues the court has no problem in acting out of their jurisdiction. Like putting a stay on farm laws. Also it was the court which had started the entire CAA, NRC mess in Assam. From which the BJP got the idea to do it in the entire country .

      @@gigglypuff3589 it will be sham law just to malign male partner in case of disputes. As u can't prove this case in any scenario.the women can just use this temporarily harass and extort her male counterpart. As u can never prove it in later hearings.
      If 100 cases are filed,all will be released as not guilty (no Justice).

    Sex is a private thing. People dont do sex on streets. They do it in their bedrooms . If you are speaking this much on bringing law , Could you please give some suggestions on how you would prove that the sex done is consensual or not.
    It cant be on just the saying of the female .
    Tell measures.

      Marriage itself is consent, if a women wants to withdraw that consent, she can do so by applying for divorce, so everybody can come to know that the consent has been withdrawn.

    The court and Legislators entering the space between wife and husband will only complicate the relationship...Yes, the marital rape is violating Article 21(Right to Life and Liberty),,,The courts can direct the couple to a Psychological institute where they can get awareness of life, gender equality, sex, traditional belief and acceptance of patriarchy, cognitive behaviour etc..,(and also identify the root cause of the problem). The legislators can help building such institutes under Human Rights Council. Merely changing or ruling laws unconstitutional doesn't help much(reaching the masses, traditional acceptance of husband-Boss, in many communities).

    One wonders why marital rape is not an offence in India. This is just another example of the fundamentally patriarchal nature of Indian Law, no matter what noises by legislators & judiciary are made about equality. The Supreme Court uses 142 as it pleases her (or would the honorable judges prefer the masculine pronoun here?) and finds it difficult to rule appropriately on marital rape?

That a protective law is/can be misused is no argument against not having it at all ........Maybe a solution is that, as the govt. distributes free prophylactics to prevent pregnancy, govt should also freely distribute an upgraded version of that South African device Rape aXe to all married women in India and help set using it a social standard. Consent question can then devolve to 'who removed the device'... Would one like that?

      You know what a man &his family goes through when he is falsely accused?!!..he gets arrested and jailed instantly without any investigation or evidence(just by mere word of a woman)..how ridiculously crazy is that!..the humiliation that one goes through when he gets arrested is unbelievable!       There is a big problem in criminalizing this without changing the justice system. It would give one partner the equivalent of a one directional nuclear missile that can be used for extortion/custody of kids/ sending the partner to jail etc, and all based just on a statement and no evidence whatsoever. This skewed power will kill marriage in general.
      Yes, it should be criminalized, but there needs to be very very very strong and robust safeguards to protect men who are accused until they are proven to be guilty.
      False cases are as much of a reality as genuine marital rape and any law should come down heavily on those who committed rape as well as those who falsely allege it. A man commits suicide every 9 minutes in India because of these false cases. I don't think we can dismiss that as just outlier events.

    it is better to go for divorce , if wife thinks she was raped...
    I think females should be independent... educated..... so that she doesn't have to be dependent on husband aur her parents or relative....
    sometimes it only shows that if female wants to take revenge.. she ll file charges like marital rape... or Harssment by husband or his family.
    IT is better to leave that person or family as early as possible.. and single, independent, stress-free life.
