How were you damaged? By watching the game you would have never had the option to watch before without Sunday ticket? Or do you think you can walk into a store and just take a spoonful of peanut butter...cause that's all you really want. Regional broadcasts exist. Are you harmed because your local ABC network doesn't show you the local news from 1000 miles away? You know why NFL has an antitrust exemption? To ensure that local games are available freely on networks. Local. Why are they a monopoly? Because every time a competitor comes around...no one watches. It's not the NFL making themselves a monopoly, it's fans. What is your damage if you can't watch Seattle while living in Miami? What's the dollar amount? Damages have to be proven, and both the experts and the Jury took a BONKERS way to calculate it. You don't get to sue the Hummer dealer if you bought one when the markup was 100% during the shortage. If you bought sunday ticket....watching those games was clearly worth the money to you at the time, so....how were you damaged? If you didn't buy sunday ticket, you have no standing in this case and you CLEARLY weren't damaged by the pricing of Sunday ticket. It's like someone buying a van Gogh and suing because the actual paint he used wasn't worth 10 million. Florio's legal analysis is a perfect example of why he talks about football for a living instead of practicing law. I struggle to believe he passed a bar exam anywhere honestly. This case was NEVER and could never, be about making all non regional games available on network TV nationwide. That is CLEARLY covered by the exemption. There is no legal precedent for forcing someone to offer their services in ALL markets at ALL times. That's not how it works. If you break the NFL's exemption, you don't make shit cheaper or require games it to be on your local network, you empower the Cowboys to negotiate their own deal, and the packers etc etc. Suddenly if you want all the games, you are paying for 32 different streaming subscriptions. I mean if you are a Broncos fan, you clearly want their home game service(they would only control the broadcasts at home)...but when they play Vegas away...well Vegas controls that broadcast, so now you have to pay for THEIR service as well etc etc.
It harms us because if you live in a state your team doesn’t play you get screwed. Sunday ticket is incredibly overpriced which encourages people to watch local games instead of the team your root for or the best game. I lived in Mississippi for 4 years and had to illegally stream the Giants because that wasn’t the game that was on. Now if i want to watch the best game on TV i can’t because i can only get the national game. It bully’s you into spending an insane amount of money for a product that should be available to annoyone.
Nobody was harmed. The people that bought Sunday Ticket did it willingly, knowing full well what it cost. That is a mutually agreed on contract for entertainment.

I’m a lawyer (but I don’t do this type of work and I don’t practice in federal court), and all I can say is that this wouldn’t happen in state court where I practice. There has to be a REALLY compelling legal reason to overturn a jury’s verdict no matter how insane their decision was. Seems unfair to say “we are leaving the judgement in place, but we are erasing damages without awarding a new trial.” Hopefully the appellate court reverses.

So several issues I have with the judges ruling. You can't wait for results to make that kind of ruling #1. #2 you have undermined the juries decision and are unbelievable. #3 is how can you call someone unreliable for not being able to put together a prediction of what it will look like. I hope the FTC looks at this now as well. They are stupid with the things they go after, but then things that have a lot of weight and would be meaningful to the country, they look the other way. I am a Seahawks fan in Florida so I just miss half my teams games if not more and I can't afford Sunday ticket so I end up watching my games through redzone which sucks.

Good chance this comes back on appeal. They can have a separate trial on the question if damages (although this could take years). The NFL might end up wishing they had just eaten the $14B.

You’re literally not being forced
A jury can never figure to the penny what the damage was in an anti-trust case. The jury has to make a determination and add any penalties. Then the plaintiff and the defendant negotiate a settlement to avoid an appeal. The judge should have let the $4.7 billion stand and then the negotiations would have found a more reasonable number.

One uncomfortable thing I realized, we the consumers, don't care about antitrust violations or even outright monopolies, if we like the one in charge of the monopoly.
The main example is Steam, which more or less, holds a monopoly on PC gaming, but we like Steam, so we back them.
When it comes to smart phones, we pretty much have a duopoly, which is pretty much the same effect as a monopoly, with Android and Apple, but we like their products, so again, we support them too.
The NFL has a monopoly on football, seeing as no one cares about the Spring leagues, and we still watch every season.
So yea, we like monopolies, even if we'll never admit them.

Mike, do the plaintiffs have some sort of reliance argument? If the judge had ruled at the beginning that their experts could not testify, then the plaintiffs could have presented their evidence in a different way. But the judge ruled up front that their expert witnesses were good to go. Can the judge pull the rug out from under the plaintiffs like that?
Justice doesn’t exist in America but this isn’t new. It never has.

I will be moving on to some other sport to watch even though I have been watching football for over 50 years. So I'm out. We'll see if the NFL eventuallly gets straightened out. Here are just a few things they will have to straighten out. 1. Officiating must be improved. At a bare minimum they need to bring back the challenge of pass interference. 2. Considering how much money is allowed to be spent on gambling now there must be audits by legit third parties of the Officials so we can be confident they are calling the games without any bias. 3. Get rid of "black outs". No blackouts for online live games.
My hours got cut slightly a few weeks back. Watching this clip gave me a clearer understanding as to why that happened.
