Austin theory of sovereignty
Intro : sovereignty means the supreme power and sovereignty is very important for state
2theories come under it monistic theory and pluralistic theory
Monistic theory
Monistic means single it states in a state only one can be sovereign it can’t be more than one only one
Where pluralistic means more than one can be sovereign
Monistic theory was given by John Austin it’s other name is legal theory
John Austin was English jurist he gave many lectures on law he wrote a book also this book contained the monistic theory
Main idea of this theory was that if in a society there are many superior ppl and one of the superior ppl don’t listen to other superior person and other ppl seeing him also do same than the person not listen become the political superior

.positive everyone follow him
.negative sovereign don’t listen to anyone don’t follow anyone
Feature
Sovereignty is essential for the state
Sovereignty is absolute :it is without any condition
Sovereignty is indivisible
Sovereignty is a determinate person:a ll person in society can be sovereign but one of them is always more sovereign that he don’t listen to any
But everyone listen to him
Sovereign is source of law the person who is sovereign if make law will be applied to all
This theory was also criticised and can’t be practice at now
Criticism
Not absolute a person can’t be superior he also sees the society and follow the society ex: custom tradition in society are also to be followed by the sovereign he is not absolute
Not possible in underdeveloped communities: as they follow the rules that there ancestors showed them they don’t believe in any sovereign
Sovereignty is divisible:like state is powerful at its place and lcentre is powerful at the centre hence sovereignty can be divided
Sovereignty is not unlimited:sovereignty is limited internal limitation external limitation there is always some limitation attached to it
Law is not command of sovereign always:our nation has customs culture tradition although it may or may not be command of sovereign
Undemocratic : democracy is not followed ppl are not given supremacy it give rise to a single person who is sovereign hence it is not good
