    Arrest him I'm disabled I 4get buss pass then I don't travel... now a breach I would walk up and say this guy has distressed and worried me like to make complaint, then u can knick him breach ... disability does not give u the right too use mental health or physical ...and be entitled other people are entitled to go about the journey with out this person cause distress too other passengers if he disabled shame on him

    I'm a bus driver, we can straight up say no to anyone we feel causes distress to either ourselves or passengers... We cannot physically throw anyone off the bus but we CAN refuse to drive the bus with them on it

      You're a bus driver, and like the majority of bus drivers, you are bad at driving and simply WRONG. You do not have ANY legal right to overrule the law, which clearly states exemptions for disabled people. Mind you, since you posted that just under 2 weeks ago, if you're still paranoid, you really shouldn't be in a job that involves being around strangers

      Personally I don't really care what people do on the bus... But disabled or not the bus driver had every right to refuse him as he does with anyone else for any reason 🤣
      It isn't against the law to refuse travel.
      I could refuse to take you for example purely because I don't like your face.
      It is written in the terms and conditions of use at every bus company.
      I never mentioned the legality as it's completely irrelevant as is your comment.

    We can refuse who we want for whatever reason we want. It is a condition of carriage… Regardless of reason, it is within our right as we are in charge of the vehicle. If we feel somebody acting a certain way will make other passengers feel intimidated etc we are well within our right to not let them on board

      At the same time, you still have to abide by UK law. Not sure about these exempt cards but for disabled people this means the bus company complying with the Equality Act 2010.

      @@Jackary1232 The official statement from Arriva's conditions of carriage, much like all other companies in the UK. The statement in particular, "The driver has discretion at all times as to who boards the service", hence implies that the driver can indeed refuse you with no valid reason stated, as they have the discretion as to who boards the service!. Obviously you are not allowed to discriminate against any protected characteristics which surely does go without saying. However if you feel somebody is being rude/unpleasant towards yourself (Regardless of race/disability etc), you are more than within your rights to leave them waiting an hour for the next bus. Maybe in that time they can learn some manners!

      @@MetalFan10101 wasn't though arriva company policy was and has to be withing uk law and all regions of UK state excempt status self declared and state excempt no proof required and this was on arriva and others twitter Facebook and websites, with arriva giving with national rail the sane list of possible reasons including bpd, ocd, schizophrenia, adhd autism and other hidden disabilities, the lists were just examples the law stated that and recall Helen whately junior minister health stating on media thid could be something a Dr wouldn't even diagnose as could be u tried mask for while and realised it affected you so u decided to not wear but self declare so there's no way a gp could make a decision about excempt status

      In the devolved states of uk mask mandate still there look up there government online and Scottish rail and various supermarkets etc and bus companies and you'll find exempt status exaclty sane as July 2030,self excempt and no proof required once u state when asked or state on entering your excempt thats it

      Well in this case he was and arriva would've informed driver he was wrong hopefully customer was able call them and give basic details even if like me a full complaint is difficult I when told yes u don't have to show proof say can u make sure depot is told and then contact me to say so

    It's a tricky one for the following reasons - the gentleman videoing is absolutely correct that he doesn't (or didn't) need to show anybody any proof that he is exempt. The bus driver (more specifically and by representation, the bus company), on the other hand, can refuse travel to any individual within the guidelines of the disabilities act. By deduction, the bus driver cannot refuse this person travel on the basis of their lack of a face covering, but they can refuse travel on the basis that their actions could compromise safety. This in turn, however, could be argued to have been created by the bus driver's refusal to transport him in the first place. Ultimately, you don't (or, again, 'didn't') have a right to be 'protected' from people who don't wear face coverings, because there are exemptions in place. The rules dictate(d) that you have a right to be protected from people who don't wear face coverings AND aren't exempt... Which they're not required to prove. See the problem? In my opinion, the best thing the bus driver could have done is to say, "Good morning... Thank you." And taken the gentleman on his way. If passengers have a problem with that, their gripe is with the law, not the bus company. Incidentally, it's mildly comical that the bus driver's face covering isn't being worn correctly!

    I was a bus driver... i dont care if u pay or not😂 but the company does and if they send a ticket inspector on the bus it will be the bus drivers job on the line or he will get called to the office. Can you imagine if everyone said they are exempt?
    A bus drivers job is hard as it already is. They deserve way more money

    Bro anyone can just walk in and say they are exempt. By law you are required to show some kind of proof when asked to support this claim if not the bus driver has full right not to let you on the bus. That is just how it works.

      Yet under the law, the onus of burden of proof was upon the driver to prove the passenger wasn't exempt. There is also the small matter of 'Doctor/Patient Confidentiality' & the 'Right to Privacy'. A person's medical status is between the Dr & the patient. Bus driver's are not important enough for a GP to risk losing their license by providing proof of a medical condition to them.
      Ever seen a medical certificate signed by a GP for the eyes of a non medial professional? It has the absolute bare minimum of info.

    Sadly I was a bus driver and originally those that were exempt were supposed to show their exempt card, but then it was either changed or bus operators just said let people on with or without the exempt card so not to get in trouble and be complained about.

      When I read through it you didn’t need a card and as far as I’m aware there isn’t a official card for it. People were allowed without medical proof under the ‘reasonable excuse’. Not that it matters now it was a load of garbage anyway and pointlessly annoying to deal with.

They don't have to permit anyone travel anywhere, they can literally eject a passenger for any reason, and can refuse to take people anywhere, in the same way that disruptive passenger would be kicked off a flight, despite having paid hundreds for a ticket, and likely not given a refund. If the company (Arriva) want people to wear masks when boarding their bus, or train, and they refuse, they can refuse to permit them travel.

I also don't need to be a driving instructor to have noticed 100% of bus drivers drive poorly - not indicating, pulling out into the opposite side of the road when traffic is there, speeding, pressuring cyclists and other road users by driving right behind them, not checking blind spots, and, as mentioned, stopping right behind cars in traffic, only inches from the bumper.

      Take it up with the government of the day ignoramus. If you say you're exempt that's it you do not have to show the person asking anything to do with your medical issues . And you certainly do not have to get off the bus its then up to the driver to stop the bus and alert his company now if they want to contact the police let them attend and you can give them the name and address of your dr . Then when the police get in touch with him and he tells them that you suffer with say trigeminal neuralgia or any other neuralgia of the face . Then you sue that bus company in court .

      And in an ideal world....that's what should happen. Law and order, and morals are in the gutter in this country, and they have dragged the great out of Britain with them. I can remember the 1960s.....and it was a lot better then. We need an absolute 0 tolerance to all bad behaviour, and crime.....we need harsh medieval punishments reintroduced, and we need people in government with some idea what they are doing....instead of the wishy washy politicians we have been lumbered with.

    As a bus driver I would've switched by bus off got out the cab and waited for my inspector to arrive I personally would refuse him travel due to his behaviour as of our company policy

      Since July 2020 done this a few times for a few companies each time satisfied with company be it arriva, costcutter, morrison, tesco also I kept up reminding various companies about the rules and agsin all said yes we are well aware we can only ask and if thry say excempt we can't ask anymore no. Proof of excemptions needed England before July 2020 ot rest of UK now or tfl in London or if we go back to face mask rules soon my guess is if we go back to ruled England more will legally self id as excempt

    I have Autism myself and don't agree with the camera guy.
    You do need a card showing you are except but the card doesn't show what the reason is. I wear the card every time I go out to avoid this situation.
    Secondly, bus drivers can refuse service to anyone without a reason, with Autism or not.

      I don't normally agree with old bill, but in this case its a clear breach of the peace, so it is a matter for the police. Also im disabled & except & under the Covid-19 guidelines, if you are exempt then you should have a badge that you can download from the British lung Foundation, or Asthma UKs Website, or you can go to your GP & ask them for proof that u have breathing problems. I keep mine on my phone, so if anyone asks I have it. People say that you have to have it on a lanyard around your neck. No you don't, you just have to have it on you, so if your going into a public building, or using public transport you can show it if your asked to & if you don't have it, or refuse to show it, then the driver can refuse you transport.

    It is always a condition of carriage that the bus driver can refuse boarding. It’s his own subjective opinion of what poses a safety risk to himself or other passengers. The legal enforcement of mask wearing involves issuing a fine. He is not trying to do this.

Anywhere in uk any location any ground transport taxis uber train bus or coach, or retail or hospitality or even nhs proof was never required and there wasn't any proof anyway just lanyards badges or screenshot, download or hand written I'm excempt etc no actual proof but none was proof and none was a legal requirement only self id I'm excempt was all that's needed in devolved areas or now tfl London no actual proof

      They may not legally have had to show an exemption card, but, if they genuinely had one, and had feelings for others cares and worries they would show one anyway. Most of them didn't have one to start with and argued the toss rather than pulling together rather than helping each other. Possibly one of the reasons lockdown went on so long.

      i have no ailments but do have a disability a learning disability but i could have had an excemption but i tried a mask and found i could have one on comfortably so i wore them i once sat at the back of the bus and because the back of the bus was so warm in summer i felt sick so i moved to another seat and was fine after that but the guy was right you dont have to show excemption card its only to show you dont have to wear one and you only had to say you was excempt thats it and he did that so he should have let him on

    He has autism. As a bus driver myself I would have allowed him travel to limit service disruption, and not all people who are exempt have the card. But ultimately it is up to the driver and probably best to accept the refusal of travel and get on another bus. But even allowing travel for someone without a mask can cause other passengers to complain. And on occasions passengers would remove the mask when seated, but that is out of our hands. Fortunately our company policy prohibited drivers from wearing masks due to safety issues, since wearing a face mask can restrict breathing. But I can see why drivers who are forced to wear a mask would dislike carrying passengers who would ignore it. I'm just glad face coverings on public transport has been dropped, with the exemption of TFL.

    I have had many problems with this particular bus company. Its people who are not genuine who say that they may be exempt from wearing a mask when actually they might not be, from the drivers point of view I kind of understand but at the same time he is not paid to police passengers that is not his job his job is to drive the bus and get people to where they need to be safely. It’s people who fake being exempt or fake needing help that they actually might not need that puts people who are genuinely exempt and who are genuinely in need of help in a difficult position

      The person has even stated there excemptions 3ven 5hough he does not have to he is autistic and no doubt like me sensory issues, oxygen issues and more under law he only had to state he's exempt he was correct police and driver wasnt if driver and police had bothered to contact customer service they would of been informed no proof needed driver u have to take this person as most como2ar3 fully aware which is why they and retailers don't challenge as no point when we had face mask legislation, which stopped July anyway then excempt in all 4 parts of uk is self excempt, state your excempt and no one can ask u why ot ask u to show proof

      As for genuine or not there's no such thing, when exemptions came in health minister stated excempt status could be someone who really find a mask difficult to wear, they don't have to have a recognised disability or prove such

      another issue is that in them refusing puts others on the bus at risk I drive all day long and on busy days can take well over 400 people and every one not wearing a mask increases my risk of catching it and needing to take 10 days of unpaid leave (ssp)
      a lot of gobby shits can't be arsed to wear one and i (not often) refuse travel, I am aloud to refuse travel and I don't have to give a reason, I can just say I don't like that person, I see loads of people with exemptions and have no issue with them but the ones that try to start shit with me I don't tolerate it and you get a feel for them immediately.

    Since when did bus companies offer a free service to people without a valid Disability Freedom Pass as evidence of identity?. The bus driver was correct, and the policeman was correct regarding breach of the peace, the fact that he got off the bus resisting arrest proved the point that he was in the wrong.

      That would be true kind of if he had left the cab but most companies fully sealed the cabs at one point or the other you can see this cab has been fully sealed up around the front to where the doors actually are on this one it's just one of them things in a way the driver has his own point because it's him who is keeping everyone safe but at the end of the day all the driver would have to do is ask politely to open a window and let some air on the bus or give him a note/transfer ticket to get the next bus.. I Think with all these videos allot of it is left out so you don't get both sides of the story 😊

      Then customers will be able to contact police and customer services and seek support probably police won't care but can assure u bus companies will there were cases of public attacking verbally non mask wearers and complaints were taken very seriously and passed to. Police stating we have customers who can't wear masks they don't have to identify to anyone and other customers must respect this or could be in trouble

    Just had a quick read up on the government website and you don't need to show an exemption card however, you may feel more comfortable to show an exemption card for added reassurance to the driver or anyone else for not needing to wear a facemask. As long as you've given a valid reason, you should be allowed

It's one of those things that has set rules and terms, in the case of a bus they expect you to act amicably on board and not be abusive or disruptive or endanger other passengers, not to smoke on a bus, etc. The driver can refuse you travel, ultimately although it's a TFL service the buses are owned privately by private companies such as StageCoach, GoAhead Group, Arriva, Metrobus, etc, all of whom will have their own differing internal policies, and it's down to their drivers whether they permit travel to someone or not.
      TFL can suggest and give guidance but ultimately any bus driver can refuse travel to someone as they're the operating firm, not TFL.
