      I think he wants to present himself as a liberal judge, but that's not true. He has not been able to safeguard the constitution and the people of India. He is not even allowing bail, for example, Umar Khalid has been arrested for 3 years under UAPA but there is no bail, and there is no proof against him.

    Then make another marriage act same sex marriage act. How difficult is that. ??? India is a Hindu country and not an Abrahamic country. In Hindu culture there is nothing against homosexuality.

    A lot of people have preconceived impressions about what LGBT actually is. They see it the way media portray them holding a rainbow flag and covered in heavy and exaggerated makeup, having beard yet wearing jewellery this is part of it but not limited to that only. There are also those people who are well built as masculine as a heterosexual man who behave like any ordinary man but not straight. When people began to have broader understanding of this subject there’s going to be more acceptance.

      if i become supreme court judge, i swear to god that im gonna destroy this rule and law of same sex marriage, legalization of adultry, and all otrher such rules acts asnd laws which are against nature created by the creator of humankind and universe...i would rule as a crime for those who go against nature.       basically what he's saying is that only the parliament can amend the special marriage act/pass a new bill for same sex marriage.....the court can only strike down unconstitutional laws for example Section 377 (rendered unconstitutional in sept 2018)
      This is clearly in the hands of the parliament so we need to vote for parties that include SSM in their campaigns which i don't think any of them do unfortunately

    The word marriage as an institution cannot be passed better as taiwan passed as union of two people. Moreover the law cannot be made by SC . It's something that must be discussed in parliament and we know in India what can be the outcome.
    Moreover it's not easy to passed the law , with marriage comes responsibility and there comes many more zones. I believe for this another section need to be added .

      Look at the US debate, they have question how to define a woman? No expert in USA has ever defined it. No wonder then,
      This brainwash Concept of same-sex marriage is percolating from USA madness.
      Any creature or evolved species have desires and attraction for their opposite sex and there is a natural reason why, that is procreation. This is not offense against minority. And what would gay people achieve after enactment of this law?
      What difference will it make if enacted ? Their justification need to be heard before proceeding to any Madness.
      It is a movement - like government supplies in Needles to drug- addicts in the name of saving their lives.

      @@varoonnone7159It's important to remember that being a lawyer or gay doesn't automatically mean someone is saying something sensible. Society or courts allows sex but doesn't allow certain people to marry, which doesn't make sense. We often need the law to enforce societal norms, such as in the case of marital rape being ruled by the court, despite society not initially accepting its existence.

    When a gay man marries a woman, it's not just his life but also the woman's life would be ruined. Same thing for lesbian woman and a straight man.
    But people do get marry Bcoz of family pressure and societal norms.
    Legalising is the only option

    But the question is Right to Love and Right to association family is considered fundamental rights. And courts can't simply be in denial that its the duty of parliament. The thing that court should have done is to direct the Government to pass law on marriage equality. If country like Nepal can do. Why can't India?

    Don't make this a small issue sir, it's about the life of thousands queer folks in India, you are saying "you can't come court for every issue and that court should draw the line" when no one is supporting the minority people in a country, its the court duty to work on, and it's not a small issue it's a big issue, it's the right to choose a life, which judiciary can not just ignore, during 2018 judgement it's the judiciary which took first step to remove the taboo from society, if not judiciary do you think parliament would do anything about that till today? The answer is no and the parliament won't do about same sex marriage in future also, the Indian society won't change and queer people will have to forcefully marry someone because of the societal pressure! Don't you think these things are happening now! Every queer people in village small town are getting pressurized to marry, they don't have any other options, they literally don't have any other options and it's a big issue it's a huge damn big issue acknowledge it.

      Make that millions. Even if only 1 percent of Indians are gay. That's still 14 million people.
      About 7 percent of Americans consider themselves to be other than heterosexual. It is likely India has a similar count, which skyrockets this number to 96 million people or 9.6 crore.

    If the court won't listen to the Public, who will? He also knows that the government these days works on matters that will give them the majority of votes to ensure getting re-elected. Who will speak for communities whose votes will not make much of a difference.

      Marriage is a contract between a couple and people of the area. if the people of area are not ready for such marraiges why should be legalise it. Also CJI is right this is under the realm of Parliament. When people deem to find this acceptable they will enact a law.

    It's just his excuse to appease the government. He is a loyal bhakt who wouldn't bring any such law in India without the government's approval. He pretends to crack down on cases so that he stays in a balance but is weak enough to not take a stand of bold issues. He is the CJ who feels he can say anything in other cases where he feels so strongly but doesn't want to in cases where he simply can't relate with the idea because he hasn't lived through the injustice people in the community are subjected to everyday.

    If India is a secular country, then how was the minority and majority decided - on what basis?...
    Where is fundamental rights of Hindus?
    Why should secular govt run only Hindu Temples?
    Hindu society feel cheated in secular India.
    In India, secularism and justice equality means oppression of majority Sanatan and promotion of abrahmic religions.
    Free Hindu Temples from govt
    Allow gurukul shiksha..RTE..
    Remove places of worship act.

      Why government controls temples? You need to ask the state of Gujarat they control the Temples in their state.
      I am a Hindu and I want the government to control the temple, otherwise it will go under the control of hooligans and a certain community who discriminate other Hindus. Example is Chidambaram Temple which is not controlled by the government, in which we can see and hear day to day discrimination on devotees by those who are managing the temple.
      Abolish the discrimination within the Hindu religion before asking for freeing the temples.

    I find the body language of the interviewer outrageous. He is forgetting that he is interviewing the Chief Justice of India. I believe that the CJI is being very tolerant to such behaviour.

If one isn’t treated equally, then neither can one be criticised on an equal ground.     Also our father purchased 1 plot from the company, on 13/09/2007 the company also issued a "lease and purchase deed" in which it is written "10 years non-assignment to anyone" Our father's lease term is 10 years on 06/01/2010 while still in Hawaii.       As a gay Indian these are the following reasons:-
      1) India still doesn't has a uniform civil code, basically there are personal laws regarding marriage, divorce etc for different communities like hindu personal law(for hindu, Buddhist,sikh,jain,parsi) muslim person law and Christian personal law. Dissolving these laws and replacing it with UCC would've been the first step to marriage equality and it was also in BJP(ruling party)'s manifesto but due to opposition consolidating muslim votes and dividing Hindus on caste based reservation benefits, they opposed it and now BJP doesn't has a clear majority so enacting it will be difficult.
      2) CJI chandrachud was in favour of legalization of same sex unions but it was ruled out by 3-2 majority last year in October, they said this will effect essentially all laws regarding domestic violence as well as rapes because in india rape is only defined as crime done by man against woman, a man can't be recognised as raped legally and for that the legislature would have to step in judiciary alone can't do it.
      3) some judges and a percentage of India's population is homophobic and half of rural india doesn't even understand this concept.

    After my interaction with people, I came to a conclusion that gender doesn't matter at all, gentle temperament, good character and behavior is more important.
    I myself got to experience triple trauma:
    1.dealing with a narcissist and other mentally ill person
    2.dealing with personality clash
    3.dealing with other toxic behaviors
    I feel like there are problems that need to be addressed like who will be married and are qualified to become parents, the issue on teenage pregnancy is also a problem...
    The problems faced by our society have been brought by heterosexual people mostly..

    Soon after the judgment against SSM, CJI Dr. Chandrachud was there in US and gave an interview in connection with SSM and the judgment. Are there no other issues apart from SSM for those who interview CJI in Oxford, Harvard or in America. There are so many burning issues which are not touched on which the CJI could have been an activist but unfortunately I seem him always speak passionately on this one topic. This is my view.

    I disagree. It WAS court’s duty to protect Lgbt people from the clearly homophobic government and give them rights on urgent basis. It WAS a matter of fundamental rights and being able to live with dignity.

      Yeah absolutely the court has to protect its citizen regardless of their gender according to the law. That's what he is doing. He's clearly interpreting the law which is his duty. He's just an interpreter of law. He's not a law maker. Simply put- he can't make the law, he doesn't have the power to do so nor it's his duty and doesn't have the jurisdiction to do so. Marriage doesn't come under fundamental rights. It's under personal law and under it there's no mentioned of same sex marriage rather it clearly says husband and wife which is male and female.
      Law doesn't work like a dictator, it has rules, forms and procedures to follow.
      If you don't have the balls to follow, then you better stop complaining.

    They unanimously said right to marry person of your own choice is not Fundamental Right! Is that also something the civil society should be "discussing"? They took the right of marry person of your own choice back, which was allowed in Lata Singh v State of U.P. judgment (if I remember correctly). Now the state governments are making anti conversion law, the UCC in Uttarakhand even adult heterosexual people to register even for live-in relationships. The Supreme Court got the lowest hanging fruit and decided to deprive on of the marginalized and vulnerable people of their right to get married, which might provide them some protection against malicious actors. They did not do complete justice.

    In case of male and female creatures/ organisms in animals, birds ( living on earth or under water) etc of the nature, almost all the male creatures / organisms approach (different sex creatures not the same sex creatures) ie., female creatures , from time to time, to satisfy its physiological / biological, sexual desires etc, mostly by undermining / hardly maintaining family relations.

    Contrary to the animal culture/ jungle law, human culture, traditions, family life, relationships and its values, ethos etc., particularly that of Bharath human society have been proved / accepted by ancestors / experts, as natural, Universal, eternal human law, with certain exceptions to that of imported / foreign toxic family dynamics imbibed by certain fanatics.
    It is not clear as why the systems, in name of freedom, are hard to open Pandora’s box like same sex MARRIAGE ( relating to physiological / sexual desires which are so dynamic as that of toxic family dynamics) mostly trivial / extreme in nature ( as same sex union is not resorted to even animals, birds, other creatures - other than humans) by exhausting the precious time, resources etc., of human society, at the stake of Bharath human culture, traditions, family life, relationships and its values, ethos etc.
    Further, the growth / evolution of any creatures mainly depends initially upon female creatures / organisms ( even in animals / birds etc.,) of the nature, it takes full / total responsibility to nurture, nourish its babies to certain stage of self-reliance, independent.
    Same sex seems to be of the nature of cases like contract union / living together & may be falling under extremity / triviality, hardly expected, are being tried very hard to bring it under the definition of marriage, though not envisaged in the initial definition of marriage. It appears to be the outcome of certain international self proclaimed intellectuals and it seems may warrant questioning/ disputing/ litigating all the meanings / definitions of any word in any language, which is the base for any law / rule / regulation on the planets.
    It appears that this may lead to different variety of grounds / relationships not defined anywhere in any scriptures / religious texts / dictionaries on any planets and may result in involving intellectuals including self proclaimed in the relevant subject / field to find new meanings to existing words, simultaneously innovate new words, deal with variety of cases etc.
    Further exercise of discretion (instead arranging for framing/ formulating / enacting of unambiguous laws, rules, regulations by legislature / parliament) and interference in redefining word (s) differently from it’s standard universally accepted definition instead of interpretation, may warrant questioning/ disputing/ litigating all the meanings / definitions of any word in any language, which is the base for any law / rule / regulation on the planets. It appears that this may lead to different variety of grounds / cases in addition to the pendency.
