My suggestion is instead of lambasting "non-compliance" rather focus your energy on zoning in to find out the challenges of first time business owners trying to figure all these compliance matters while trying to build the business itself.
Don't be out of touch with the history of this country, perhaps your department needs some sociologists and historians to advise you so that you can come up with positions that make sense for the context.
@@mukondelelic.mulaudzi8357 True I agree with you there, and it's not always the case where people don't know in which direction to go sometimes it's cipc and sars systems that complicate things for their users and first time bussiness owners won't always have the money for an accountant but rather have to navigate through these complicated systems themselves and just give up
Kindly elaborate on the problem you are experiencing, to enable us to assist you.
@mukondelelic.mulaudzi8357 I 100% agree with you. All this rubbish red tape is making money for accountants and all the newly created "specialists" who are charging anywhere from R800 to R5k for the service. I am a bookkeeper and do not understand what the difference is between an "affected" and a "non-affected" company. When dealing with US and UK issues, you can Google anything and find a simple straightforward solution. When Googling SA issues you are sent to one 50 page document after another. No of which answer your question. I don't have time to read all these legal documents. My clients are electricians, property developers, graphic designers etc. They certainly do not want to read all this rubbish. When will government departments change to Keeping Things Simple. The majority of small business owners are not skilled in admin and government regulations. And they shouldn't have to be.
Kindly note an affected company is a regulated company as set out in section 117(1)(i) and a private company that is controlled by or a subsidiary of a
regulated company as a result of any circumstances contemplated in section 2(2)(a) or 3(1)(a).
• An affected company includes-
• A public company;
• A state-owned company;
• A private company - in terms of the transfer of securities when exceeding the percentage prescribed by Minister (10%)
within a 24-month period;
• A private company that is controlled by an affected company (regulated company) or is a subsidiary of an affected
company.
The CIPC is refusing to accept AR if the BO is not submitted. In the case of Non profit Homeowners Associations it is a massive struggle to get all owners to provide their id copies etc because now we have to get all owners to submit their proof of residences etc. How do you do that when there is 400 + owners? Without the owners providing this we cannot submit AR? So we are being held hostage by CIPC and threatened with de-registration. This does not make sense.

Kindly note an affected company is a regulated company as set out in section 117(1)(i) and a private company that is controlled by or a subsidiary of a
regulated company as a result of any circumstances contemplated in section 2(2)(a) or 3(1)(a).
• An affected company includes-

@@theCIPC that doesn't help me. Please explain what the difference is.
Kindly note Non-affected company without beneficial ownership information - companies that are not classified as “affected companies”, and have no (nil) beneficial ownership information to declare, will select this category. The CIPC system was a failure for a long while. The system has not been riddled with errors even when I tried to re register the system had error messages. I am now being deregistered. After two years. It’s just sad that they do not communicate with companies, and they do not allow companies to rectify the two year lapse. They were at fault to start off. Now that they have suddenly got their puzzle pieces all fitted, the world must now fall apart for some. The website is not very user friendly. Sometimes people are sick and cant continue with business immediately or they run other endeavours and they dont have the time to juggle all the balls in the air. So dont deregister business if they are though compliant but are still dormant. There you do not have a right as CIPC. After covid people sufffered financially and was ill and there are reasons if there are still dormant companies due to people will start it but with covid, stress and other financial stresses people cant get to do all as they planned. So you would be acting unlawful if you do remove legitimate dormant companies. You did not send out emails to all last year on this matter.
