    The reason why NIJISANJI made such perplexing moves on both public relations and legal fronts today, I believe, primarily boils down to the following two points:
    1.They severely lack expertise in the oversea (English-speaking) world legal affairs and public relations.
    2.They mistakenly believe they can manipulate public opinion by using tactics commonly seen in Japan to suppress unfavorable information. Just like the recent scandal involving sexual assault within Johnny's, which only surfaced in the last year or two, the leading figures in Japan's industry are accustomed to using their influence as an excuse to suppress or cancel factors that are detrimental to themselves.

      To be more specific, they mistakenly believe they can manipulate _western_ public opinion. All of this is working fairly well on the Japanese community unfortunately. When you are raised in a culture where Corporations are treated as literal gods it's very easy for them to take that side.

      1st one is plausible since Anycolor (then Ichikara) tried expanding the Nijisanji brand overseas back in 2018 with China and Taiwan, but failed in 2019.
      2nd one... it'll take some whistleblower within Anycolor to spill the beans regarding the gross mismanagement.

    The major issue here is that they fired someone in the middle of a mental health crisis who had sent them documents through her lawyer.
    They fired her while she was in the process of what you might call an HR complaint about management and other creators under contract.
    She sent them document, they fired her, gave other creators access to the document she filed through her lawyer, and THEN made her mental health issues public through their statement to justify her termination.
    This is absolutely insane behavior.

    For Vtubing companies, posting a public contract termination for the fans is probably the norm. However, this is the first time I have seen a termination that was issued FIRST to the public and not to her. She straight up said she was as clueless as anyone else. The fact that the company listed their dirty laundry in the termination notice is even worse as they should have just give her the termination notice, then issue a public termination notice without any unnecessary legal stuff that is shown in this notice. In the best way possible, they should have just said she broke NDA in some kind and left the rest to the legal team.

    He only usually does 1 hour streams but it almost went 6 hours with max of 6k live viewers. He just started down the rabbit hole and will do a part 2. And then maybe even other vtuber legal issues like zaion or rushia later.
    He tore apart nijisanji arguement and their PR disasters. He started impartial but within 1 hour he was swearing at anycolor. The elira, vox, ike statement really peeved him off

    The most important thing to remember about this drama is that Nijisanji did it to themselves. This isn't some typical drama where one person calls out another person and tries to cancel them. Selen/Doki had not said ANYTHING before the termination post. We the public did NOT KNOW that she was being bullied within in the company, let alone by other livers. NIJISANJI IS THE ONE WHO TOLD US THAT. It is genuinely unreal how insanely incompetent their PR/Legal tem is.

      the prevailing theory is a complete failure in the comms department where somewhere along the way they thought the document that Selen sent them was the one that she was threatening to expose... how that mistake got made when it was the one she had them sign would only remain between those parties is just insane levels of incompetency but crisis mode sometimes makes literal underqualified, overworked, and underpaid management (have you SEEN their job listings) make really stupid mistakes

    The issue with this whole thing is that is written so unprofessionaly almost sounds like some teenagers with a vendetta. As far as defamation and slander in Japan go. They dont care if someone has the proof in the world theyd still be found guilty lol read up their laws. Here's another proof of their black company tactics. Another recent graduated talent formerly known as pomu rainpuff had open her membership content for everyone. The only video that was privatized by Nijisanji was a membership video where pomu was crying venting her frustration about their management.

    It took them almost 2 days to NOT respond before she posted a video, but TERMINATED HER CONTRACT WITHIN 2-3 hours when confidential documents sent by her lawyer. I think it's beyond unprofessional behavior. I just don't have right words.

      yeah guys the law youtubers like legal mindset content is interesting, you have to be really invested in the specific topic though because - funny enough - a stream runs long when you're trying to read through filings or explain law to people like us who know nothing. You just have to bear in mind it is a long ride and the length is what it is.

    The thing about the termination notice I would like to point out, though, is that in the world of VTubing, where the talent is a very public-facing personality, and the fact that you can't just replace the actress/actor behind the avatar (they tried this years ago with Kizuna AI; it *did not* go well), firing the talent is the same as retiring and shelving the avatar. In that sense, it's necessary to post a termination/retirement notice, because fans *will* notice and unannounced/unexplained absences, as was the case with Selen suddenly going off the grid for over a month. Announcing a termination is standard practice in the VTubing world. What Nijisanji did *wrong*, however, was going into the stuff mentioned starting at 1:18.
    Contrast it to their biggest competitor in Japan, Cover Corp/hololive. Earlier in January, Cover had to terminate one of their original talents (as in someone who's been in the company since 2018, when the VTubing branch wasn't even a year old), Yozora Mel, but her termination notice was just a simple "She broke NDA, and it was a difficult decision, but we have decided to terminate our contract with her." That's it. No digging up dirt, just a simple announcement, and there legitimately appears to be no bad blood between everyone involved, just sadness and heartache over having to let go of such an esteemed member. The CEO and some staff members even posted farewell tweets, and Mel was allowed to tweet one last time to say goodbye to her fans even after her termination. It came as a shock, and a terrible day for fans, but no one held it against the company. Even when Uruha Rushia was terminated in 2022, which was a much messier affair due to a lot of factors, the termination notice itself was professional and intentionally vague, simply mentioned NDA being broken, again with no dirt or personal grievances aired in the announcement.
    It's such a massive contrast in reactions and steps taken that it's almost inevitable that the way the two companies handled these terminations so close to each other be compared.

    Should compare it to Hololive's termination notice for Yozora Mel released a month prior to this mess. It was done with more tact and reverence for the talent versus the character assassinations that Niji posts on its terminated livers.

    So something to note, the copyright permissions that she was missing was Nijisanji's. Because she used Niji livers in the music video she needed to get permission from the company and the individual niji livers in the video yet even then Niji couldn't get that done

    Omg. That’s literally what I was saying from the beginning and people always get mad at me because I’m distracting from the actual issue (?) I’m not completely sure, but what I always say is that all of the issues that Nijisanji first started having is when they made the EN branch because has been extremely obvious to me that they have no idea how things work in America and they needed to do their homework. At the core of everything- the problem is ignorance- but they are a powerful company and ignorance on this level can cause a lot of damage. Now…it is still completely Nijisanji’s fault, but the problems didn’t start with Selen or Zion, but I started seeing issues back around Yugo

      You know I remember years ago I came across 39Daph's channel back when she was just a small time YTer and I recall one of her stream she had mentioned her illness and whatnot. At the time the image I got from the person was she's pretty reserve and perhaps even timid. I am aware that over the years her channel grew but was never really an avid watcher. Who would've thought that years later I would see news about her again and not even in a good way but then again it seems to be the same with many YTers you see over the years; you just see the obnoxious/nasty side of them that you never thought existed. Its like that Dark Knight quote some times: You either die as a hero or live long enough to see yourself the villain.

      The stream was a break of the whole fiasco and its major points and where they fit a Legal case for Doki to fill to attack Kuroshit.
      Also, Doki being Canadian, means she's protected by PIPEDA (And more so the MOST SEVERE VERSION, PIPA PIPEDA, exclusive to only one district of Cucknada), Kuroshit nuked themselves by causing SEVERAL BREACHES of Doki's Privacy, filling for a Privacy violation in Cuknadian Court has her have the best chances of winning.
      As for those who hate Legal Mindset, they are the same bunch of Ls that idolize the leftardist or trashier side of Legal Tube, like Leonard French and Legal Eagle, the two trashiest Leftardists that can't keep their fucking personal bias out their interpretation of legal matters.

    To me this feel like a personal vendetta inside company. I mean, like whoever was in charge of Selen or was the bridge with Japan really hate her. Maybe years of bad comunication, + the obvious cultural diferences just stressed the guy and snaped, because the chain of events were to fast and too "personal". Like terminate her inmediatly after receving her legal document, showing the document to the other livers. Then postin that absurdity of notice were you incriminate you own livers on bulling to save face, looks to me like a manager who dint know how to work with the western livers and allowed a bad work enviroment, panicked after Selen disclosed the suicide attempt. A very obvious , "it was not me, it was them". Then forcing the livers to do a pr statement on their channels instead of the corporation normal ones. But then duing it the same day and hour as Selen returning to her old account... way way to emotional and personal responce for a company.

    The fact that they publicly fired her *through Twitter* is what's crazy to me. When I lost my last job, they put me in a conference room alone to tell me personally, and in private. Away from my coworkers, away from the public, it was between them and me and it stayed between them and me.
    Nijisanji didn't fire her and then make a Twitter post about it, that Twitter post was her firing.

    The most annoying part about how nijisanji handles "breach of contract" with terminations: other livers get away with doing the same things with no problems.... meaning those rules are either made up on the spot or selectively-enforced.
    Easily the most unprofessional talent agency ever. Nijisanji will sink as soon as the Chinese investors pull out.

    There's a really good post in the Niji subreddit by someone that has worked in public communications that does a good job of theorizing what could have happened...that being that someone thought Selen was going to go scorched earth. That the document she and her lawyer sent them and wanted kept private was actually the statement she would release. Niji was ready to go to war, while Selen wanted it done quiet.
    I'm not going to try to explain all the nuances of what this theory said, but I personally think it explains some of the baffling communications from Anycolor and NijisanjiEN the best of all the crazy theories going around. As sad as it sounds, this entire dumpsterfire realistically could have been the result of a stupid miscomminication.

    they have the work contract that basically making them "own" the person. especially in nijisanji, according to ppl that got offered, the talent behind vtuber must not have other job, dont tell anyone about your job as vtuber, they are not allowed to criticize or talk bad about the company.

    they are using work contract as a way to "slave" someone, in the name of NDA the talents must do what the management wanted. they said that retiring is an option anytime but in practical they must wait if there are other talents who are also leaving or if the work contract is still have sometime before running out. the company wring dry the talents from the merch cut with 2% for talents, projects cost must be from the talent's own pockets

    5:51 as I understand it she got confirmation from the artist, not in proper legal document or normal process for the company she worked at, they (because of Japanese copyright law) have a whole chain of command to get it in place.

    It's not uncommon for these companies to put out a contract termination notice. But it's usually just "Rules were broken and we have to uphold our NDA contract."
    This one felt like a personal attack.
    It's supposed to he a document more for fans, so we know a little about what's going on. Look to recent termination notices from Cover Corp regarding their talents Mel and Rushia.

On the one hand, he's certainly right that (especially here in Nijisanji's case with Selen's termination), this sorta practice of posting termination notices is basically inviting a legal nightmare. On the other hand, it's become standard practice for VTuber corporations now because, like with graduation notices, they allow a talent's viewers to know that their oshi will no longer be streaming, and for termination notices specifically, for them to know that it's particularly because their oshi was terminated (and the distinction is important because the former allows the VTuber to stream of a certain amount of time before doing a final, "graduation" stream, whereas the latter means that the VTuber will no longer stream, period; and in some cases, it also means that all their content up to that point will be deleted, outside those that were uploaded by third parties like clippers and such).
    I feel like Niji fucked up here (specifically in terms of posting the termination notice) because they showed the full thing (or at least, presumably; there could be a longer, more detailed document that we don't know about). The full notice is something that would (presumably) normally only go to the person being terminated and their lawyers, with something more curated and summarized being uploaded online like what Hololive posted for Mel's termination. Not to say that Hololive's notice was "curated" in the sense of being edited to sugarcoat or something, but it's at least both more professional and more suited for a viewer's notice compared to what Niji did here...

I also read the GURRAT, and while I do think the point they raised is a possibility, I also don't like how the GURRAT switched the focus on Niji management's failure to Elira being the mastermind of it all, and as a result, a lot of people switch their focus from the management to Elira as well
    While I believe, even if the GURRAT is true, Elira would be nothing more than just a small gear within a much more complex system in the Nijisanji management. EN is not the only problematic branch in Nijisanji; IN, KR and ID were all decimated by the main branch, and I don't think those have anything to do with Elira at all, also don't forget about Mirei Gundo's termination/graduation, because that shows that even in the main branch, management really only care about stock, way more then their talents, and the problems EN is facing right now, again IF the GURRAT was true, would only be the result of the main branch's negligence. Removing her would simply make room for another 'Elira' to take her place, so really for me, if we really have to complain to someone, don't waste time by complaining to any of the livers including Elira, just focus on the management, I still believe they are still the main bad guy in all of this, even with the GURRAT

      Elira is still a bad guy. When someone gives you a power doesn't mean you can just abuse it. She's the bully allegedly, why just gonna forgive her? You can just target the main villain and it's troop.

Is it not going to just make things worse for both parties, especially for Doki? Because as far as i’m concerned all of this pointing fingers nonsense is going nowhere and is taking the attention away from the very fact that Nijisanji and its management did not do their jobs.

    The was an analysis by a comms guy I saw where he speculated that the initial, disastrous termination notice was due to Niji legal misinterpreting the personal account by Selen documenting her alleged experiences with bullying as something she was going to release publicly (rather than just a private notice for Niji legal), and trying to get out ahead of it.

    It's funny. If this ended at just Selen's termination I could say Niji was in the right at face value since I know from a corporate standpoint they want to be the ones with permissions instead of said employee as a means of covering their arses in the event something happens.
    However, after hearing Selen's side of the story and Niji airing out their dirty laundry with her in their termination letter instead of letting her graduate, dragging other livers into this related to a legal situation they had no business being involved in it's hard to feel sorry for them in any way.

    It's so funny how the girl who got bullied wanted this whole thing to be private and just wanted to leave the company. However the dumbasses at the company loaded the glock and shot themselves in the foot and made everything public😂
    These people could have had the easy way out and fired the girl and moved on. But they just had to do stupidest things and break the NDA. And then go and tell everyone that they broke the NDA publicly and then blame it on her 😂

    about the song in question: Selen (now: Dokibird) apparently worked for a year on it. and i highly doubt it, she did it in secret all the time. this makes me assume, (her) management should have had lots of time to check all of it and to check that she had the OK of all rights owners involved.
    and one more thing: how can i believe any allegations about her "violating" the rules, if it is stated that she did so since her debut. and yet noone seemed to have any issues with that alleged behavior - or otherwise NijiSanji would have punished or terminated her years ago over it.

      1.Just my assumption, since i dont work in niji. They know what she work under. Then some vtubers who was in the video is graduated/terminated. Selen refuse to delete them, niji dont give her right to use other vtubers images.
      2. If your mistakes is minnor - no one care until you make a profit. And Selen, as much as i know, was popular, which mean profitable.

    I still think the Problem with the permissions was that the permissions were given a year ago and management wasn't sure if all the permissions are still there (especially for livers that left the company during that year). Still a problem of bad management tho.

    but the management clearly underestimated the range of influence that Selen have already gained from the beginning of her career until the incident.
    they did the same move they've used on Zaion. termination and livers statement to actually plucked out the nail instead of hamerring it.

    I think releasing the notice is good for something like Vtubing. I would be very upset if they terminated someone I like without explaining anything. As long as Vtubing history goes, it is still pretty new and pretty much depending on fans/people who come by to support them but in this case they know it's a breach of contract they know something not proper happened and they still went this far into detail in the notice? That's like outting yourself. Like a certain old man from a certain organization once said: "that's a bad move"
