There are specific exceptions e.g accused being flight risk or likelihood of interference with the investigation. A bail application is not really about the merits of the case. From 08:40 of the video, Lawyer Cliff Ombeta just argued that his clients were unlikely to be involved in the crime and should be granted bail. The court granting bail does not mean they have been acquitted. Once the trial begins, his initial theory can still be countered by the prosecution.
