So what the writers missed in this was If the brother was planning the trip with his wife, they would have both had plane tickets in advance for the same time not knowing the brother/husband would have a sudden worked related hold up and couldn't go and the prosecutor never exploded that question because had they discovered only 1 ticket been bought that would have shown the brother/husband had for knowledge he didn't need to go.....
The prosecution was sloppy. She should have had ample evidence to prove conspiracy before moving ahead with the trial, and the defense should have stayed on message = no evidence, no crime. The prosecutor was banking on rage, but it was a foolish gamble, even if it did pay off. The DA would have read this ADA the riot act regardless of the outcome.
