I guess it is time there should be a law that even if a land is illegally encroached for more than 5 years and government has not done anything or authorities have given electricity meter, water lines etc then its on government and it cannot be demolished. The people claiming that land would be compensated on government's money since it was because of government's negligence only that encroachment took place and survived for 5 years.

Registration department doesn't check (or get involved) in ownership rights. All it does collect taxes (stamp duty) and do registration (more like witness) of a transaction between two private parties. This is pretty common in every country of the world (including USA). Government bears no responsibility on the validity of the transaction. USA and some other countries have something called "title insurance". Basically it provides the buyer the protection against cases related to the "title" of the property. In India no company providing "title insurance" as the risk is very high (due to some many "title" related cases).
Rule of law should prevail. In any circumstance, we shouldn't encourage illegal encroachments. Especially environment related things. Don't we have other lands to dwell. In india these type of exceptions, kindness in the name of poor led to most polluted cities of the world. They are already been provided 2 bhk houses. Don't simply criticize government.
