- A jury chose to find Jesse James Clay guilty of manslaughter instead of murder for running over and killing Joe Wade Warren in 2020.
I don't like the outcome. The man took it upon himself to get behind a moving truck in reverse. The man caused his own death. There are blind spots on that equipment.

So it's the truck driver's fault because some stupid person walked behind a truck. The guy that was killed should have been smart enough to understand that trucks cars anything cannot see 100% directly behind them how about standing to the side of the truck and waiting for the truck to stop. The driver should not be charged for anything because of the victims mistakes

@@arishem555 Tell me how was the driver distracted. The only reason the driver backed up was to let that old man put his garbage in the truck. That is not a distraction that is called trying to help an old man get his garbage thrown away. If you actually pay attention to the video the old man was standing even with the corner and the old man is the stupid one that walked forward 10 to 15 ft without the driver being able to see him. Are you also one of the geniuses that walk towards a truck backing up to where they cannot see you you do understand these kind of trucks do not have rear view mirrors they only have side mirrors and the closer you get to the truck that decreases your chances of being seen by the truck. The old man got hit by the truck because of his stupidity

The truck driver reversed and the old guy thought he would stop so he could throw the branch in the back. The pissed off driver just keep going in reverse. The driver had backup camera and at least 3 big rearview mirrors. lntentional.

Do a bit more research. Thete is a definite reason the court found this intentional. There should be a good explanation in the first 20 comments or so.

@@cakeman58 multiple videos showed that the victim started yelling at the driver because he failed to pick up some trash. Driver throws the truck in reverse, victim naturally assumes that he is coming back to get the trash that he missed. Driver, not only knows the victim is there, he has a back up camera so he can see exactly where the victim was.

On April 4, 2020, Joe Wade Warren was outside his home, trying to toss a branch into the back of a passing Texas Pride Disposal garbage truck. He missed and the truck drivers kept going.
Home surveillance video captured Warren yelling profanities at the truck driver. A few seconds later, you see the truck backing up as Warren walks toward it. The truck never stops, eventually running Warren over.
“There’s a brief moment in time where they sit there, and then you see the garbage truck drive right off," the family's lawyer told KHOU 11 in 2020.
The 65-year-old victim died as a result of his injuries.
The driver of the garbage truck was identified as Jesse James Clay. He was charged with murder in Warren's death.
The company paid a 10.3 million dollar settlement to the family.

I don't think that man should be charged with anything. It looks like a complete accident to me. This is so scary, because in Houston, a lot of people do not stop if you are backing up in a parking lot. In fact, people walk right up behind the moving car and could actually touch it as if they are just completely unaware that you are backing the car up. They don't hold their little kid's hands or anything. Some people just walk straight into the street without looking or caring if people are driving right there or not, and some people do not slow down when they drive through a parking lot. I have considered getting an alarm or a large fog horn to announce that I am backing up and please do not walk directly behind the car as I am doing that. In fact, I think that might be a good invention for all cars, to have a speaker with a human voice very loudly announcing that the car is backing up and not to walk behind it. As more and more people are completely distracted and actually have developed autism or maybe something close to it, I think that maybe they DON'T know to even check to see if it's safe to walk into the street or behind a car. If anybody should be charged, it's the city because there should be cameras and alarms on the garbage trucks to help prevent this kind of an accident.
It wasn’t a complete accident. You’re judging by a couple of seconds of video when you clearly don’t know the whole story. The driver knew the guy was there, he was pissed off at him, he had a clear view of him when he walked behind the truck, he would have been able to see him on the back up camera, and you’re not even supposed to back those things up on the street if you can at all, avoid it, but if you have to do so, you sure as hell don’t do it as quickly as it was being done here. Especially when you know there’s somebody on the street behind you because you were just yelling at him.

Because the man thought the driver was coming back to pick up the garbage that was missed and expected he would be stopping at that point, and the truck driver was backing up so fast because he was pissed off and intentionally hit the guy that he was just yelling at
Good call in the jury. Why was he backing up such a ridiculously far distance at such a high speed? It’s against the law to back down the road through oncoming traffic, you must find a sufficient point to turn around and come back. Both are at fault, but negligence on the driver is never a good excuse.
To all those commenting "It wasn't his fault--that guy should have moved out of the way!" Meh. You weren't on the jury, you didn't hear all the facts and see all the evidence. Juries don't just convict people for NO reason. It doesn't take much reasonable doubt to get an acquittal in America... too little usually in fact. Juries generally WANT to believe that people are good and innocent. But if the facts don't support that reality, they must convict.
I think we need to hear more about this subject. Why the truck was backing up, and why so fast? I think the driver only mistake is that he assumed the person walking behind him an adult that knows to never be on the street with moving vehicles, not mentioning a huge one

I don't need to see more evidence or hear any facts... The issue is the man easily could've just moved to the right of the truck. There was more than enough time to react. That's what the majority of us see. The man didn't have his back turned, the truck wasn't swerving all over the place, and by the man's actions he clearly didn't care for his own safety.

He wasn’t in his blindspot, the truck has a back up camera. They were yelling at each other and he was pissed off, he knew exactly where the guy was, and he backed up at a rapid clip in violation of all safety standards, knowing full well that there was somebody behind his truck.

There may be more to the story. The man shouldn't have been behind the truck backing up. That's what I see in this video. Someone else posted there was some type of verbal altercation.The victim was trying to throw away a tree branch. Was he ran over for cursing at the driver? They were both wrong in this situation. As a former truck driver, I was not backing up if there was any possibility of someone being behind me. As a person who has worked for a living, I would not stand anywhere in the path of heavy machinery. Common sense seems to have evaded both parties.

On these kind of vehicles there are no rearview mirrors, side mirrors yeah but no rearview mirrors. Prosecutor said there was a backing camera, idk, maybe it was, maybe it wasn't, maybe it worked, maybe it didn't. With all of that being said, there's still a possibility it was an accident.
