Russia made in clear almost 3 years ago that foreign fighters (contractors/mercenaries) would not be given the same legal protections as Ukrainian soldiers if taken prisoner. They knew the risks if they went there.
This guy was a mercenary he has no Geneva Convention rights. He is not a POW just someone that was foolish enough to get involved in a foreign war that Australia and Australians should not be involved in. He has thrown his life away for a US proxy war against Russia.

The 1989 International Convention against the Recruitment, Use, Financing and Training of Mercenaries extends this definition to persons recruited for the purpose of participating in a concerted act of violence aimed at overthrowing a government or otherwise undermining the constitutional order of a State, or at undermining the territorial integrity of a State.
