  • Legal experts generally agree that the scandalized Supreme Court's gift ruling to Donald Trump on presidential immunity is not likely to help him escape his New York criminal conviction on the basis of trying to claim everything he did was an "official act," but a less noticed line in the ruling could give Trump's lawyers another opportunity.       One problem is that the payment came during his presidency and the invoice stated "legal services". But much bigger problem is that prosecutor used the line of evidence that depended on official acts (which is not allowed in case of immunity) despite many warnings and objections from the defense team. It was totally rigged against defendant.

      In a similar way that Cases get overturned and people are released from Prison and now have a right to sue for damages and time served they were not supposed to serve, due to new evidence that came out or in this case evidence that has to be ignored or thrown out because it no longer applies to the case, There is no Grandfathered in when it comes to cases, In this case Judge Merchan ruled that he was Guilty of 34 counts sorry "Jury" lol, Now the ingredients used to make this Soup / Case for a lack of a better analogy were mislabeled therefore the Soup you were served (Verdict) is no longer The Right Soup / The Right Outcome for this case

      This is not the problem here. The problem is that prosecution used line of evidence that included official acts despite numerous warning from the defense that it can't be used because of immunity. Both judge and prosecutors simply ignored it. And this is the result.

      Sc just interprets the existing laws. They don't create a new rules. And judge knew the law and knew that the conviction will be rendered invalid if he allows the precluded evidence. So don't blame sc for the mistake in NY court.

      Federal or state, it doesn't matter. And the payment to Cohen for legal service happened well during TFG's presidency. But the problem isn't in that payment. The problem is that the prosecutors used a lot of evidence that depended upon official acts despide multiple warnings and objections from the defense team that such evidence would violate his immunity. And because judge ignored all warnings and overruled all objections, the whole case has to be dismissed.

Strange how most don't know this but then again when civics is only required for citizenship and those who took and passed would know this. It's way past time that the other two branches of government call them out! For that matter the Senate as well🤬. It's also a common misconception that the last word resides with the non supreme court. When you base misconstrued opinions on factual based matters this is the same as the military following unlawful orders. Seems like there are too many people who are willing to be complicit with this unlawfulness. This has always been the biggest downfall of the Democratic party.       So much gaslighting and dems are getting away with it again. The problem in this case is that judge dismissed all warnings and overruled all objections from defense team who argued that evidence related to official acts would render whole case unconstitutional and would warrant dismissal.

    I disagree with her on that one. Here's an example: emancipation proclamation. When that was given that blacks were free as slave it meant some of the previous laws that were previously enforced would no longer be. If 2 months earlier someone enforced a law and convicted someone, that was not overturned. The judge acted fairly according the law at the time of the trial. That's what happened. SCOTUS set no guideline to making it retroactive. None. If it's infinitely retroactive you can go back to Nixon and Clinton. By throwing the case you imply Merchan did something wrong, he did not. Don't give more power to the ruling that is already there. Even in appealing, they can't say he did something wrong in trial that's nonsense.

      They didn't "grant" him immunity he ALWAYS had it. As have past President's and as will future President's. So he already had immunity before any trials. Supreme court interprets constitution law and previous ruled cases they don't write law, that is Congress job

      @@zk4761 wrong. The ruling was that presidents had it all along. Even though it was not clearly defined in the past he did have it at the time of the trial. His lawyers even argued that point to the judge during the trial.
      The supreme court ruling simply confirmed the truth of his claims of immunity...

      I completely disagree with SCOTUS and Believe Trump should be sentenced. But Where i have to correct you is that, This decision from SCOTUS isn't stating what trump did is or isn't illegal; or it isn't stating what he did was illegal then but now now, therefore he's innocent. The decison made by SCOTUS is that, some of the evidence used to convict Trump is not legally allowed to be used, and thus this would constitute as a mis-trial.
      Basically meaning, If the Judge in the case is not ab le to find a 'safe' way to finalise the sentencing then he will have to legally call a mis-trial. I suppose the only benefit is that the Special Councel can re-try the case instantly and just hope they get the same Judge and Jurors with common sense that know crime when it's told to them.
      I am surprise Trump can just continue to keep finding scape goats and getting out of the grasp of the law.
      Reminds me of the saying... "Fool me once, shame on you. Fool twice, shame on me."

      It is admission that prosecutors and judge are corrupt. Defense team warned them that immunity doesn't allow them to use evidence related to official acts, but they rushed to conviction and ignored all the warning. So it was totally rigged.

      The problem for Trump is that one isn’t allowed to use two defense strategies. Either you aren’t guilty and you(r lawyer) argue why that is. Or you are guilty but have immunity, and you argue why. You can’t claim that you are innocent, but are immune if you are guilty.
      Another problem is that Trump should have put forth the claim that specific evidence couldn’t be used for a specific reason well before a specific datum set by the court. He didn’t do that in the NY trial. Then he could have had grounds for an appeal.

    However, since the U.S. slipped into the alternative reality of the Magaverse, what I once saw as outrageous abuses of authority by our own politicians and judges, now seem like mere trivialities compared to what goes on in the U.S..

      Just a little bit of filibuster trivia with regard to Biden's best friends and the role they played in civil rights. The record for the longest individual speech goes to South Carolina's Strom Thurmond the Democrat segregationist that filibustered for 24 hours and 18 minutes against the Civil Rights Act of 1957. That was the Congressional voting record Civil Rights Act in 1957, which created prohibitions against intimidating, coercing or otherwise interfering with the rights of persons to vote for the President and Members of Congress. Biden once called Thurmond his “closest friend.” Now it just so happens Biden was also good buddies with former KKK member Robert Byrd that also just so happened to filibuster the Civil Rights Act of 1964. In fact, they were such good buddies that Biden gave his eulogy. Biden himself had very segregationist ideas on busing in schools and is well known for his "racial jungle" comment… so it's no surprise that Biden praised Strom Thurmond as his closest friend as they thought alike. Biden worked closely with his buddy Strom when he wrote his crime bills that disproportionately targeted black people. True story.

    Changing the rules in the middle of the game to benefit one side is in no way fair. Presenting those arguments is a blatantly obvious attempt to sabotage a legal and fair proceeding. The SCOTUS decision should have no bearing on this case as the trial was well underway before the decision was even argued.
    It’s not like new evidence has been discovered. Or even old evidence that is now allowed. Changes in the law should never be retroactive. If they were, you would have to re-try every legal case since 1776 in order to apply todays laws.

    Surely the doctrine of waiver would still apply? Immunity only attaches if the defendant pleads immunity at the right time on the issues in question. If the defendant doesn't, he has waived his immunity. As I understand it, Trump didnt plead immunity at all, or in time, in the NY hush money trial. Or if he did, he failed to appeal the judge's ruling that immunity didn't apply. Or if he did, he failed to appeal the appeal courts' rulings upholding the judge's finding that there was no immunity. Otherwise, the Supreme Court would have delivered a ruling on whether trump has immunity in the NY case, which the Supreme Court obviously has never done (its immunity ruling comes out trump's prosecution for totally different crimes in Georgia). Surely trump cant just start pursuing an immunity claim in the NY case after he gets convicted? The more so given that any immunity argument now cant plausibly claim the crimes themselves are immune from prosecution as official acts of the presidency, and can only claim a procedural error in the way the judge - who, to repeat, was not even faced with a live immunity claim - failed to make determinations on whether some of the evidence the prosecution adduced for context, in further corroboration of matters for which other evidence was already adduced, and which in itself wasnt even necessarily required for a conviction, should have been excluded as covered by presidential immunity. Not a procedural error to not follow the correct procedure for ruling on immunity when there isnt a live immunity claim.

      First he raised a limited argument about some aspects of immunity when seeking to have the case removed from state Court to federal court. The federal judge dismissed that application and had the case sent back to state court. He found that the limited form of immunity that Trump invoked was unfounded. And he explicitly recorded that Trump had expressly waived any argument based on alleged absolute presidential immunity (the kind he is now seeking to invoke now that he's been convicted). Trump did not challenge the federal judge's ruling.
      Secondly, long after the federal judge made that ruling and sent the case back to state Court, months after the expiry of the deadline imposed by the state Court for making any such motion, and only 3 weeks before jury selection, Trump attempted to invoke immunity both as a defence to the prosecution and as grounds for excluding certain of the evidence the prosecution wanted to adduce. Months out of time. And even longer after a federal judge's unchallenged ruling that Trump had explicitly waived any claim to absolute presidential immunity.

The point about immunity is that it's never an absolute bar to conviction. Only a bar if it's actually invoked in due order, rather than being waived. The concerned individual is always free to waive it, as Trump clearly did here.
