    We first entertained the idea of constructing an off-grid cabin while completing our initial home renovation in 2014. However, amidst subsequent life changes, that dream was temporarily set aside.       Yea, I feel how you all are feeling. Even tho my wife is a Realtor, It's still exhausting to look for land. And the prices right now are way too damn expensive.

    I think I would've been ok with the clause if there was a stipulation that they needed prior approval / notice given to come on the property. But I also grew up on a farm where it was normal to go hunting on the neighbor's land as long as you gave them a heads up.

    I think you guys made the right decision. The hunting clause is super weird. I think it’s a slippery slope when it comes to allowing someone to hunt your property. Living in Montana, we have had people just show up at our door asking to hunt our property. Everyone having a story saying “the old owners let us hunt it”. I think having no strings attached was the way to go! Congrats on the land purchase!

      Whenever I hear (the old owners) I hear someone pulling a scam. Maybe its something to ask the old owners in those cases.

    I’d have gone for it, but would have had lawyers write some clauses in as well for your safety, and protection. You don’t want to be liable for any accidents. That’d be my biggest worry. Like you said though, at 90, she’s not going hunting again.
    Congrats on the property! Love the cabin in the woods. An a-Frame is a dream!

    The hunting clause is a very interesting scenario. I probably would have been weirded out as well, but her being 90 years old might have tipped the decision. It’s highly unlikely she would ever hunt again, but if she did it would be terrifying. Old people and guns don’t mix.

    As someone who grew up hunting, and still hunts, hunting was a big thing that brought the whole family together every year. Even the grandparents and great-grandparents. I would have allowed and welcomed the amendment. I understand how much hunting means to people. It was a very sad day when my grandparents finally stopped hunting due to their age. Plus, at her age, the odds of her hunting more than a few days a year, if at all, were very low. I'm sure it was more trying to hold on to those last few happy memories than it was really trying to harvest a deer.

    That was a wild curve ball! I think that clause would be a no from me. Just no strings attached. If I bought land, I bought it. If that lady wanted to hunt, she should keep the land. You can't have it all. I was surprisingly sad about her license though. You can peep them leaves on your own land now, Becki!

    Thank you for taking us along this journey! Buying property is such a daunting task, but so worth it in the end. You’ve got to trust your gut along the way. I don’t think I would have been able to move forward with that deal if the seller had been able to build that into the contract. Glad it worked out in your favor!!!

    You guys made the right choice not wanting her to even have the option of coming back to hunt the property. Not only does it seem like a big insurance risk if something were to go wrong with her alone on YOUR property, it opens up a weird web of her relatives possibly feeling entitled to hunt that land as well. What a weird situation and absolutely a deal breaker.

    Adjust the clause to include a 72 hour notice and ability to approve or decline. Additionally, limit to the 2-3 week period of peak season.

    Honestly it would have depended on where I was getting the land from. If a buddy was selling it to me and he was a hunter I'm sure we couldn't work it out. But a random stranger probably not.

    I would say if they are adding a clause, you should add a clause that you are not liable for any thing that happens to her while on your property and she cannot bring guest. Overall, I think the logic of her getting a license or actually coming were slim to begin with. Yall did the right thing.

    The hunting clause probably happens more than you think. We bought farm land from a neighbor and their grandkid wanted to be able to still go hunting on it. We did a handshake deal off the contract that he could come for the first couple of years. But you have to then worry about what happens if someone you let on your property gets injured. It certainly isn’t worth it to have that in a contract and hanging over your head.

    I always find it interesting when a property has been on the market for a long time and then suddenly there is a lot of interest when there hasn’t been a drop in price. I always tell our agent we don’t play games and walk away. Fuck that shit.

    I would have just required that, if she was going to go hunting on the property, she had to notify you ahead of time and has to actually ensure you got the message (like, you were directly on the phone with her when she told you, not just leaving a message). Then you could just make sure you're not there when she was.

    That is crazy. While I (Kelley) am a hunter and have been for over 25 years. I wouldn't have agreed just because that so weird. I would never want to walk a property not knowing if someone is there hunting. We have public land we hunt next to ours and I will only do it during bow season. Also the lability on you for that if she got hurt. Asa realtor I wouldn't want you to do it. We lease the land we hunt and have to have separate insurance we pay for that.

    Excited for more of these videos! I think the hunting clause would have had me back out. In the unlikely event she went hunting at 90 years old, she wouldn't have been hunting by herself. Having a small group of people walking around on the property with guns just wouldn't be cool with me.

    As someone who does bow hunt, asking permission to hunt a property is pretty common within the community. If you wanna keep people off, keep it posted. Sure, some Aholes will trespass but youd have legal rights.
    I think the piece of land y'all bought is perfect, though. I've been in the search phase for a while now myself. Can't wait to follow along!

    Very strange clause…. But the chances of her actually hunting the land was next to nothing. Though, I could see that opening up the possibility of bringing her son with her or other interested hunting parties and at that point, what do you do? Glad they were smart enough to tell her no on the license.

    As a real estate agent, you run away from that clause. What if she hurt herself on your land? Would you guys be liable? You had a great agent!

    90 year old wants to hunt my land, sure! But I’m thinking there’s a concession, she needs to give me a better price or pay each time she comes to hunt. Seems like the oddest ask ever, I’d likely be just like you and 2nd guess it. Glad she couldn’t get the license. Nice to know the state of NY has some common sense in that department.

    Context: this is coming from someone who grew up with a super hard right, 2A loving family and from someone who also has hunting experience and shot my own deer.
    There is a **big** difference between these two hypothetical situations: 1) allowing friends or locals to come on to your property during hunting season on a conditional, case-by-case basis, where you have all the power as the current property owners, and 2) having a written legally binding clause in the agreement of acquiring this land that allows an elderly disabled person (who realistically shouldn't be operating any kind of dangerous object like a firearm) to come onto your property at any time of their choosing with a loaded weapon. By extension you're also allowing other members of her family to also come on to the land since she needs to be driven and assisted to get around to places.
    There are some fucking weirdo ass people in these comments trying to normalize what the former property owners and the old woman wanted. Don't doubt yourself, Becki. Your gut feeling and logic was completely right to want to immediately walk away from that deal, and I'm glad the situation sorted itself out in the end and that woman was not granted a hunting license. Jesus Christ 😂 As the owners of the land, you have the authority to decide what you two are comfortable with and not comfortable with. And that decision does not have to abide by any common American hunting traditions or unspoken rules.

    Ohh Becki, if you you were so excited when your realtor called you to let you know they accepted your offer that you shat your pants, can you imagine the pant sharting that would have taken place when you wake up on a cool fall morning, unzip your tent, and are face to face with Nana Bang Bang!! Good ole Nana, her walker, an oxygen tank, all decked out in hunter orange, a rifle she can barely pick up anymore, offering you some of her pocket candy! That would be instant shitting of pants! That’s a hard one for sure though! One side you have the good karma of knowing Nana died with a smile on her face just thinking about the possibility of going hunting on her favorite grounds. Then there’s the other side where people, especially Nana’s family be Fuc$&n crazy as shit! You don’t know them, and they don’t know you. Plus you just emptied your bank account for something that has strings still attached from the previous owners? Nahhhh.. In the end it all worked out great, but you two were stayed so level headed and you both were thinking the right way in that if you had to walk away, sure it would suck donkey balls, but at least you wouldn’t have that weird feeling in your gut for years worrying about the what if’s. High 5 to you both! You did good!

    I would have been fine with the old lady's amendment. However, I would have countered with she had to wear clothing identical to Elmer Fudd's hunting gear, including the hat.
    That would have made it well worth the risk.

    Hunting someone else's property isn't really that big of a deal. Even in Canada. Not sure why you had such a strong reaction.
