    as a lawyer myself, I feel all lawyers must be compulsorily made public defenders for a particular period of time. like 1 case every 2 years or so or they won't be accepted as lawyers.

      I'm thinking of going into criminal law and I'm not sure whether to be a prosecutor or public defender. Now I see that defenders make less, so... yeah. Mind elaborating on why it should be compulsory? I'd love to hear your insight, and any advice you might be willing to offer.

      You mean like how doctors have to do housemanship work at public hospitals? It could work. That way we could have more lawyers and less burden of work per-lawyer. But will this increase the cost of public spending to hire all those lawyers? I mean is it practical? I look up on WHO statistics that in the USA there are about 2.54 doctors for every 1000 patients....so I guess for starters there need to be a study on the efficient ratio of lawyers per population.

      there aren't many public defenders out there, it's a huge problem, and the general public needs lawyers. making it compulsory will help the current public defenders develop a good career for themselves, as well as bring in the top notch expensive ones into the system.

    Case loads would drop dramatically if drug usage was just considered a health issue, not a criminal one.

      Which has started to prove out in California. We have Jails that are no longer packed and I think they are no longer looking at building new prisons.

      Eh, I've heard both sides of the story. Just to be a devil's advocate I'll try to provide a reason for the other said.
      When people were on drugs such as marijuana, crack, etc. they do really stupid things that can cause the death of others. For example, smoking marijuana has caused a couple(s) to forget their babies in the hot car and allow them to die. Sure, alcohol and smoking also kills, but that doesn't mean we should let more become legal. Plus ever heard of those stories of how people have gone broke and homeless from wanting it all for drug money? According to Adam, the prices of illegal drugs are lower than when they were legal, so they must REALLY spend a lot in order to go broke.
      Hope that made sense and was a good counter. Personally I don't really care since I will never even drink and don't care if Bob down the street decided to do too much drugs (even prescription) and died, as it was his fault.

      OK, that's fine... but you are ignoring the actual crimes, and looking to punish as to what you see is the cause. There is already laws on the books that work. Child endangerment/neglect. Various homicide related charges could be imposed in that particular instance. What doesn't work is the pay for play law system, and the fact our corrections departments are literally being rewarded to keep people locked up longer. So by stacking crimes on top of one another including drug charges, gets the defendant more time. Coupled with the fact that many laws have been passed that double your time just for being high while committing the crime. How is that logical, ethical or fair? Have we forgotten that we as a nation have separated ourselves from that kind of barbaric justice? Do we have to define "unreasonable" or just keep it vague so a judge who's having a bad day, coupled with an overworked public defender can make sure to lock up any undesirables and get them off the streets.

      Then you punish them for negligence (with the baby thing) not smoking weed. Look at booze. It causes a LOT of car accidents but we punish people for drinking while driving instead of just for drinking.

    Yyyyep. Because "tough on crime" looks good to voters and "funding the defense of people who may or may not have done anything wrong" doesn't, for some reason.
    When you think about it for a second, of course there's a conflict of interest, and we could change it if enough people paid attention. But that won't happen any time soon.

    I think the Court System should implement a policy where all lawyers must do at least one public defender case for every 7 or 8 private cases. Idk though, I'm not educated in law.

      You can't really forced people give their best. Forcing lawyers might make public defence worse off, where the lawyer prioritise his/her private clients and give less effort to public clients.

      So you would like to steal peoples labor from them and force them to pay for someone else's screw up (defendants or prosecutors). If you do that you will also take reduce their ability to pay their student loans and ability to take care of their families.

      In the US we believe survival of the fittest is something to strive for.
      Why provide healthcare to everyone, if you can’t afford it you deserve to get sick and die.
      Why provide access to affordable education when we can charge out the ass for it with debts that never go away.
      Why provide access to fair legal counsel when we can reserve it for rich people. Heck, in Arkansas you have to pay a couple hundred dollars to apply for your free attorney. If you can’t afford it then you can pay the state back with interest.

    To those asking about why do people become Public Defenders, here's the deal. Most people become public defenders for 3 reasons.
    1. They genuinely wanna help people
    2. It looks good on your resume, especially if you have plans to become a Judge or run for office
    3. You can't get another job.
    Of the three, 1. is obviously the rarest. Most people treat this office as a stepping stone. Being a PD would actually be a really great job, if it wasn't for the mountains of work and the crappy pay. PD gives you good exposure for being a lawyer. You get significant real world experience, and find out how the system actually works. However, for most people its not 'worth it'.
    And sure, private firms have similar work crunch. But tell me. Would you rather come home at 2 AM in a Mercedes, or use the subway?

      Yashendra Shukla My moms a PD, for the most part her and all her friends only work there because there's no better options. Being a Lawyer sounds fancy and all, but it's actually super hard to find a job especially for new lawyers. Most of e ones I know ended up opening their OWN firm. I do know one lawyer in Arizona that loves it though.

      Why don't they go on strike? If they can't, why not do a slow down? Make it so you spend x10 as much time on each case so that things get even more backed up.

    There was an open letter put out by a public defender- because there's a sort of prejudice that if they were arrested, they're probably guilty, their task is so much harder than that of the prosecution. There was a case where the prosecutor deliberately ignored evidence that didn't fit their story, and the defense simply didn't provide information that they didn't have, which would have made their defendant look guilty (remember: one side was outright lying, one side just didn't know). The prosecutor got a slap on the wrist, and the defender was nearly disbarred

      Ciara.Chaya Oh that prejudice is definitely there. The jury suggests tot he judge what they think, and the jury is only made up of everyday folks. We say innocent until proven guilty but most regular people think "well he wouldn't BE here in the FIRST place if he wasn't guilty of SOMETHING."

    I had to sit in on several trials and cases as part of my high school graduation requirements. It blew my mind though, when I saw the same defender for like thirty different people. Sixty cases that day, and only two defenders. I felt bad for one of the guys too, because he had misunderstood the terms of his client's sentence, and was arguing a moot point for about five minutes. They're way too overworked.

    Company: *gives money*
    Govt: "What solutions? It's only problems"

      you've got it wrong this is the US in a nutshell:
      Govt: we created the problem but are tricking you into thinking it's the companies that created it and we have the solution, just give us more money.
      Citizens: *pays higher taxes, giving more money under threat of jail time*
      Big Companies: *gives money to select officials to get loopholes in new cost-hiking laws to exploit*
      Small companies: *are royally screwed through all of this*
      Govt: "our solution didn't work but we have a new idea that will we just need more authority so we can *make* it work".
      Rinse and repeat.

    As a Brazilian Public Defender, I have to say that we face some very similar struggles here as well (understaffing, excess of cases etc.). As a difference I'd point that the Public Defender career in Brazil is very hard to join, requires previous practice and it's quite attractive financially, notably in some States. However, the overall funding, especially when compared to the Prosecution costs, is ridiculously low: in the Federal level, for instance, the Public Defense annual budget corresponds to 0,5% of the Prosecution budget. Still, it's a career of many personal achievements and that can truly provide a sense of accomplishment and social relevance.

    It's because those lawyers are state paid and private institutions will always make more money because of that. State budgets simply do not have enough money to pay public defenders 100k a year or more

      And nowhere in the constitution does it say that attorney needs to be top notch and paid 100k a year or more. You're acting as if the right to an attorney is not given with this system. You'd have to increase taxes immensely to fulfill your insane ideas.

      @@Sr_Sinful or cut spending elsewhere. it would also incentivize investigations into potential fraud in the welfare system. Folks not in legally who might be collecting or people able to work but are gaming the system would be cut off saving the funds that can be reallocated to bringing on more public defenders. even with current pay levels, what they really need is more personnel to deal with the caseload

    The biggest flaw in the American justice system is still that important decicions are made by a bunch of people who now nothing about the law and rather judge based on their emotions then on facts.

    My brother is a private practice defense attorney. He started his own firm. He’s expensive but he typically has one client at a time. Having one client at a time means you have his undivided attention and your case is the only one he cares about. He’s good. But good luck to most people when it comes to affording him.

    Not to mention that normally a case doesn't go to court unless the prosecution feels that they will most likely win. Prosecutors don't like wasting their time with cases they will probably lose. So a defender usually stands little chance of getting his/her client from going to jail. It's usually more about damage control, getting the client a ten year sentence with a shot at parole instead of a 25 year sentence without parole.

    i sat on a jury last year. the lawyer for the defendant was terrible. He failed the defendant and was sent him away for 5 years. If he had a decent lawyer he would be free. I honestly believe that.

      It boiled down to she said, he didnt say. You can only vote on the evidence in front of you. So we kinda had to convict. If he took the stand, he would have created doubt and that might have freed him. He can thank his crappy lawyer for that, literal, injustice.

      For all you know, the guy was actually guilty and terrible on stand so the lawyer decided against it. Kinda unfair for you to judge without knowing much about the conversation between the lawyer and the defendant.

      Im sure that is a reality in many court cases, but for the one I was involved in, all (ALL!) of us jurors made fun of the defendant's lawyer for amateurish tactics and just sucking at his job.

    The public defender shortage is crazy. The first thing to ease the workload would be being less hard-on-crime-- make less victimless crimes crimes, and allow the ones that are to have lower sentencing so that there's less on the line. From there... someone suggested below making all lawyers obligated to taking on public defence cases sometimes... of course you'd have to limit that to criminal trial lawyers, not all lawyers, but there's something there.
    Mostly, though, what needs to be done to fix this in the long run is to put more money in the system. Pay public defenders at least as competitively as public prosecutors. Make more people want to be public defenders, do cases on the state's money rather than the clients.

      Legislate private firms to chip in to help. Institute certifications (assuming there aren't any, I don't actually know) that require new lawyers to spend so much time training in public defense.

      +Goabnb94 Or we could get rid of a lot of legislature that raises rates of imprisonment and costs of the judicial system (drug laws, prostitution, and gambling for instance). Lawyers already have to pass the bar and go to school, it shouldn't be up to anyone but them where they work. I would be okay with more funds going to public defenders, but taking away the freedom of lawyers forcing them to work as public defenders isn't the right solution and may end up harming the system. Why would you want an inexperienced public defender that doesn't want to be there?

      I agree that inexperienced lawyers being forced to be public defenders is a bad idea, because of that. I would support obligation to all lawyers to ease the load of public defence-- but only as a temporary solution while the other more important things are dealt with OR if all the other things are implemented and there's still a lot of strain on the system that needs to be eased, still. Requiring criminal defence lawyers to do a few cases a year would be fair-- I'd give them some incentive to do their best before asking such a thing, of course. Make it a tax deductible or something.

      ***** It is really straight forward. Lawyers already pay income taxes. Just make them pay more when they represent the rich. The costs go up for everyone, but the service equalizes.
      We don`t need good lawyers for everyone, we just need equally shitty lawyers for everyone.

      You would remove something because it's out of style? That's just wrong. I could imagine removing carpets because they're messy and hard to clean, or popcorn finish because it's rough to touch and falls apart, but to remove wood panels cuz your neighbors think it's less modern than their walls is ridiculous.

      Jones Crimson+ We're planning to remove our carpets and replacing it with wood flooring, otherwise selling our house would be far more difficult. So yes, when you try to get other people interested in something, style does matter. It's super annoying.
      But if you don't plan to sell any time soon, removing something you find to be "old fashioned" to make it look "better" is a matter of opinion, and not always based on how others might see it.

    Since Public Defenders are paid by the state, private Lawfirms will always be able to pay better. So there will always be more private lawyers than public defenders. The only way to fix this issue of not enough Public defenders is to get people to stop committing crimes and suing each other for pretty much everything.

I wouldn't be surprised if the reduced workload with no drug "offence" cases would lead to their funding being cut further.

So if we end the Drug War a d remove most of the policies created to aid it, we will have a better place to work from. You can't improve a broken system, you have to remove the broke pieces, fix the foundation and build on top of that. So we ha e a long way to go.

    For anybody that doesn't know, if you're ever charged with a criminal act and can't afford a paid lawyer, your best bet is to try to plea the charges down and plead guilty to those even if you didn't do it. In most cases you don't even get to meet your public defender until the day of your court appearance so there's no real way to build a defense. You can try to get a new court date, but if you're sitting in jail it could be a year or more before you go to trial. That's a year or more of your life gone when depending on the charge you could have been out in a month or two. There's no incentive to try to prove your innocence if you're poor.

    As someone who has been in the system, due to my own bad choices, I can tell you from experience that the judicial system is a mess. And I don't live in a metropolitan area. The public defenders mean well but they're overworked and in some cases they're the bottom of the class lawyers. The people who barely passed the bar. They don't want to do anything except meet you and ask you to sign a plea bargain. And they're in the courtroom all day every day and they're pals with the prosecution. On the one hand it gives them an advantage because they get offered fair deals but on the other hand, they don't want to step on the DAs toes for one client. I actually saw with my own eyes a public defender file a motion of discovery against the DA for misconduct because his client made a serious accusation...the DA even went to trial. Immediately after that every single defendant in the courtroom that day had his/her plea bargain pulled off the table by the DA. Just out of spite.

      Well most people become public defenders for 3 reasons.
      1. They genuinely wanna help people
      2. It looks good on your resume, especially if you have plans to become a Judge or run for office
      3. You can't get another job.
      Of the three, 1. is obviously the rarest. Most people treat this office as a stepping stone.

    I live In New Jersey and what I found is that the Public defenders are understaffed and usually seem untalented. I've been to court a few times and I used to watch lawyer after lawyer walk up to the bench and say hi to the judge and ask them about their personal life. What I soon found out was that many lawyers become prosecutors or even judges later in life if they can make the right friends.
    I defended myself every time I ever went and did better than anyone I ever heard of who was in the same situations.
    Everyone should allocate some of their time out of the day to read law. Just a little bit. Things like hearsay, or what needs to be proven in order to be be guilty of certain charges and what their common defenses are etc. Law is complicated but it's not rocket science.

    I don't understand: instead of cramming cases, why not delay them to have enough time? The more delays, the more the problem will be lamented and eventually the system will be changed. Heck, make private lawyers be public defendant sometimes like jury duty is for the public, or something.

      Delaying cases unfortunately would hurt a suspect's right to a speedy trial. Especially since the public defenders are state employees. It could (and likely would) be seen as state sponsored trial delays and would likely cause jails to fill up even faster with suspects waiting for trial who cannot afford bail or an attorney. Most criminal law attorneys have served as either prosecutors or public defenders prior to their entry into private practice. Honestly, criminal lawyers do have a right to make money just as much as other lawyers. One issue I'm seeing with so many people saying "make all lawyers take one public defender case every 10 cases". Unfortunately, the public defender's office is one of the most qualified to help those unable to afford a lawyer of their own. They know the environment their clients come from and they do work very hard in the name of providing representation to their clients. Granted, some of their clients arent the best to work with. Could you defend someone you hated? Could you provide a defense for someone you knew in your heart was guilty? Also, please dont make all lawyers serve in the public defender's office. The last thing I'd want is an estate lawyer or a worker's comp lawyer representing me in a criminal case.

    Maybe this is why my public defenders have treated me terribly. I committed a crime while blackout drunk and with a previously clean record, I don't remember any of it. I woke up with my left knee bloody, apparently a police k9 tore up my leg. Yet my pd told me that anything that happened to me I deserved, and that if it were up to him, he'd give me a much worse sentence than what I recieved... I was thinking the whole time but it is up to you :,( and he also repeatedly told me I have no case and if I try to fight it and lose I'll go to prison for 3 years. There were no tapes but he told me nobody would believe my word over officers... I basically was given no choice but to accept whatever offer he gave me, with him constantly telling me I'll probably go to jail.. (I didn't go to jail, but I have to pay a huge load of money for the next few years)

    That is true the D.P.D is often underfunded, this also means that most of the time they often refuse cases that they see might not be winnable or might be difficult. This sometimes does mean that some innocent people can't get the legal help they need have are forced to plead guilty to a crime they did not commit...
    Also something they missed is that in ALL criminal matters prosecution is always employed by the state.

    This one ties into the prison one. As public defenders basically present you with a plea bargain. Once you say your guilty even if it was just for the plea bargain. If you are ever in the court again you will be considered guilty based off your admitted guilt the 1st time. I know it's not suppose work that way but that is how it is. Especially in a prison state.

      Not the 1st time, I believe some episodes are aired out of order. Because the drugs and jail episode aired a week apart, but then they showed the Wild West episode before this one, so who knows?

    a thing that was missed about the Jury trial bit, is that, in many places Jury selection is skewed to get the stupidest people to be on the jury, that way they are easier to manipulate. if they find out you're intelligent, you're more likely to get dismissed for duty. which is also something stacked against public defenders.

    That is whole point of your Justice System. That is why such long sentences are given to people with such such minor crimes. And if the Public Defenders can't do anything then they stay there forever or they accept the plea deal.
    All so that the CORPORATION CAN EARN ALL THE PROFITS

    Probably why so many people take plea bargains regardless of their guilt or innocence. I believe only a fraction of cases actually go to court.
