I was at a gas pump 930pm I see a cop do a u turn in the middle of the road. He pulls up behind me at the gas pump and comes up to me and said he was taking my plate. And tells me I got 5o walk home with my 17 yr old 3 legged dog. I called a friend he towed me home. Went to court a month ago. 2nd court date today 9am..
He is just wrong. To convicted of the crime, you don't need a corpus delecti. You need to be guilty of the elements of the crime. Growing or possessing marijuana is illegal, so it is a crime. You can be guilty of a code violation, which is punishable by a fine. The code is a law.
Supreme Court has ruled time and again that injury-in-fact is an essential element to prove standing, thus to prove jurisdiction. The latest case being Robins v. Spokeo. The reason for Article III is to limit judicial power so it adjucates only cases and controversies, not private interests. The violation of a bare statute right is not sufficient to assert injury.
