    Yes, the government likes to grant people the 482 visa and process 186 TRT. But, knowing 186 can no longer tie the employee for a level of certainty, employer don’t want to risk losing the leverage they have on 482 holders while really reluctant to grant people 186 TRT nominations. On top of that, each year the ENS grant has a quota, and so many 482 hopefuls would be competing with those numbers. It is a hugely unfair system towards employee and employer because there is no certainty for both parties and no legislation to provide such certainty. Employer fears employee would just leave after 186 grant and employee fear employer not sponsoring them all the way, losing their PR chance. I can’t believe government loves this visa so much recently, while luring all the skilled workers into a false hope of residency.

      My employer has just announced to all employees that they would never sponsor 186TR to all 482 visa holders again after one of my colleagues left the company soon after his visa was granted. We should start a petition to get this policy changed.

      @@sokhemhun3719 Either they change the law so employee has a legal obligation to work for the same employer for a minimum of 2 years, or they remove the sponsorship requirements of the PR stage whatsoever. The current policy simply lure 482 hopefuls into a PR dream trap that is difficult to get out of, and eventually left the country once time runs out. DOHA granting 482 visas en mass is cruelty in stealth.

      I think the law should not let 482 visa holders depend on their employers to apply PR after minimum 2 yrs on visa 482?
      We should propose a letter to express this concern ? How does everyone think ?

      @@huynhxuan4090 the new SID visa is designed to end this gridlock and allow applicant to self-sponsor. Dunno how angry employers could become after knowing their employee won’t need them for PR. Maybe they just refuse to sponsor in the first place. Either way, at least tilting the balance towards employee is a better outcome.

    Australian immigration is known for its ethics, values, equal opportunity. But we are surprised that we 2022 applicants for 491 subclass are being neglected even after redoing medicals and PCC and 2023 applicants are being gifted grants like anything.

      It is. They scammed students above 35 years old. They promised us that we would qualify for 485 visa allowing us to stay up to 3 years post graduation. But nope they changed rules this year. Do now we are in deep sh!t

    I appreciate your informative content on Australian immigration issues. I wanted to bring to your attention a critical issue affecting many 2022 applicants for the 491 Family Sponsored Visa. Despite following all required procedures and even redoing medical assessments, many 2022 applicants, including myself, are still waiting for our visas.
    It appears that Ministerial Direction No. 105, which mandates processing in order of lodgement, is not being followed. Applicants from 2023 are receiving their grants while we face indefinite delays. This inconsistency in processing times is causing significant anxiety and frustration among 2022 applicants.
    Your platform could be instrumental in raising awareness about this issue and advocating for fair and transparent processing practices. Thank you for your attention to this matter!

    Hi Karl, thanks for this very informative video. I have a question, the 2-year requirement would consider working from another country for the same employer remotely for a short period (i.e. 2 months)? Does it also mean that one can travel overseas for holidays during annual leave for example without having any issues counting this time? Thank you!

    There are many in 485 who are working in their skilled occupations as well.Can they too access this stream?They are as qualified and settled as the ones in 482,if not more- as they have contributed to the education sector as well

    Thanks for all you do Karl. 482 to 186 TRT here, submitted June 5th, 2023. My company just received the approval for the position nomination in June after a year of waiting. My own visa application still sits as received, and has not been actioned.
    When I submitted 90% were being approved within 14 months. That got down to 12 months and now is back out to 16 months here in August 2024. Funny thing is now 50% of visas are being action within 13 months when it was within 8 month just a month ago. Not having insight into the situation, sitting on a bridging visa, and not being able to move forward until it's resolved is the toughest part. You just feel like you are in suspended animation.
    All you can do is just wait and hope they get to you at some point.

      Yeah, to me this is a massive risk visa applicants have to take, for they can’t just “sit around and wait” like 189/190/491. They also have to pray business which is sponsoring them don’t go down under, aka closed/bankrupt/initiate a massive layoff etc. It’s an even more anxious and nerve wrecking experience until the visa was granted.

    Hi Karl, thank you for the regular updates. Requesting to share a video on clarity as in why has the processing times for 190 visa changed to 24 months now. We have been told 6 months while lodging then 12months, 18 months and now 24months.. Many of us who have lodged visas in 2023 are purely disheartened and panicked with the timelines! We have kept our lives on hold awaiting the visas...requesting to please make a video on this..

    Please comment on the 190 visa processing time being increased to 24 months for 90% grants. Really frustrated about this. Waiting 24 months for a visa while pausing big decisions on life is really a cruel cruel joke.

    Hi Karl. Many thanks for your wonderful videos. We do look forward to each of them every week. During this episode it would have been good to have covered the age exemptions under 186 TRT, especially since there is one still listed that was supposed to be available up to the end of June 2024. Also, are there any conditions under which processing time tends to be sooner than usual e.g. if employee is in a region, has served more than the minimum 2 out of 3 years, is serving a government sponsor or high demand skills such as medical, teaching, etc. Looking forward to the next episodes.     Anyone on 482 should also have other plans for 180, 190 or 491 and not solely depend on their employer nominating them for 186 to avoid disappointment

    Hi Karl, alas some news for 482/487 visa holders, thank your efforts to keep the general public informed. I've been working for my employer 2 months short for 5 years and have secured another 2 years of contract. My dream of getting PR is very thin as my employer is reluctant to sponsor me due to my age. Do I need my company to sponsor me on this 186 TRT, or can I apply on my own while I'm currently employed with them, if not what are my options? Thank you

    Hi, I applied for nomination approval on 4th April, 2024.
    Last month they mailed me to ask for additional documents. It's been more than one month since I submitted those. All together, it's about 5 months now, and I'm still waiting for nomination approval. Is it normal, or there's something wrong?

    If we are advised to apply for 186 a "few days" before our 482 expires, how can we do that if we can only apply once the nomination is approved. How do we know if it will be approved in a week or a year? I don't understand people are expected to do it on time if a lot of part of this application is out of our control?

      You don't need to apply only once nomination is approved. The nomination must be submitted first, but you can submit application right after, even on same day (lot of people do that to "save time")

      i dont know about the court case but i doubt if the Australian government can be taken to court,that happens in African countries or the USA only,they did it in South Africa and the government lost ,some onshore students approached the australian human rights commission about discrimation by age,the only help they got was being given phone numbers of some lawyers and being told to find a migration agent,that does not happen in the USA there in the USA lawyers would have voluntered to take on the government in court,the petition is still there,it was a big mistake coming to this country,but they convinced us to come here because they wanted our money

    My sister has applied for her Australian student visa in the month of June and still awaiting outcome.
    I'm a PR of Australia. My younger brother is also on student visa in Australia since 2023 January.
    Can I apply for my mom's visitor visa (parent's subclass 600) whilst my sisters outcome is still awaiting?

    The problem is not many employers who employ under 482 are willing to sponsor for 186. I have been working for my employer for almost 3 years now. But they have a policy of not sponsoring for 186 I have asked various people who work in a similar domain and this seems like a common trend specially among big cooperations

      It’s very simple to understand: under 482 visa, employer can expect employee to work with them due to visa conditions. So there is a level of certainty. 186? There is no such certainty anymore so why give employee enormous power to decide their fate when they can tie people to endless 482 renewal forever?

      @@estellebright2579 It would be interesting to show figures of how much 186 visa grants actually given to people. It seems if anything the government wants to encourage the TRT stream but on the other hand all the power is in the employer's hands. The end result is you are stuck working under 482 forever and they can simply kick you off whenever they want. I do not blame the employers, as any institute would use every tool in its disposal to retain employees in this tuff market. It is the system that is allowing them to use this visa as a tool with no incentives for them to sponsor their foreign workers. Having said that, I could not feel more exploited by the whole system with nothing I can do about it other than consider moving to somewhere else. Not that I do not enjoy the people, culture or anything, Australians are by far some of the nicest people I worked with, but just the uncertainty that comes with staying here for myself and my family. The Australian government promotes Australia as a place where highly skilled people can call home but I don't see that on the ground, I was brought in during COVID when the borders were still closed. The government issued an exemption for me to get here at a time not even Australians can get back to their loved ones in order for me to assist in a critical sector and now once everything is settled I couldn't feel more forgotten and abandoned. Meanwhile, I see an influx of people brought in as various trades that the country really needs working as Uber drivers or other non relevant professions which speaks volumes about the expectations vs reality. The immigration system of this country needs significant reforms, shame given the beautiful place and the amazing people.

    What if you’ve been on a 482 and then your occupation gets taken off the list when your 2 years are up?? Can you still go through the 186 even if your occupation was on the list and now isn’t?? 😢

    Can a 482 visa holder apply for an 186 visa if they complete two years cumulatively (1.5 year service from another employer+0.5 years from their current employer). On the 482 visa, they completed 2 years. Please reply

    Hi Karl . Thank you for your videos . Hope you had a good vacation.
    I have a request please.
    Can you highlight the issues we are having. We have lodged in 2022 and have not received an outcome as yet . I am aware of each case is different etc and I can say confidently that our case has no issues like many other applicants from 2022 that I am in contact with .
    The frustrating part is that DHA is being unfair because they have finalized many 2023 cases yet here we sit with no end in site . .
    According to their website they should be finalizing cases according to date of lodgement so how is it that a person that lodged a week after me has received his grant but I haven't?
    Or that people from Jan to June of 2023 have but I haven't.
    Please help us .

      Sadly currently there is no official venue to hold DOHA accountable for their slow processing and black box managing of visa applications. Best you can do would be to keep complaining to them. Maybe launch a petition to the parliament so that your voice may be heard.

      We have tried . We have sent GFUs , via our agent and anonymously. We have emailed the ministers , called the call centre , left notes , uploaded cover letters etc.
      Nothing is working

      Same with me, (491) 22 months wait, when within processing times DHA says look at 90% processing, out of processing times on 4 occasions and then DHA customer service says you fall within the 10% of applicants. Seems like they don't know where we fall as long as they collected the fees from us 2 years ago and it is now sitting and accumulating interest for them while we sit with nothing and no hope. Please Karl, bring this out for us.....we still have to journey a further 3 years after the grant to reach to PR. Years of our lives are wasted just waiting.

    My subclass 462 visa is expiring on 2nd Nov 2024 and i want to apply for student visa for a course starting in march.
    So 4 months gap bw two visas is possible including processing time
    ....

    Dear Karl,
    I got visa refusal due to marriage after 55 months of waiting. I lodged 190 visa application on January 2020. After one year of waiting I married during covid lockdown, because nobody knows when this lockdown end. I compensated the lost 10 points with my spouse's PTE and my NAATI CCL exam. But CO did not consider that points. Is marriage a big offence to refuse visa application?
    In your last video you advised me to go to court for an appeal. I am an offshore applicant. Can you advise me what the procedure is to go to court. Many applicants are suffering due to this . Kindly help.

      I know a guy onshore who was in the same boat like you. He got the grant recently in May 2024(lodged Dec 2022). The strong point he built than yours is he took skilled spouse 10 points for compensation which directly reflects compensation in same domain probably which you lacked.

    - Medical Laboratory Technician ( 16/11/2021- ongoing)
    Aims assessed on the basis of these two occupations for Medical Laboratory Technician.
    Can I claim points for the first two years of my Australian employment as AIMS needs 2 years of experience for Skill assessment (if graduated from non aims accredited university) ?
    Can I claim 10 points for work experience?
