@Amit Sengupta. We are happy to hear that you have a clear and narrowed down picture regarding the recent incident in Nagaland. But allow me to clarify two things: Firstly, being in a Democratic country we are entitled to have our own opinions regarding any subject or matter, but that doesn't make the wrong- right or vice versa, so speaking on behalf of what Nagas want was not correct because we strongly disagree with your statement of us Nagas wanting to keep AFSPA and continue with it. You may not know the history of how much our Grandparents and parents have suffered during their time, but let me remind you that innocent civilians suffered a lot. During those those times no one had phones and internet connectivity, otherwise if those incidents were to happen today your narration and take on AFSPA will surely change.
Secondly, in order to make you understand our past and history it would mean for us to sit and discuss long hours, which is not possible, So my humble request is, while AFSPA may have had the right motives to start with but it has harmed innocent civilians all the more. Human life is just a one time and we cannot count it as a mistake or error in terms of people's life's. One lost soul may not affect you much but to those going through the grief it's unthinkable.

Repealing AFSPA doesn't mean there won't be military presence, it actually means taking away the rights of the army to do whatever they want. Yes, mistakes do happen but if it happens repeatedly, it can no longer count as a mistake. There are Several cases of the army abusing the civilians, girls taken advantaged, etc. Also, NSCN Khaplang was considered a terrorist group and they are not allowed in the Naga region of India too. The army in the Naga region is the NSCN IM who are actively in dialogue with the Indian Government.

But today's video on AFSPA seems to be a shallow explanation. The recent Oting massacre is not the only reason , we need to look back into the history of AFSPA since its implementation. Much damaged have been done than good by AFSPA , in the name of hunting down insurgencies many innocent people have been killed, raped, tortured by our own Indian Army. People of northeast are also evolving as the world evolved so you can't still implement 1958 Act. we love Indian Army ,many young people are aspiring to become one of them. I strongly believe that in a country like India there can be better law in place of this DRACONIAN LAW (AFSPA) to wipe out insurgencies from NE India.

I dont know a lot about the north east but afspa is needed in j and k because many in kashmir (not all but still many) are relgious extremists and dont wanna live peacefully and co exist with people of other religion. They want a relgious state. Dont know a lot about north east but unlike kashmir many in north east dont hate india and many even fight for India in our army.

You know the ill effect of AFSPA only once if you have lived in a place under which it comes because I've lived back in the 90ties when Tripura was considered disturb due to insurgency. Army shot dead quite a number of innocent people whom I personally knew are indeed innocent just because of suspect, including one mentally ill person because he criticized them. You have to fear for your life every second either from insurgents or army. This is just one incident in my village alone. Male earning members are picked out of their house at night suddenly and beaten black and blue infront of wife and children who became permanently disabled just because the family provided food to the insurgents. If he didn't do the insurgents will kill the family.
If you experience this law with your family, I'm sure 💯 percent you'll also not support AFSPA.
AFSPA in any form is draconian and cruel law. It is undemocratic as it violates the right to life under article 21 of our constitution. It's a British era law still in use.

I feel sorry for you, but North East including Nagaland is an inalienable part of India, it will not be allowed to be used by Chinese as proxies. So until and unless these secessionist give up their arms and surrender AFSPA will not and must not be repealed.
Now, if Tripura had never been imposed with AFSPA, and the insurgents would have got their way, do you think it would be a more peaceful/ democratic situation? Since the govt went full throttle over the insurgents, now there's peace, and there's no AFSPA now. I knw it sounds insensitive. I wish I could feel your pain, but I can imagine those years would have been horrible. Actually this is one of the difficult problems the world is facing. Violence in such region due to whichever the reason might be pulls in law enforcement. Law enforcement is under pressure generally because of the asymmetric nature of the conflict. Imagine a scenario where a terrorist goes and hides among kin. Terrorist can hit soldiers without regard to fellow citizens and take refuge among kin but a soldier is only supposed to hit a terrorist without harming others. As the provocations from both sides escalate, the line between 'soldier' and a 'terrorist' blurs gradually and both get increasingly indiscriminate (However we still need soldiers but not terrorists). It is the duty of responsible adults to pull their children away from separatist and domestic insurgent movements. They are attractive because such aspirations appear noble and easily accessible. It is much more difficult to make a real career when this type of 'fatal attraction' is close by. I feel bad for border areas where they need lot of abstinence to avoid joining the 'noble' causes (whichever they are) and focus on making a career and building a sane society. This is particularly important because building real careers is not easy even in those areas that are not affected by insurgencies. May all be blessed with enough strength to overcome the stressful times and build safe and peaceful societies.

The demand for revoking afspa is not only a byproduct of the recent killings of Konyak civilians in Oting. Nagas (and all everyone under afspa) have collectively suffered under the act foe years; a history that brings tears and sadness to us when our grandparents narrate their sufferings to us. Though the sufferings were great, people were finally trying to move on in prospect of a peaceful future and willing to make amends with the Armed forces that oppressed us for so long. However, the Oting incident clearly indicates that the sentiment is not shared and the people are not ready to allow these "human errors" or "mistakes" to destroy lives and pull us back to the dark times.
The motive behind the demand for the revoking of afspa is far more humanitarian and civil rights grounds than it is political as people may assume.
While looking at it from a bird's eye perspective, it might seem like a genius way to "united the nation and keep it peaceful " but what is peace if the cries of the people in small provinces are it's price?

Without AFSPA the rebels will only grow stronger. There isn't really a simple exit from this conflict. AFSPA has permanently ended separatism in other north eastern states. It's better to weed out rebels completely than to keep generations drenched in this conflict.

I have been in nagaland for 3 years such a beautiful place.. I have so many naga friends too.... But I have seen lot if horrible things too... Seen by friend and his family killed and people with swords running in market and People running in horror..... My naga friends say that AFSPA is mostly needed and mostly people support it but don't show because of fear ..
As army doesn't know who is with them it's greatly needed that people come in support with army so they can differentiate between INDIANs and MILITANTs...... .

I have been to Hindi speaking belt of India... They region is highly urbanized but too much pollution... I have so many friends their... But I have seen horrible things too... People their get robbed, ragged and looted in broad daylight... Women are unsafe... Crime rate on women is high... Even a mother is not safe inside his own home... People would not tolerate couples holding hand in public but public lynching is tolerated and people would choose to ignore if any crime takes place in open public... Most of the people are uncivilized... My mainlander friends say that the region need more stronger law to control the savages their.... As administration cannot solve this problem as they have to deal with anpar gawar people their so while India need to come out in the support of administration...

Sir with due regards i have learnt from you so many things but I disagree some points you have mentioned in this. Paying the highest respect to Indian army for thier sacrifice to our nation.... but Afspa has actually damage more than good. In ground reality people like us are suffering from two ways from our own insurgence and the army... there is a history of oinam village massacre and I believe all humanity have par it’s limit and the incidents still carry on by the army. We have many armies from north east too and we want to get rid of insurgency but the act of damage can never be justified. So I won’t agree when you said many support afspa... people have seen the outcome and it did not really help but brought more damage. The trust deficit has been developed by the people and without the cooperation of locals there wont be desired outcome to both the people and government.

Everything sounds good and brave when you only read it. You have to be constantly be under the tip of the sword piercing through you inorder to understand the real issue.
From all the scholarly articles and evidences of Rape, torture, detentions, young children jailed, arbitrary arrests, extrajudicial executions....the list is long.
If the objective of such acts are to maintain peace and attain proper integration of the affected states, then bad news, it's doing the exact opposite.
We feel more alienated and feelings of hate for this act ignites our notions of separation from India and it is being made stronger with every violations that occur.
Soldiers are humans. Just because they are soldiers it does not guarantee their morality. As long as this act remains, human rights violations will continue to occur.
Even after continuous recommendations from international and National committees to revoke AFSPA, the government and Army continues to harp on security concerns.
No amount of security concerns should override human rights.
Immunity to the Armed forces under Asfpa should be removed. They should be held accountable for their actions. It's been too long that they've continued to be cloaked under this act.
Without them we would not be there to talk about human rights. Holding them accountable is a good thing in other ways

Being a Naga and having seen the outcomes of this act, I say this with utmost respect for the armed forces. But they're losing their moral standards in our eyes by continuing to support this act.

If you have any sense of the importance of civil rights, you will definitely be supporting revoking of AFSPA.

@@vivekpaliwal2037You can throw in your argument but it will fall baseless because time and again it has been proven that Afspa is not the right way to deal with extremism(at least in Nagaland). Although there has not been any signs of extremism from Nagaland over decades, Afspa continues to be the used as a tool to suppress mere militant miscreants which can be handled well by state police.
The solution is simple, take away any unreasonable immunity under this act and make it justiciable (Right to remedy) when rights are violated. Carry out investigations and deliver Justice on all cases(now and past) of crude injustice meted to citizens under this act.
I'm certain that a high institution as that of armed forces have all the mind and brains to be able to formulate better policies/acts that are in line with today's standards of human rights.
When India Is moving fast to keep up with a rapidly modernizing world, it should do away with acts like these that are outdated and only proves to be a burden on it's image.

Couldn't we use drone surveillance systems or satellite imaging to prevent such casualties during operations. For example, monitoring an area with a live satellite feed. Could you please comment on this?
Additionally, we can use ARCAS assault rifles system Israel that are AI-enabled to improve aim on a subject and reduce errors during open fire.

Making India a democracy right after the disastrous partition and independence was the most foolish thing to have happened . It should have given time to the country to stabilize properly and develop itself before making it a democracy in federal structure .

AFSPA is against the basic idea of democracy. More AFSPA means more chances of human right abuse and more violence as a consequence. I respect, support and love Indian army but GoI have to understand why local people are angry with the armed forces.

@@rajkishorebehera7489 since the massacre we have been holding rallies and processions continuously, all the CSO's amd major tribal bodies have openly condemned this act in the local daily, all political parties are demanding for it's repeal. It's clear, we want it removed.
@@kimonobe278 Not really until a voting is done on the issue in Nagaland and the majority comes in favour of repeal then yeah sure,also even if say that's the outcome of such event still that's not how the government decides whether to keep AFSPA or not rather there are other factors that determine that, the government should fence Nagaland border with mayanmar so that these insurgent thugs don't cause trouble in india then run back to Burma and hide like cowards safely.

Many of family my people, admire and adore the army uniform so much, many youths dream to wear any of the military uniforms, such ar army, airforce, navy, bsf,cisf etc. so much in life. But despise afspa uniform to the core when they heard the story of the locals what they have gone through because of afspa as they have done more damage than good. Raped, killing innocents people in Manipur and nagaland.

Thank you sir. Sir, Sec 197 Crpc mandates sanction for prosecuting a public servant. A public servant on duty if commits an offence, the concerned Government has to first sanction. Similar provision is there under Prevention of corruption act- Section 17A and 19.
There have been few instances when under AFSPA there have been misuse of pellet guns and tear gas cans, which have been hit on the heads of protesters rather throwing in open spaces. The hitting of a can has even caused death of a protester. There have been FIRs against few personnel but court could not take cognizance bcz of lack of sanctions from the Ministry.
