**********I actually misspoke in this video and did not give full clarity. Please read below!********** I misspoke on this video. Due to much of my time in law enforcement actually being in the state of Georgia. Under Implied Consent all drivers agree to recognize upon earning their driver's license agree to O.C.G.A. § 40-5-55 and § 40-5-67.1When we asked a driver to take filed sobriety test we always incorporated the breath test and or chemical test as well. If they refused the FSTs they would still need to take the breath or chemical test. If they refused then they faced their license being suspended. So even if they did not take the field sobriety test they were required to take a breath or chemical test.

I don't know where you get your information or how long it was since you were a LEO, how much experience, or what state you come from. You might want to clearly preference that in your videos. NHTSA sets the standards for field sobriety. A person indicates a failure by showing a specific number of clues per test. A person passes if they don't show the required amount of clues. It might be your verbage I have a slight issue with. You might want to also advise people that laws differ state by state. They change and might have after your change in employment. Your statement that field sobriety tests are not pass or fail is completely wrong. The tests are exactly pass or fail. You can say "indicates a pass or fail". However, you are now splitting hairs. People can pass field sobriety tests. I've had many pass. I'm sure that every police officer has. If you haven't, you were not in this career long. Then, I'm wondering why you commenting from this platform (We The People University). SFST's can also be used also for evidence gathering. The last time I looked at a Indiana probable cause affidavit (yesterday) they have a list of standardized field sobriety tests. Next to it are the words pass or fail with a box to check them accordingly. I think you also insinuated that without doing SFST'S there isn't any evidence of intoxication (maybe in this video). Overall, this isn't accurate either. You can establish probable cause without any field sobriety tests. I'll give you an example. The driver may have had poor driving behaviors, a strong odor of an alcoholic beverage coming from their breath, open container in plain view, slurred speech, glassy eyes, disorderly clothing (urinated on themselves) poor manual dexterity, they may be confused. Upon exiting a vehicle a LEO might observe unsteady balance, ect. Individually, you have next to nothing, you put all or some in a combination you can have probable cause. That's all that is required. You are correct that anyone can refuse SFST's. It is not a requirement that someone complete them at least in Indiana. Sometimes it would benift people to do them sometimes not. Refusal to perform the tests does not establish probable cause. You could say that some or all of those observations could be signs of a medical condition. You are correct. That's where a search warrant for their blood comes in. Which in my area requires a trip to the E.R. This is a great opportunity for medical professionals to take a look at the individual. When the blood draw results come back with anything at or above .08 or illegal drugs you most likely will be at least a per se violation. For those extremely unfortunate yet rare incidents that a person has a medical condition are arrested that person may consider a civil lawsuit. You are also correct that a person doesn't have to assist in a LEO investigation. I'll agree this police officer didn't say or do things perfectly, nor does anyone.They weren't completely awful or even close. I find you commenting on his errors then making your own shows how difficult this job can be. The officer telling him it is a lawful offer that he has to remove his sunglasses isn't accurate. That is not a lawful order. Maybe he misspoke like you. We all error it is part of life. This police officer isn't perfect and he isn't training someone completely wrong. At least with me, I never want to arrest anyone. I want to be the last resort. I hate the feeling of taking someone's freedom from them. Sometimes, it has to be done. The more information I have, the better decisions I can make. I work for the people. Not to sound rude but, saying you are a former police officer and former deputy sheriff doesn't really qualify you as an educated officer. There are just as many current uneducated officers as former ones. I really wouldn't take advice from anyone less that 10 years experience. That is about when an officer is grounded and decently educated. No matter the experience level or years of service, officers will make mistakes.I'm sure you did. Do you have any other education? Maybe a bachelor's or master's degree? Just something more than I did this job so I'm qualified. It might also help if you pointed out what the officer did well. That would cut down on the deviciveness. Unless that is the goal then you are doing well. There are a lot of aweful police officers out there. I do believe there are more good ones than bad. I do believe the system is broken and needs reformed. I do believe officers need to be held accountable. If that means being written up or even jail time. Even as a police officer I am not a back the blue guy, a thin blue line guy or any of that nonsense. I'm a pro common sense guy. I'm guy a that got into a career to help people. I will not dispute that I've been mortified of the actions of some law enforcement just as I've been mortified of the actions of the public. I truly believe that besides victims and family members of victims created by LEO's there is no one more angry at bad officers than good officers. Good officers pay the price for bad officers every day. Those that say good to that or they earned that are a part of the problem. It seems that it is not acceptable if law enforcement is treated poorly by one that we take it out on everyone. So I would challenge everyone to treat everyone how they want to be treated respect goes a long way for everyone.

FST'S (feild sobriety tests) include tests like the "walk and turn", "nystagmus eye tests", "ABC's and counting".. chemical tests are breath, blood and urine tests, a breathalyzer is the most common chemical test used during DUI investigations. It's important to understand the difference between "FST'S (eye test) and Chemical Tests (breathalyzer)". A breathalyzer is NOT an FST, it is a chemical test. No state requires you to preform FST'S, there is no punishment for refusing FST'S in any state... BUT there are punishments for refusing Chemical tests (aka a breathalyzer). When you get a license you are agreeing to provide a BAC (blood alcohol count) upon request of law enforcement. An officer can order you to provide your BAC (usually in the form of a breathalyzer) during a DUI investigation, if you refuse to provide your BAC or refuse the breathalyzer your license will automatically be suspended for 6 months to 1 year depending on your state. The police will always ask you to preform FST'S before asking you to take a breathalyzer because their goal is to gather as much evidence as possible. FST'S strengthen their case.. if you refuse the FST'S (which is your right! And you cannot be penalized) the officer will then ask you to provide a BAC (blood alcohol count) using a breathalyzer. You CAN legally refuse a breathalyzer, in fact most lawyers recommend that you do (especially if you've actually been drinking) BUT your license will be suspended automatically. It's also important to know that if you decide to refuse the breathalyzer and your license does get suspended for 6 months, a judge can over turn that suspension. Many times courts will look at a DUI suspension and decide that the officer did not have enough suspicion of intoxication to initiate a DUI investigation in the first place and the judge overturns the suspension. So, don't let the fact that your license will be suspended scare you into taking the breathalyzer. If you refuse the FST'S and the chemical tests, they have VERY LITTLE evidence that you were driving while intoxicated, as a result those cases are usually dismissed and your license reinstated. They may have other evidence like the officer saying "he smelt alcohol on your person" or they may have dash cam of you swerving BUT in a courtroom that evidence alone without FST'S makes a much weaker case. You are always better off refusing FST'S. It's also important to understand that if you decide to refuse the chemical test (breathalyzer) and accept your license being suspended, an officer MIGHT still be able to arrest you on "suspicion of DUI" based solely on his observations. Observations such as " your speech is slurred, the odor of intoxicants, swerving, you appear unsteady on your feet"..Once you've been arrested he can apply for a search warrant for your blood and FORCE you to provide a BAC through blood sample. Also, if you decide to take the breathalyzer and you blow a 0.00, the officer might still arrest you on "suspicion of driving under the influence" based solely on his observations!! An officer can use his observations such as " red glossy eyes, he smells weed on you or in the vehicle, or you were driving erratically" to help establish the probable cause he needs to arrest you. So, it's important to understand that even if you pass the breathalyzer you may still be arrested. Most lawyers recommend that you ALWAYS refuse FST'S and only submit to a breathalyzer if you haven't had anything to drink. If you have been drinking refuse both FST'S and chemical tests, let them arrest you and try to apply for a search warrant for your blood, it might be denied (strengthening your case). So, to summarize you CAN refuse FST'S (walk and turn, eye tests, ABC's) without any penalty.. You CAN refuse chemical tests (breath, blood, urine) BUT you will be penalized and your license will automatically be suspended. Hope this helps!

As a former deputy I hated what I witnessed and is also why I no longer do it. My colonel didn't like me. I'm currently taking Brandon Joe Williams contract killing course. Also using other sources etc as I learn how we all were duped into slavery. Disclaimer on language etc but this is worth learning to become truly free. You'll learn how "law" enforcement and "peace" officers etc get away with this.

Add short man syndrome to that he probably got picked on in school all the time that's why he is a cop. I've run into cops that can't wait to fight, both should be barred from becoming cops on a psych. test.
Cop's on a power trip. Was pulled over recently for a DUI checkpoint. Told me I had to do a roadside sobriety test. I told them that they were harassing an at-risk senior. I'm legally disabled and couldn't pass such a test. I told them to charge me or release me. One or the other. Stuck to that statement and after 15 minutes of "ordering," me to do this or that, they finally told me to leave.
Best outcome. possible. Best to say NOTHING beyond the proverbial "Name, Rank, Serial Number." You need never justify yourself to any LEO; a cop must establish Reasonable Suspicion to detain in order to investigate for a crime(s), and Probable Cause to arrest. Hold the police to those standards, and don't give them ANYTHING. They are NOT your friends and don't have YOUR interests in mind.

@@ANunes06 The sad truth is that you will never see that kind of a behavior out of cops in Eastern Europe, as they are usually much more civilized than US state troopers. However they also have more rights to stop, search and arrest than their US counterparts, so it works both ways.

I am very involved in my constitutional rights and very much understand them. I exercise them regularly. I am very involved in the audit community. But I do refuse to watch videos with a closed mind and i refuse to assume the cops are always wrong and the citizen is always right. I understand these youtube personalities ha e followers who think very one sided but I think openly and weigh every video seperately based on the evidence revealed in each video. That is the only way you can truely decide if someone rights had been violated. In this video there is no evidence the cop had RAS and there was no evidence that the cop was violating the mans rights either. That is because we only ha e a small part of the interaction and we ha e none of the video of what transpired before the stop. Therefore we camt actually say if his rights are being violated
@@admthrawnuru not true. You dont need probable cause to have reasonable suspicion. Reasonable suspucian can be swirving, almost hitting a semi, following to closely. Upon further investigation he lacked probable cause for an arrest. Mainly because the man was smart enough to refuse the field test.

You think it's the responsibility of the police to educate people about the law? Add that to the list of things we expect cops to do at all times - always be perfect, never make mistakes, know everything about every situation the second they show up, respond to calls within 5 seconds of being called, shoot guns out of people's hands so you don't have to kill them, disarm people with knives or blunt weapons without hurting them, know every single law and every applicable exception, and educate people about all of those laws. And do all of that while people are demanding to defund the police, stringing up good cops for enforcing the laws on people with the wrong skin tone, convincing good cops to quit, demanding more training while demanding less money go towards training, etc. Might just be easier to not break laws, like driving drunk.

Not showing ID is a CRIME? How does showing an ID absolve someone of a crime? Cops show up, ask people for ID, and that's about all they seem to do. I've watched hundreds of hours of police interactions and I've never seen them actually investigate nothing... Less one Crime!
Im a recovering alcoholic and have avoided a dui on numerous occasions before I got sober by not refusing field sobriety tests. I could pass 1 with ease regardless of my blood alcohol level and since I never refused 1 I was never forced to take a breathalyzer. Thankfully I don't have to live like that anymore.

@@4G63Tx I was never asked to take a breathalyzer because I never refused a field sobriety test. I was a professional drinker so it was always easy to pass. I warned them ahead of time that I was missing a ligaments in my dominant foot (wich I am) to explain any slight wobble

I’ve seen several cases of sober people failing them, many because of poor balance. Having to do the stand on one leg thing for so many seconds is almost impossible for anybody, even sober people. Cops lose their minds when a citizen uses their legal rights. He should have told the cop he has a built in breathalyzer - all the cop needs to do is unzip his pants and suck vigorously on the probe until he gets a sample which he can evaluate for alcohol based on it’s flavor!
This whole interaction lasted as long as it did because cops HATE when you tell them no and will do whatever it takes to try and get you on any technicality as punishment for defying them. You will go to jail for the most minor of offenses to teach you not to ever tell them no or question their authority.

I have a real narcissist here in my county. I am over 70 now and several years ago two county deputy's cars actually slid into my driveway, ordered me to stand about fifty feet away and they would talk to me in a minute. I have never in my long life did anything wrong. Never committed a crime. Heck, i haven't had a speeding ticket in over forty years. The two cops just stood at their cars joking and talking, so after about ten minutes i walked over to find out what was going on. In a flash the one crazy cop jumped on my back and started punching me, and then the other came over. I thought he was going to pull the cop off of me, but then he also started beating me. They threw me to the ground and my head hit a big rock knocking me out. As i was coming to, they began kicking me from head to toe. I was bruised from my head , down my body and even my feet were bleeding and bruised from them stepping on them. Then i was charged with assault on a cop! The judge, the cops and my public defender worked together and my public defender told me to take a plea deal. I was shocked. Then my public defender said i should take a plea deal or i would go to prison for five years. I am old and on a small fixed income so i couldn't afford a real lawyer. I ended up taking a deal which i had to attend several different programs. One was Alcoholics anonymous (i never have drank alcohol).. a drug addiction class (have never used drugs) and a psychiatric class. (which i actually led the class when the Doctor had to leave and go somewhere (which she did every day) She actually put me in charge of teaching the class! lol There are a lot of nutcase cops out there and one of the cops who attacked and beat me has killed people since, but they always say he was justified. One was an old man in his back yard and the cop was alone. He said he thought the man had a gun. He was very old and was holding a beer can. I am wary now and always have my Kahr 40 at my side. I'm too damn old to put up with it anymore. Sorry for writing a novel. Your post just hit the nail on the head and it reminded me of my incident.

@@mannycastle3011 Yes. 1) Demand to exist the vehicle. Legal only if officer fears for their safety. In this case it’s for a field sobriety test. 2) Saying the driver must verify his address on license is current. Driver does not need to answer, considered aiding the officer in his investigation against driver, violation of (4th or 5th?) amendment rights. 3)Saying driver must remove his eyeglasses so he can see if driver is impaired. Again, driver does not need to as it would be aiding officer in the investigation. This officer is nicer than most and is in training, so I give him some slack, but he is already making demands that would trick someone who doesn’t know their rights because they sound like it would be illegal to not follow them.

Most State Troopers are like this one. I have only met 2 that were seemingly decent human beings. I used to be in outside sales. The worst troopers I know of are in my home state of Ohio.

As my wife and I watched this video, I expressed to my wife the *exact same sentiment* that you are sayingin your comment! Obviously, you and I can only speculate that this is the case, as we don't personally know him (or at least *I* don't)...however, if I were a gambling man I would "put all of my chips" on him being a kid who was bullied his whole life, and chose this profession for all of the *wrong* reasons, such as: getting to be able to *be the bully,* rather than *being a victim.* On the flip-side, concerning "bad cops"/people who joined LE for all of the *wrong* reasons, there are also those who *were* the "school bullies" and always got off on picking-on others, and as adults, such behavior would not be tolerated in most professions, so they *too* joined LE for the absolute wrong reason; they want to carry on with their preditory/bullying behavior under the guise of being a "tough on crime" policeman (or even policewoman, for that matter). Either way both of these types of people have NO PLACE holding any type of authority, especially not in law enforcement! I have the utmost respect for all of the honorable men and women on the force. My in-laws are retired police officers (Las Vegas Metro, and Nevada Highway Patrol), my father [RIP] and sister worked in LE. My sister's fiance [RIP] and childhood next-door neighbor were/are on the Chicago-area and Chicago police force, and all of them, as well as others I've known in LE, took the job for the *right* reasons, and never abused their position of authority to my knowledge. I've encountered many officers who were kind, respectful, and doing their jobs professionally, as they should, and this was even BEFORE the era of "smartphones" and "body cams," but just like in every other area of life, there are "bad apples" that are a disgrace to others in their profession. There are doctors and lawyers who are dirty and corrupt, because this is how human beings are; most are decent/semi-decent, or at least not "terrible" human beings, but unfortunately, some are, and the young officer in this video seems like he got onto the force for all the wrong reasons. "Because I said so!" is *NOT* a "lawful order," it is something a parent says to a disobedient child! A good officer would have approached him like a *man* and addressed him with the same respect that he himself would like to be treated with. Respect is *earned* -even in short encounters. Speak to me respectfully, like a grown man, and I will respond in a respectful manner. Come at me condescending and barking orders, I certainly won't act foolish or give them any reason to shoot me or take me, but I will certainly not give *you* respect, when you have been disrespectful toward me. I would never give them "ammo" that can (and will) be used against me, but I would likely just say *nothing,* or as little as possible. I certainly wouldn't "happily cooperate" with a tyrannical jerk! Sorry for the rant, but I've met many A-holes like this jerk, and was even arrested and verbally terrorized and abused, on my last day of 3rd grade, along with a friend, for something we didn't even DO! I'm so glad to hear you say the tests are not pass/fail and just for collecting evidence, failure almost a certainty- because I failed one stone cold sober. It was dismissed in court after I blew 000's at the station twice. These "visual drug impairment experts" cops are becoming are alarming now too.
Same thing happened to me. They kept escalating the test saying i failed until we finally used the breathalyzer that read o.oo. The cop didn't want to even tell me what it said just angrily then told me to leave now and be on my way. He was mad that I was sober 🤦♂️

Unfortunately, cops have this stupid thing called qualified immunity, and the legal ability to lie,. But I agree with you. I don’t see how it is right for them to lie, but we can’t. They are supposed to be upholding the law what is we can clearly see with every video that comes out pretty much on the hour. That I don’t think there is a good cop. And in my 50+ years, I’ve never met one. Now granted, I don’t go around breaking the law either. But from everything I’ve seen and everything I’ve witnessed in my life there are no good cops. I used to aswell. Unfortunately it took 30+ years for me to change my view. After being pulled over 17 times in a 34 day period. All because someone living in my neighborhood just wasn't a fan of me but had a friend and happened to be a Sheriff Deputy. Person living in my neighborhood told his friend I was a big-time drug dealer and I supplied everyone in the area. You would think in order for Sheriff's Office to pull you over that many times in such a short period they would need some kind of proof or something. Those 17 different occasions they pulled me over I never got a ticket a citation anything because I wasn't doing anything illegal. But they kept pushing and I made a call down to the Sheriff's Office to ask why the fuck is going on and all sudden it just stopped. I'm about to go in all of the details because it's a lot but probably 25% of those stops they did some bullshit in like making me sit in mud as I'm in handcuffs. Dumping my Mountain Dew can out inside of my vehicle all over the inside and other childish and probably illegal Acts. Kind of odd no body Cam's wherever on no - cams wherever on so they claim.
One of my relatives is a good, honest man with even temperament and fastidious attention to the law. He was a sheriff's deputy for 20 years, then worked with the FBI task force as a liaison tracking, arresting, prosecuting, and convicting child pornographers and human traffickers. He was one of the few people in law enforcement I ever met that I would trust with my family's life, including my own. And when the conversation came up about abuse of police power, he said something that mortified me. People tend to gravitate to becoming police officers from two sources: (1) those that are humble, self-sacrificing, and are born of a character that wants to uphold, secure, *and* protect the rights and privileges of their encompassing community and its members. It could almost be considered a "calling", but one born from humility. They want to protect their neighbors, their children, and keep their community safe in a legal, moral, and ethical way, in accordance with the laws of their land. (2) those of personality temperament that are engrossed in wielding power via a position of authority where they can tell people what to do or not do, how to act or not act, where to go or not go, how to stand or not stand, what to say or not say, etc. And they feed that mantra via the auspices of sporting the means to exact lethal force as a threat to accomplish it. In short, they come from the pools of (1) servants, and (2) bullies that stroke their egos and get their rocks off by ordering people around. What shocked me was my relative, a life-long public servant, telling me flat-out a non-trivial *majority* of officers he's known (thousands of them) fall into the latter category, not the former. This man had seen a LOT during his career, and I found it mortifying that, in his experience, most officers wear the uniform because they "dig it", not because they want to truly serve the public at-large. We always knew there were some; but it was a real eye opener to hear how even the "good" officers know just how bad it really is.
It should be against the law for police to lie to you about the law and try to trick and entrap you 😤. These are tactics to try and collect money from you through dishonest means 😤
This is one reason never ever talk to them not even to say your name. A traffic violation is not a crime so they can not arrest you. All you have to do is show id. Just let them stand there and repeat themselves. Or even better turn on the radio and start singing.
They're allowed to lie because the supreme court failed to specify the difference between an undercover cop lying to keep his cover and a normal street cop or detective talking to a citizen while he's in his official capacity. So now they all use and abuse that allowance...
Entrapment is illegal, but entrapment is when a cop convinces you to commit a crime that you wouldn't have committed without their influence. There definitely should be a limit to what police can lie about. The purpose of allowing cops to lie was for undercover officers to maintain their cover and for use as an interrogation tactic.
Cops say there are no traffic violation quotas, but there are at least 5 cops in Monroe Louisiana that have been disciplined for not writing a sufficient number of traffic tickets.

There are good cops, but unless you're a habitual criminal you'll tend not to meet them. A large part of the problem with these auditor videos is that cops aren't being taught the law, which isn't entirely their fault.

Do not worry about being filmed, most people can only post a video soon forgotten and have no financial means to fight you in court, besides, the dept and judges have your back. If we have to let you go, we have your back, we will help you get into another dept. And if the worst happens and we have to throw you under the bus, you can be sure of atypical sentencing with a lot of protection and preferable treatment."
I just got a citation for failure to yield in an accident when the other driver ran through a red light, I was injured taken away in an ambulance. Was administered narcotics for pain. Arm broken in 3 places, not once when police called did she ask me what direction I was driving. I tried to contact officer three times. To no avail, I had to hire attorney for 1,000 to fight citation, still ongoing......

Your 5th amendment right to remain silent shouldn’t get you in technical trouble but I’ve read case law where judges believe remaining silent, with out invoking that right, doesn’t count. OR being silent could count as an admission to guilt. You’ve got to remind them you reserve the right to silence.
When refusing a field sobriety test use this line “Legal counsel has advised me your test are inherently flawed. I refuse to conduct any such test.” And not another word! Your lawyer will thank you

I was pulled over. I had 1 beer 2hours before I drove. I was asked to take the FST. I thought no problem I am sober. Took the test, and I thought I aced it. Nope....took me into custody and did a breath test at the sub station which came back .03. Well below the limit. The officer still booked me for duece based off of my FST performance. D.A. charged me and explain there is two ways they can charge . B.A.C. or F.S.T. I got it reduced to wreckless driving. My attorney informed me, that you do not have to take the F.S.T. Had I not, I would not have been charged.
"Is that a lawful order? Yes. You can order me to cut the grass too but that does not mean I have to do it." Good one. Many videos show people saying they do not answer questions but this guy does the best job I have seen. He knows he does not need to get out of the car to take any tests (only for the officer's safety which is not the case here) and he knows he does not have to lift his glasses to allow the officer to check his eyes. What his more is the officers states he needs him to lift his glasses so he can determine if he is impaired. In other words the office admits he cannot tell at present he is impaired. If the officer chooses to arrest him, he also just handed this guy a "get out of jail free" card.
What does the Supreme Courts say about getting out of vehicles? Folks need to stop giving wrong information out and causing folks to get arrested!!!!!!

If you want to see real reform, we need to get a ballot initiative started that puts it into law whenever a training officer is fired for misconduct every cop he ever trained in his entire life is immediately fired for being improperly trained. My dad has always been the one to remind me that, when dealing with any police officer, state trooper, etc. always wait 5 seconds before responding in order to dissect everything they just said and asked you about or to do and consider if it's a favor or the law. Cops are trained and coached in literal extortion tactics in order to squeeze as much money out of citizens they "protect and serve" in order to expand their budget for the following fiscal year and in turn, increase their own wages and the quality of their equipment as well. It's a filthy racketeering practice that is slowly becoming less possible with the advancement of technology i.e. body cams and camera phones in 4K. I grew up at the tale end of an era where the outcome of every situation was the cops word against your own which gave them a Supreme advantage over the public. My dad mentioned a friend of his who got drunk camping and was too hammered to set up his tent so he slept in the backseat of his car and was woke up by a park ranger and a state trooper tapping on his window. They questioned him, smelled booze and prepared to give him a D.U.I. evaluation through a sobriety test even though it was clear he hadn't drove since the night before. They were both super friendly with him and had a pleasant conversation about nature and camping etc. Towards the end of the chat and before the test they had him pull his car into a parking spot that wasn't in the way of boat trailers coming into the lot and he was so hungover/still tipsy and feeling great due to the wholesome conversation they provided he did it without a second thought. BOOM. D.U.I. car towed, license suspended, fines and court costs, drug/alcohol counseling classes and he lost his job without having transportation to make it to work everyday. They couldn't prove he drove that drunk and used a dirty tactic like instructing/asking him to move the car and he did it not realizing the set-up until they pulled in behind him in the parking spot with their lights on. Yeeeesh...I still remember that even at 10 years old it stuck with me. Protect yourselves people.
They did that to a friend of mine In Puerto Rico but the cop didn’t know that he had called his boss and his boss was in a car behind the cop and saw the whole thing and he got to sue the shit out these bastards..
Cops are not trained or coached in extortion tactics that is an out and out lie. Cops are trained in how to gather evidence and present that evidence in court, but extortion, this is not the 1930 doesn't happen. I would therefore find it hard to believe that a park ranger and state trooper would allow someone to move a cart if they thought he/she were intoxicated, asking someone to break the law to get an arrest, that woiuld be entrapment.

BAD ADVICE. Think about it. Make sense to you that a cop lies about your sobriety tests, arrests you, then has to take you for blood or breath test that will show you’re not drunk? If you are drunk, you can refused sobriety tests and still be arrested. In most if not all, states, the penalty for refusing a blood or breath test is harsher than for DUI, and you can still be convicted of the drunk driving. So, such a blessing.

As someone who was arrested for a DUI with zero alcohol in my system I can say this is the right way to go. They figured their breathalyzer was faulty and took me in based on their observations. Told them I just had knee surgery. Blood test came back with nothing after I was locked up. Still lost my instructor duty in the military because of the arrest.

Beat the case, but it took about 7 months after continuous court dates and the prosecution not wanting to drop the case until we requested trial. Military career was set back about 5 years because I was still charged with a DUI and I lost my clearance for a while and my instructor duty. Which is bad for your record.
That happened to me, I blew a 0.00. His sergeant apologized and made the cop apologize to me and ride me back to my vehicle. If I had known what I know now, I would have sued.

I misspoke on this video. Due to much of my time in law enforcement actually being in the state of Georgia. Under Implied Consent all drivers agree to recognize upon earning their driver's license agree to O.C.G.A. § 40-5-55 and § 40-5-67.1When we asked a driver to take filed sobriety test we always incorporated the breath test and or chemical test as well. If they refused the FSTs they would still need to take the breath or chemical test. If they refused then they faced their license being suspended. So even if they did not take the field sobriety test they were required to take a breath or chemical test.

I don't know where you get your information or how long it was since you were a LEO, how much experience, or what state you come from. You might want to clearly preference that in your videos. NHTSA sets the standards for field sobriety. A person indicates a failure by showing a specific number of clues per test. A person passes if they don't show the required amount of clues. It might be your verbage I have a slight issue with. You might want to also advise people that laws differ state by state. They change and might have after your change in employment. Your statement that field sobriety tests are not pass or fail is completely wrong. The tests are exactly pass or fail. You can say "indicates a pass or fail". However, you are now splitting hairs. People can pass field sobriety tests. I've had many pass. I'm sure that every police officer has. If you haven't, you were not in this career long. Then, I'm wondering why you commenting from this platform (We The People University). SFST's can also be used also for evidence gathering. The last time I looked at a Indiana probable cause affidavit (yesterday) they have a list of standardized field sobriety tests. Next to it are the words pass or fail with a box to check them accordingly. I think you also insinuated that without doing SFST'S there isn't any evidence of intoxication (maybe in this video). Overall, this isn't accurate either. You can establish probable cause without any field sobriety tests. I'll give you an example. The driver may have had poor driving behaviors, a strong odor of an alcoholic beverage coming from their breath, open container in plain view, slurred speech, glassy eyes, disorderly clothing (urinated on themselves) poor manual dexterity, they may be confused. Upon exiting a vehicle a LEO might observe unsteady balance, ect. Individually, you have next to nothing, you put all or some in a combination you can have probable cause. That's all that is required. You are correct that anyone can refuse SFST's. It is not a requirement that someone complete them at least in Indiana. Sometimes it would benift people to do them sometimes not. Refusal to perform the tests does not establish probable cause. You could say that some or all of those observations could be signs of a medical condition. You are correct. That's where a search warrant for their blood comes in. Which in my area requires a trip to the E.R. This is a great opportunity for medical professionals to take a look at the individual. When the blood draw results come back with anything at or above .08 or illegal drugs you most likely will be at least a per se violation. For those extremely unfortunate yet rare incidents that a person has a medical condition are arrested that person may consider a civil lawsuit. You are also correct that a person doesn't have to assist in a LEO investigation. I'll agree this police officer didn't say or do things perfectly, nor does anyone.They weren't completely awful or even close. I find you commenting on his errors then making your own shows how difficult this job can be. The officer telling him it is a lawful offer that he has to remove his sunglasses isn't accurate. That is not a lawful order. Maybe he misspoke like you. We all error it is part of life. This police officer isn't perfect and he isn't training someone completely wrong. At least with me, I never want to arrest anyone. I want to be the last resort. I hate the feeling of taking someone's freedom from them. Sometimes, it has to be done. The more information I have, the better decisions I can make. I work for the people. Not to sound rude but, saying you are a former police officer and former deputy sheriff doesn't really qualify you as an educated officer. There are just as many current uneducated officers as former ones. I really wouldn't take advice from anyone less that 10 years experience. That is about when an officer is grounded and decently educated. No matter the experience level or years of service, officers will make mistakes.I'm sure you did. Do you have any other education? Maybe a bachelor's or master's degree? Just something more than I did this job so I'm qualified. It might also help if you pointed out what the officer did well. That would cut down on the deviciveness. Unless that is the goal then you are doing well. There are a lot of aweful police officers out there. I do believe there are more good ones than bad. I do believe the system is broken and needs reformed. I do believe officers need to be held accountable. If that means being written up or even jail time. Even as a police officer I am not a back the blue guy, a thin blue line guy or any of that nonsense. I'm a pro common sense guy. I'm guy a that got into a career to help people. I will not dispute that I've been mortified of the actions of some law enforcement just as I've been mortified of the actions of the public. I truly believe that besides victims and family members of victims created by LEO's there is no one more angry at bad officers than good officers. Good officers pay the price for bad officers every day. Those that say good to that or they earned that are a part of the problem. It seems that it is not acceptable if law enforcement is treated poorly by one that we take it out on everyone. So I would challenge everyone to treat everyone how they want to be treated respect goes a long way for everyone.

FST'S (feild sobriety tests) include tests like the "walk and turn", "nystagmus eye tests", "ABC's and counting".. chemical tests are breath, blood and urine tests, a breathalyzer is the most common chemical test used during DUI investigations. It's important to understand the difference between "FST'S (eye test) and Chemical Tests (breathalyzer)". A breathalyzer is NOT an FST, it is a chemical test. No state requires you to preform FST'S, there is no punishment for refusing FST'S in any state... BUT there are punishments for refusing Chemical tests (aka a breathalyzer). When you get a license you are agreeing to provide a BAC (blood alcohol count) upon request of law enforcement. An officer can order you to provide your BAC (usually in the form of a breathalyzer) during a DUI investigation, if you refuse to provide your BAC or refuse the breathalyzer your license will automatically be suspended for 6 months to 1 year depending on your state.
The police will always ask you to preform FST'S before asking you to take a breathalyzer because their goal is to gather as much evidence as possible. FST'S strengthen their case.. if you refuse the FST'S (which is your right! And you cannot be penalized) the officer will then ask you to provide a BAC (blood alcohol count) using a breathalyzer. You CAN legally refuse a breathalyzer, in fact most lawyers recommend that you do (especially if you've actually been drinking) BUT your license will be suspended automatically.
It's also important to know that if you decide to refuse the breathalyzer and your license does get suspended for 6 months, a judge can over turn that suspension. Many times courts will look at a DUI suspension and decide that the officer did not have enough suspicion of intoxication to initiate a DUI investigation in the first place and the judge overturns the suspension. So, don't let the fact that your license will be suspended scare you into taking the breathalyzer. If you refuse the FST'S and the chemical tests, they have VERY LITTLE evidence that you were driving while intoxicated, as a result those cases are usually dismissed and your license reinstated. They may have other evidence like the officer saying "he smelt alcohol on your person" or they may have dash cam of you swerving BUT in a courtroom that evidence alone without FST'S makes a much weaker case. You are always better off refusing FST'S.
It's also important to understand that if you decide to refuse the chemical test (breathalyzer) and accept your license being suspended, an officer MIGHT still be able to arrest you on "suspicion of DUI" based solely on his observations. Observations such as " your speech is slurred, the odor of intoxicants, swerving, you appear unsteady on your feet"..Once you've been arrested he can apply for a search warrant for your blood and FORCE you to provide a BAC through blood sample.
Also, if you decide to take the breathalyzer and you blow a 0.00, the officer might still arrest you on "suspicion of driving under the influence" based solely on his observations!! An officer can use his observations such as " red glossy eyes, he smells weed on you or in the vehicle, or you were driving erratically" to help establish the probable cause he needs to arrest you. So, it's important to understand that even if you pass the breathalyzer you may still be arrested. Most lawyers recommend that you ALWAYS refuse FST'S and only submit to a breathalyzer if you haven't had anything to drink. If you have been drinking refuse both FST'S and chemical tests, let them arrest you and try to apply for a search warrant for your blood, it might be denied (strengthening your case).
So, to summarize you CAN refuse FST'S (walk and turn, eye tests, ABC's) without any penalty.. You CAN refuse chemical tests (breath, blood, urine) BUT you will be penalized and your license will automatically be suspended. Hope this helps!

Cop's on a power trip. Was pulled over recently for a DUI checkpoint. Told me I had to do a roadside sobriety test. I told them that they were harassing an at-risk senior. I'm legally disabled and couldn't pass such a test. I told them to charge me or release me. One or the other. Stuck to that statement and after 15 minutes of "ordering," me to do this or that, they finally told me to leave.
Best outcome. possible. Best to say NOTHING beyond the proverbial "Name, Rank, Serial Number." You need never justify yourself to any LEO; a cop must establish Reasonable Suspicion to detain in order to investigate for a crime(s), and Probable Cause to arrest. Hold the police to those standards, and don't give them ANYTHING. They are NOT your friends and don't have YOUR interests in mind.

I am very involved in my constitutional rights and very much understand them. I exercise them regularly. I am very involved in the audit community. But I do refuse to watch videos with a closed mind and i refuse to assume the cops are always wrong and the citizen is always right. I understand these youtube personalities ha e followers who think very one sided but I think openly and weigh every video seperately based on the evidence revealed in each video. That is the only way you can truely decide if someone rights had been violated. In this video there is no evidence the cop had RAS and there was no evidence that the cop was violating the mans rights either. Not showing ID is a CRIME? How does showing an ID absolve someone of a crime? Cops show up, ask people for ID, and that's about all they seem to do. I've watched hundreds of hours of police interactions and I've never seen them actually investigate nothing... Less one Crime!

I've heard it put this way, a DUI test will never be used to prove your innocence, only your guilt.
Im a recovering alcoholic and have avoided a dui on numerous occasions before I got sober by not refusing field sobriety tests. I could pass 1 with ease regardless of my blood alcohol level and since I never refused 1 I was never forced to take a breathalyzer. Thankfully I don't have to live like that anymore.

I have a real narcissist here in my county. I am over 70 now and several years ago two county deputy's cars actually slid into my driveway, ordered me to stand about fifty feet away and they would talk to me in a minute. I have never in my long life did anything wrong. Never committed a crime. Heck, i haven't had a speeding ticket in over forty years. The two cops just stood at their cars joking and talking, so after about ten minutes i walked over to find out what was going on. In a flash the one crazy cop jumped on my back and started punching me, and then the other came over. I thought he was going to pull the cop off of me, but then he also started beating me. They threw me to the ground and my head hit a big rock knocking me out. As i was coming to, they began kicking me from head to toe. I was bruised from my head , down my body and even my feet were bleeding and bruised from them stepping on them. Then i was charged with assault on a cop! The judge, the cops and my public defender worked together and my public defender told me to take a plea deal. I was shocked. Then my public defender said i should take a plea deal or i would go to prison for five years. I am old and on a small fixed income so i couldn't afford a real lawyer. I ended up taking a deal which i had to attend several different programs. One was Alcoholics anonymous (i never have drank alcohol).. a drug addiction class (have never used drugs) and a psychiatric class. (which i actually led the class when the Doctor had to leave and go somewhere (which she did every day) She actually put me in charge of teaching the class! lol There are a lot of nutcase cops out there and one of the cops who attacked and beat me has killed people since, but they always say he was justified. One was an old man in his back yard and the cop was alone. He said he thought the man had a gun. He was very old and was holding a beer can. I am wary now and always have my Kahr 40 at my side. I'm too damn old to put up with it anymore. Sorry for writing a novel. Your post just hit the nail on the head and it reminded me of my incident.

1) Demand to exist the vehicle. Legal only if officer fears for their safety. In this case it’s for a field sobriety test.
2) Saying the driver must verify his address on license is current. Driver does not need to answer, considered aiding the officer in his investigation against driver, violation of (4th or 5th?) amendment rights.
3)Saying driver must remove his eyeglasses so he can see if driver is impaired. Again, driver does not need to as it would be aiding officer in the investigation.
This officer is nicer than most and is in training, so I give him some slack, but he is already making demands that would trick someone who doesn’t know their rights because they sound like it would be illegal to not follow them.

As my wife and I watched this video, I expressed to my wife the *exact same sentiment* that you are sayingin your comment! Obviously, you and I can only speculate that this is the case, as we don't personally know him (or at least *I* don't)...however, if I were a gambling man I would "put all of my chips" on him being a kid who was bullied his whole life, and chose this profession for all of the *wrong* reasons, such as: getting to be able to *be the bully,* rather than *being a victim.* On the flip-side, concerning "bad cops"/people who joined LE for all of the *wrong* reasons, there are also those who *were* the "school bullies" and always got off on picking-on others, and as adults, such behavior would not be tolerated in most professions, so they *too* joined LE for the absolute wrong reason; they want to carry on with their preditory/bullying behavior under the guise of being a "tough on crime" policeman (or even policewoman, for that matter). I have the utmost respect for all of the honorable men and women on the force. My in-laws are retired police officers (Las Vegas Metro, and Nevada Highway Patrol), my father [RIP] and sister worked in LE. My sister's fiance [RIP] and childhood next-door neighbor were/are on the Chicago-area and Chicago police force, and all of them, as well as others I've known in LE, took the job for the *right* reasons, and never abused their position of authority to my knowledge. I've encountered many officers who were kind, respectful, and doing their jobs professionally, as they should, and this was even BEFORE the era of "smartphones" and "body cams," but just like in every other area of life, there are "bad apples" that are a disgrace to others in their profession. There are doctors and lawyers who are dirty and corrupt, because this is how human beings are; most are decent/semi-decent, or at least not "terrible" human beings, but unfortunately, some are, and the young officer in this video seems like he got onto the force for all the wrong reasons. "Because I said so!" is *NOT* a "lawful order," it is something a parent says to a disobedient child! A good officer would have approached him like a *man* and addressed him with the same respect that he himself would like to be treated with. Respect is *earned* -even in short encounters. Speak to me respectfully, like a grown man, and I will respond in a respectful manner. Come at me condescending and barking orders, I certainly won't act foolish or give them any reason to shoot me or take me, but I will certainly not give *you* respect, when you have been disrespectful toward me. It was dismissed in court after I blew 000's at the station twice. These "visual drug impairment experts" cops are becoming are alarming now too.
Same thing happened to me. They kept escalating the test saying i failed until we finally used the breathalyzer that read o.oo. The cop didn't want to even tell me what it said just angrily then told me to leave now and be on my way. He was mad that I was sober 🤦♂️

I used to aswell. Unfortunately it took 30+ years for me to change my view. After being pulled over 17 times in a 34 day period. All because someone living in my neighborhood just wasn't a fan of me but had a friend and happened to be a Sheriff Deputy. Person living in my neighborhood told his friend I was a big-time drug dealer and I supplied everyone in the area. You would think in order for Sheriff's Office to pull you over that many times in such a short period they would need some kind of proof or something. Those 17 different occasions they pulled me over I never got a ticket a citation anything because I wasn't doing anything illegal. But they kept pushing and I made a call down to the Sheriff's Office to ask why the fuck is going on and all sudden it just stopped. I'm about to go in all of the details because it's a lot but probably 25% of those stops they did some bullshit in like making me sit in mud as I'm in handcuffs. Dumping my Mountain Dew can out inside of my vehicle all over the inside and other childish and probably illegal Acts. Kind of odd no body Cam's wherever on no - cams wherever on so they claim.

One of my relatives is a good, honest man with even temperament and fastidious attention to the law. He was a sheriff's deputy for 20 years, then worked with the FBI task force as a liaison tracking, arresting, prosecuting, and convicting child pornographers and human traffickers. He was one of the few people in law enforcement I ever met that I would trust with my family's life, including my own. And when the conversation came up about abuse of police power, he said something that mortified me.
People tend to gravitate to becoming police officers from two sources:
(1) those that are humble, self-sacrificing, and are born of a character that wants to uphold, secure, *and* protect the rights and privileges of their encompassing community and its members. It could almost be considered a "calling", but one born from humility. They want to protect their neighbors, their children, and keep their community safe in a legal, moral, and ethical way, in accordance with the laws of their land.
(2) those of personality temperament that are engrossed in wielding power via a position of authority where they can tell people what to do or not do, how to act or not act, where to go or not go, how to stand or not stand, what to say or not say, etc. And they feed that mantra via the auspices of sporting the means to exact lethal force as a threat to accomplish it.
In short, they come from the pools of (1) servants, and (2) bullies that stroke their egos and get their rocks off by ordering people around.
What shocked me was my relative, a life-long public servant, telling me flat-out a non-trivial *majority* of officers he's known (thousands of them) fall into the latter category, not the former. This man had seen a LOT during his career, and I found it mortifying that, in his experience, most officers wear the uniform because they "dig it", not because they want to truly serve the public at-large. We always knew there were some; but it was a real eye opener to hear how even the "good" officers know just how bad it really is.

Entrapment is illegal, but entrapment is when a cop convinces you to commit a crime that you wouldn't have committed without their influence. There definitely should be a limit to what police can lie about. The purpose of allowing cops to lie was for undercover officers to maintain their cover and for use as an interrogation tactic.
Cops say there are no traffic violation quotas, but there are at least 5 cops in Monroe Louisiana that have been disciplined for not writing a sufficient number of traffic tickets.

There are good cops, but unless you're a habitual criminal you'll tend not to meet them. A large part of the problem with these auditor videos is that cops aren't being taught the law, which isn't entirely their fault.

I can imagine a conversation at police academies that goes like this, "don't worry about what you do, or if you violate someone's rights, or kill someone. We have your back, being struck by lightning is more likely to happen than you being held accountable. Do not worry about being filmed, most people can only post a video soon forgotten and have no financial means to fight you in court, besides, the dept and judges have your back. If we have to let you go, we have your back, we will help you get into another dept. And if the worst happens and we have to throw you under the bus, you can be sure of atypical sentencing with a lot of protection and preferable treatment."
I just got a citation for failure to yield in an accident when the other driver ran through a red light, I was injured taken away in an ambulance. Was administered narcotics for pain. Arm broken in 3 places, not once when police called did she ask me what direction I was driving. I tried to contact officer three times. To no avail, I had to hire attorney for 1,000 to fight citation, still ongoing......
I love how he wanted to get the man out of the car and would have cited "officer safety" but when asked to stand 6ft away he refuses knowing that a part of officer safety is REACTIONARY DISTANCE and less than 6ft is not enough distance to react!
It takes a human less than 2 seconds to travel 20 feet and stab you with a knife, about as long as it took you to read the first 4 words of the sentence. These clowns that stand right up on someone would never see a knife coming as their field of view is heavily impacted.

Your 5th amendment right to remain silent shouldn’t get you in technical trouble but I’ve read case law where judges believe remaining silent, with out invoking that right, doesn’t count. OR being silent could count as an admission to guilt. You’ve got to remind them you reserve the right to silence.

I was pulled over. I had 1 beer 2hours before I drove. I was asked to take the FST. I thought no problem I am sober.
Took the test, and I thought I aced it.
Nope....took me into custody and did a breath test at the sub station which came back .03. Well below the limit.
The officer still booked me for duece based off of my FST performance.
D.A. charged me and explain there is two ways they can charge . B.A.C. or F.S.T. I got it reduced to wreckless driving. My attorney informed me, that you do not have to take the F.S.T.
Had I not, I would not have been charged.
I love how he trained the new officer by challenging the training officer. That rookie learned a lot that day.

Many videos show people saying they do not answer questions but this guy does the best job I have seen. He knows he does not need to get out of the car to take any tests (only for the officer's safety which is not the case here) and he knows he does not have to lift his glasses to allow the officer to check his eyes. What his more is the officers states he needs him to lift his glasses so he can determine if he is impaired. In other words the office admits he cannot tell at present he is impaired. If the officer chooses to arrest him, he also just handed this guy a "get out of jail free" card.
What does the Supreme Courts say about getting out of vehicles? Folks need to stop giving wrong information out and causing folks to get arrested!!!!!!

My dad has always been the one to remind me that, when dealing with any police officer, state trooper, etc. always wait 5 seconds before responding in order to dissect everything they just said and asked you about or to do and consider if it's a favor or the law. Cops are trained and coached in literal extortion tactics in order to squeeze as much money out of citizens they "protect and serve" in order to expand their budget for the following fiscal year and in turn, increase their own wages and the quality of their equipment as well. It's a filthy racketeering practice that is slowly becoming less possible with the advancement of technology i.e. body cams and camera phones in 4K. I grew up at the tale end of an era where the outcome of every situation was the cops word against your own which gave them a Supreme advantage over the public. My dad mentioned a friend of his who got drunk camping and was too hammered to set up his tent so he slept in the backseat of his car and was woke up by a park ranger and a state trooper tapping on his window. They questioned him, smelled booze and prepared to give him a D.U.I. evaluation through a sobriety test even though it was clear he hadn't drove since the night before. They were both super friendly with him and had a pleasant conversation about nature and camping etc. Towards the end of the chat and before the test they had him pull his car into a parking spot that wasn't in the way of boat trailers coming into the lot and he was so hungover/still tipsy and feeling great due to the wholesome conversation they provided he did it without a second thought. BOOM. D.U.I. car towed, license suspended, fines and court costs, drug/alcohol counseling classes and he lost his job without having transportation to make it to work everyday. They couldn't prove he drove that drunk and used a dirty tactic like instructing/asking him to move the car and he did it not realizing the set-up until they pulled in behind him in the parking spot with their lights on. Yeeeesh...I still remember that even at 10 years old it stuck with me. Protect yourselves people.

Cops are not trained or coached in extortion tactics that is an out and out lie. Cops are trained in how to gather evidence and present that evidence in court, but extortion, this is not the 1930 doesn't happen. I would therefore find it hard to believe that a park ranger and state trooper would allow someone to move a cart if they thought he/she were intoxicated, asking someone to break the law to get an arrest, that woiuld be entrapment.

BAD ADVICE. Think about it. Make sense to you that a cop lies about your sobriety tests, arrests you, then has to take you for blood or breath test that will show you’re not drunk? If you are drunk, you can refused sobriety tests and still be arrested. In most if not all, states, the penalty for refusing a blood or breath test is harsher than for DUI, and you can still be convicted of the drunk driving. So, such a blessing.

As someone who was arrested for a DUI with zero alcohol in my system I can say this is the right way to go. They figured their breathalyzer was faulty and took me in based on their observations. Told them I just had knee surgery. Blood test came back with nothing after I was locked up. Still lost my instructor duty in the military because of the arrest.

Beat the case, but it took about 7 months after continuous court dates and the prosecution not wanting to drop the case until we requested trial. Military career was set back about 5 years because I was still charged with a DUI and I lost my clearance for a while and my instructor duty. Which is bad for your record.
There's a guy in Loveland CO that this happened to and it has affected his pilot license.
That happened to me, I blew a 0.00. His sergeant apologized and made the cop apologize to me and ride me back to my vehicle. If I had known what I know now, I would have sued.
