- Protesters have shut down college campuses across the country, creating a level of tension not seen since the Vietnam War. Threats of suspension and expulsion have been made by university administrations, but students continue to rally in support of Palestinians. Now, police across the country have begun to crack down, arresting over 1,000 protesters. This week on What’s America Thinking, host Julia Manchester dives deep into what rights these students have with constitutional law expert, criminal defense and civil rights lawyer, Robert McWhirter. Hear the latest on these protests out of Austin, Texas from Nexstar Nation's KXAN capitol bureau reporter Monica Madden.
What’s America Thinking? is a lively, informative show that leans into why Americans are so fed up with the government and its inability to make their lives better. We’ll focus on the people behind the polls, pocketbook issues, the disconnect between Washington and Main Street - what Americans are REALLY thinking!

Crazy how quickly the 1st Amendment evaporated for a foreign nation.
I know, right. Our politicians are trying so hard to suppress the ant-genocide movement that I don't really think they have stopped to consider what we see them doing. The authoritarian laws they are passing/supporting. Both Democrats and Republicans. Never forget what you all are witnessing Congress do right now. They can pass legislation within a matter of days when it comes to suppressing free speech, outlawing social media platforms that young people use, or just doing whatever a foreign nation that bribes them with campaign contributions tells them to do. But when it comes to what the people want: gun control, universal healthcare, more workers' rights, etc. Not a chance. And why would they? Our tax dollars already pay for their salaries and healthcare, and we have no choice in that matter, but the rich can choose to give them more on top of that. As long as money is allowed to infect politics, this problem will not be solved.

It’s good to see students animated by moral indignation. Would love to have seen this same degree of protest when the US invaded Iraq on utterly false pretences. “Between 280,771-315,190 have died from direct war related violence caused by the U.S., its allies, the Iraqi military and police, and opposition forces from the time of the invasion through March 2023.” [Watson Institute, Brown University].
This one is ripe for moral indignation. A group of people are abused, have their human rights stripped away, and are placed in an open air prison with blockades limiting their escape/access to things the rest of the world takes for granted; they strike out at their abusers; the abusers turn up the abuse to a level nobody can ignore and claim it is defending itself; and then the American people find out they funded and enabled this happening. Did those other events have all of this going on?
This happened during the wars in Iraq and Afghanistan. The reporting just didn't focus on it as much; much of the news coverage was "boots on the ground" showing soldiers and appreciating the first responders. For context, look at what happened to the Dixie Chicks and Lyle Lovett for saying Bush was an idiot: the media smeared dissent hardcore.

@stevencasteel6799 They were using the building to stand against investment in genocide. J6 folks did pay for up keep of the capital. The charge was the intentional attempt to disrupt a governmental procedure. I don't think they did anything wrong by simply entering the capital and occupying a space. Students spouting lefty speak is hilarious.. about time they experienced a taste of reality.
From the River To The Sea was first used by the Israeli Likud Party. The Palestinians only coined the phrase from the Israelis. But there is a difference. The Israelis mean Jews-only, while the Palestinians include Christians and Jews. Israelis do not consider themselves Arabs, but Palestinians consider Christian and Jewish Palestinians as their own.
" The Palestinians only coined the phrase from the Israelis."
'Coining" a phrase means that you originated it. You don't "coin a phrase" FROM someone else.
" Palestinians consider Christian and Jewish Palestinians as their own."
Then why did they elect Hamas as their leadership? Hamas most certainly does not accept Jews "as their own".
"The Israelis mean Jews-only" "Palestinians consider Christian and Jewish Palestinians as their own"
Have you ever been to Israel, the West Bank, or Gaza? If you did you would know how wrong these statements are. Israel is very diverse, both in religion- Jews, Muslims, and Christians, as well as in ethnicity (Arabs, Persians, Africans, Europeans, etc.), all of which have equal rights. Christians in Gaza have been persecuted by Muslims and have feared for their lives since Israel left Gaza in 2005. Just listen to street interviews of Palestinians. It is very clear what anti-Israel Palestinians want- Jews GONE (either by death or deportation). Some say they can stay but they will have lesser status to Muslims. Go. Search it up. Listen directly to Palestinians before making such statements.
The Likud platform of the 1990’s did not use that formula and did not turn it into a chant to be recited ad nauseam Most importantly, the Likud platform did not call for the eradication of an existing state as the Palestinian chant from the River to the Sea does
@@howardgootkin4216 what Israel says, and what Israel does are two completely different things. Words are cheap. Actions speak louder than words. Israel sought the "eradication" of the Palestinian state before it was even created in 1948. The Palestinian state did so as well. That is why the colonial project imposed on that region was doomed to fail from the start. There just isn't enough good an viable real estate to accommodate a functioning two state solution. And frankly, I do not understand why the one state solution was not pursued more aggressively. In Palestine, Christians, Jews and Muslims coexisted, intermarried and thrived as a society throughout until the rise of Zionism.

I am glad that McWhirter gave such a good break down on what is and is not protected by the First Amendment. I am no expert, but I think there is an avenue he did not touch on. When Action is Speech. For me, the Action of taking over these campuses is an expression of displeasure that is covered under Freedom of Expression. I would go so far as to liken it to a picket line during a Strike. An action that physically hampers an enterprise, and creates a blockage that is hard for customers to navigate. I think if this hits the Supreme Court, the protests and the encampments should be upheld as protected.
No. Wrong. "Freedom of Expression"??
@@mikeottersole
Tell me you didnt read the Constitution without telling me you did not read the Constitution...
Amendment I
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.
Overview
The First Amendment of the United States Constitution protects the right to freedom of religion and freedom of expression from government interference. It prohibits any laws that establish a national religion, impede the free exercise of religion, abridge the freedom of speech, infringe upon the freedom of the press, interfere with the right to peaceably assemble, or prohibit citizens from petitioning for a governmental redress of grievances. It was adopted into the Bill of Rights in 1791. The Supreme Court interprets the extent of the protection afforded to these rights. The First Amendment has been interpreted by the Court as applying to the entire federal government even though it is only expressly applicable to Congress. Furthermore, the Court has interpreted the Due Process Clause of the Fourteenth Amendment as protecting the rights in the First Amendment from interference by state governments.
Freedom of Speech / Freedom of the Press
The most basic component of freedom of expression is the right to freedom of speech.
*Freedom of speech may be exercised in a direct (words) or a symbolic (actions) way.*
Freedom of speech is recognized as a human right under article 19 of the Universal Declaration of Human Rights. The right to freedom of speech allows individuals to express themselves without government interference or regulation. The Supreme Court requires the government to provide substantial justification for interference with the right of free speech when it attempts to regulate the content of the speech. Generally, a person cannot be held liable, either criminally or civilly for anything written or spoken about a person or topic, so long as it is truthful or based on an honest opinion and such statements.
A less stringent test is applied for content-neutral legislation. The Supreme Court has also recognized that the government may prohibit some speech that may cause a breach of the peace or cause violence. For more unprotected and less protected categories of speech see advocacy of illegal action, fighting words, commercial speech, and obscenity.
*The right to free speech includes other mediums of expression that communicate a message.*
The level of protection speech receives also depends on the forum in which it takes place.
Let it rain plastic zip-tie cuff!!!!
I think its disingenuous to compare these people to 1968. Many of the protestors back then were protesting the draft. After it was announced there would be no more draft, the support for the protests tailed off.
It's exactly the same. The university protestors in Vietnam were exempt from the draft. The drafters came from non-college working class families, and the college students had no reason to worry about being drafted. Also, the draft was announced being ended like in 1974, the protests ended when the Vietnam war was being deescalated and we were bringing our people back. Also, their tuition money and taxes is going to atrocities, these kids are so brilliant and amazing for standing up for this. I wish my generation was this organized.
