I recently filed a claim for the PACT Act, Burn Human Waste on the DMZ in Korea in 1978, Recently had Kidney Cancer, so Far the Cancer is gone, wish me Luck.
I'm a vet and served in Korea from 77 to 1980. The Pact Act needs to go far enough. If you file a claim, it will most likely go nowhere. We have been left out. Some people will win their claim, but not many. I did the same thing you did. I came down with bladder cancer 7 years ago, had surgery at the VA, and the cancer is gone. I have a lot of friends I served with in bad condition with all sorts of problems and will die before they admit the problems caused by spraying herbicides and insecticides. Have you looked at this? You could have COPD. Or chronic respiratory diseases. Get enrolled in VA medical. Tell drs about the issues you have. Get an examination on each one them. It takes time to get it rolling. I watched RUclips and learned a lot.

I applied, turned down for insufficient data. Probably because I was in an area where what I was doing to items that were not supposed to be there (classified). This was back in the 60s, so you know data not available. MOS 436.1. Been treated for two kinds of cancer!
I tried to upgrade my disability from 10 % for tinitus a few years back. I got tested and got excuses left and right. I am dealing with it as best as I can. Sometimes I can barely notice it and fortunately for me once or twice a month I have to read lips to make out what is being said. I served in Nam for the 1st Bde 101st Abn from 66 - 68. I also served for the 1st Cav as a Bradley Master gunner from 1985 until I retired 1994. God has been good to me and my family.
They seem to deny the initial claims about 90% + of the time. However, I contacted a law firm that specializes in VA Claim denials/appeals/increases, and I am finally seeing good results. Heck, I even submitted my AD Service medical records that showed clearly that I was complaining about headaches/dizziness etc., before I EAS'd, and the VA said that since I waited and did not complain about these symptoms for 17 years after I EAS'd, that I was denied. Well, the latest claim letter showed "headaches, due to exposure" as a rating. We are winning pretty much all of the appeals, and are also getting my original ratings increased on top of that. Contact a law firm like I did. Well worth their fees.
10% is the max for tinnitus. Most times you get 0% for some hearing loss and they give you hearing aids to solve hearing loss. I don’t know the chart yet you have loose significant hearing and word comprehension to get a higher rating than zero for hearing loss. There are secondaries tied to tinnitus. Example are headaches and mental health.
Tinnitus, just an FYI, may help, may not. I finished out the Nam war in 1972. Then many years later, I received by my own excertion, tinnitus from braking 150 ft pound torque wrenches while in the Air Force Reserves in 1992. I did not go for the treatment that was told would need to be done. I did not want to loose my retirement. so I pushed on. Was not easy. 18 years later, the pain started easing up. I now have full use again. I do have hearing lose, from all the aircraft I worked on. But can not get help with that either. Fight on, so I learnt work-arounds there also. Fight on, do not give in, or give up.

79 year old Vietnam Veteran. I was in Air Force worked in Air Freight, load and unload all kinds of things. Yes, we loaded barrels of agent orange at least twice. Many airplanes still had residual agent orange stuff. Or whatever it was. I was young 19 yrs, didn’t know any better. We had body waste burn pits ( shit houses) that were burned everyday. Hey I applied, still waiting . Maybe after I die they will look at my stuff.
79 year old Viet Vet here too (Navy). I was deployed to a Thai airbase which is covered by Pact Act. Diagnosed with prostate cancer in 2008 (covered by P.A.). Since cured but still have some residual issues from chemo/radiation treatments. Like to hear from anybody with a success story.
@@sallypeterson6101 I have a success story. I was in from '95 - 2000, and was exposed to all sorts of toxic goo throughout my hitch. I was initially denied, even though I had submitted copies of my AD Medical records, as well as the VA records. I had to reach out to a law firm that deals specifically with VA and VA claims. They have been fighting for me and getting the denials appealed. So far I am up to 80%, from around 45%. We are also working on getting my current ratings increased.
I receive treatment from them for my PTSD. I can't approach their building without my anxiety going through the roof. All of my sessions are conducted by VTC. Physically being in that building make me feel they are not there to assist or help you. it seem that their priority is to protect the government by preventing you from trying to rip them off.
I’m a Vietnam vet. My barracks for 151/2 months was maybe 200 yards from a human waste burn pit where they also burned old uniforms and ALL other disposable waste. I even have a slide photo of the pit burn I turned in with a claim. I’ve had asthma for at least 45 years, now COPD. I’ve applied for PACT act and the evaluation says I have COPD and was given a disability of 0%. I have an appeal pending for 4 months. Wish me luck!!!
Hey, that's the same rating they gave me for HBP after a year of paperwork to prove to them that their previous records of my other disabilities was correct.
Does anyone find it strange that according to the PACT Act that burn pits were not used between the end of the Viet Nam War until post 9/11? I am a veteran who served in Beirut, Lebanon back in 1982-1983. We had burn pits that were actually 55 gallon drums cut in half. They were used as a latrine but were burned off regularly using diesel fuel. It wasn't just human waste in those drums when they were burned off. There were other things that were burned off as well, just like in the burn pits that are shown in anything talking about burn pits. Yet, evidently, those weren't a hazard like those pits used in pictures about the PACT Act. I guess the VA gets to have input in legislation so they can pick and choose which veterans they are looking out for. That seems to be the case in disability ratings and such. There are those that have a condition they are rated at a high rate for. Others with the same condition, and sometimes worse, are denied disability. Only after fighting for years is disability granted, sometimes. The favorite thing to use to deny a disability claim is saying that it is not service related, when it is documented in the veteran's medical records. There are even some that were denied disability for presumptive condition from Camp Lejeune water. The line there is that to acknowledge the veteran was there, that the veteran was exposed to the toxic water, but that the condition (that is on the presumptive list) isn't service connected. Want to know why so many veterans don't trust the VA? There is a good clue for you.
If you have been repeatedly denied for a condition, even a non-presumptive condition, even though you had help with a VSO, I suggest you hire an attorney. (Not sure if you have filed and have been denied, but you get the idea.) After 3 1/2 years, even though I had the help of a highly-qualified VSO, I hired an attorney, Katrina Eagle, who had the case settled in 7 months for a non-presumptive condition related to my husband's exposure to AO in Thailand. VSO's do a fabulous job, and mine had the paperwork all in perfect order, said my attorney. Makes no sense why getting an attorney works, but it did for me. There are other VA accredited law firms as well, and Google will help you with that if you so desire. I totally understand why so many veterans do not trust the VA.
I'll be dead by the time I get an appointment. If the admin people don't cop an attitude while making an appt. And it's sad our tax dollars pay for this shit.
For those of you who weren't aware, the PACT Act was expanded in March of this year to include veterans who were exposed to toxic contaminants INCONUS and not just deployed overseas or at Camp LeJeune. Please contact your VA for a TERA (Toxic Exposure Risk Assessment) consult. Some of the toxins we were exposed to INCONUS make the Middle East look like Candyland. If you have any questions about any of your duty stations' contaminants, you can research the Agency for Toxic Substances and Disease Registry for specific sites and get the Public Health Assessments that list the specific EPA contaminants, etc. I had no idea that NAS Cecil Field was put on the CERCLA/EPA National Priorities List in 1989 as a Superfund Site (the same year and list as LeJeune)- this is a list reserved for sites with hi-cut contaminants on a massive scale. What pisses me off is that the Navy knew about it in 1989 but didn't let anyone know; It was only made known after it was BRAC'd in 1999 and the City of Jacksonville took over the area. Twenty-five years later, millions of dollars in clean-up, and the land there can only be used for industrial sites or "hiking trails". Did you know that up until 1993 the Department of Energy stored enough nuclear warheads in Cecil Field's Yellow Water Weapons Area to decimate the Western Hemisphere, smack dab in the middle of the most populous city in Florida? We're not talking about the middle of the desert. All the info is out there if you just know where to look. I'm just a pissed off retired nurse with a computer.
Thank you to all, I have been blessed with five out of six awesome VA PCPs. All of the specialty docs have been great. I got lucky and have a very rare cancer, (goblet cell adeno carcinoma) so it falls under the PACT act. I got to go from fifty to a hundred percent. The tumor ruptured my appendix or else I would not even have know I had cancer. So they took out half my colon. More scars and after the first week everything was pretty much back to normal. So ya this is totally the exposure thing. I appreciate that there wasn't more hassle. Love and Respect.
I was exposed to JP8, JP9, depleted uranium used as counter weights on C-141 aircraft. Also, performed sanding, painting, fiberglass and carbon repairs on C-141 & C-17. Served 20 years and have ringing at times in my ears. Currently 60% disability for lower back injury during my service. Looking for information and support for 100% disability. Ty for your service to all the veteran brothers and sisters. Also, if you haven’t had the seven tier test done for Lyme through a holistic doctor, I highly recommend it. Two tier test is joke. I was diagnosed with Lyme this year and getting SOT therapy treatment. Please do your own research and god bless.
What?? I was a loadmaster on the C141 and didn't know about counterweights. I mean, I wouldn't doubt it. Just wasn't aware of it. So, I may have 3000 of flight time in proximity to this, wherever it's located?
@@thomashelm6931 True for the C-5's as well. Folks always mentioned that you had to be right up on the wingtips for it to matter. But if you're a young crew chief that's definitely a spot you've frequented. I wonder if the reason I just randomly vomit sometimes has something to do with all the JP-8/Jet A I messed with when I was a younger Airman. Might've consumed some anti seize at one point in time... Not sure where the DU would be located on a 141, probably wingtip/flight control area would be my guess. I know the old C-130 'A' had DU on their emergency exit door. JSTARS also had some DU and the such around the aircraft. Some of the older aircraft, their flight instruments contained tritium and radium. Could do you in eventually if exposed for "X" amount of time.
What about those of us that were exposed to hazards working on the flightline sometimes bathing in JP-8 and using those fire extinguishers in the 90's?
Exactly my question. I applied through the new PACT act for my late husband and exposure to JP-8 and also fire fighting foam. The VA denied saying it wasn't during combat??
actually all the stuff for that is covered since october of 2022. You have to tell them your mos or if you where a fire fighter. They are granting the cancers and breathing issues with that all the way back to ww2.
I had that issue Had a C-130 vent right on me and was head to toe bathed in JP8 Also I was inventory guy in POL and had to breathe all those fumes in every day when I had to measure the tank levels. I was exposed to JPTS, JP-8, JP-4, JP-5 That JP-8 Bath cracked my skin on my feet and they bleed for weeks...
@@sharonjackson5368 Fire fighting foam......right. Everyday for 4 years you sprayed foam, right? Or was just that one time when you were trained how to use it. That foam is generally fired from a turret operated by someone, that is completely shielded from contact with the foam, inside the truck. When I think of VA claims for disability I think of a transit bus accident when pedestrians outside of the bus rush to get inside the bus before the police show up.
I originally signed up for the registry in 2009 as we knew what we were exposed to wasn’t good. Had a PFT while still AD, retired in 2018 and had another. If you are a smoker, yes it works against you and your ongoing care, smoking fucks you up and it’s not discernible between hazardous exposures. Don’t be surprised if you get denied because of this. My buddies that smoke are the only ones getting denied for this. Now, if you’re still reading, the registry isn’t just limited to burn pits. Many exposures can be claimed as long as you are claiming it legitimately; meaning that it’s verifiable on training/deployment records. I was one of the first in the program after the PACT act was signed and it’s been very upfront. It’s the VA and it will take a while but they get it done if you are patient. Just be honest and don’t try to lump every other issue you have into it. Sleep apnea and all that other shit. Sure it could be a result but trust the process. I’ve had nothing but great service, slow yes, but great results and a diagnosis that I can work with now and know how to deal with. And again, if you smoke/vape whatever… knock that shit off and reapply if you’ve been denied. If you have questions, I probably won’t reply but maybe I will if I see a notification. And remember, not all VA treatment centers are the same, stay the course and don’t bullshit then and you’ll get what you need.

If you smoke remind VA in Lay Statement that Presumptive condition has nothing tondo with smoking, it doesn’t matter, you have proof of medical diagnosis, under presumptive, your entitled. I smoked 30 years, and they threw that In my face, but presumptive condition, proven, trumps smoking. Tell your friends to keep trying, previous decisions even state that smoking cannot be the reason for denial of presumptive diagnosis.
Appeal. They want you to give up. They down want to pay. It happened to me. I got denied, then I appealed and got it for cancer. I know it's bs because my claims get denied %99 percent of the time. Don't give up. Appeal, Appeal, and Appeal.

Sure do, I can't be on registry because my service area is not recognized. I was exposed to toxic burn pit pollution in my camp. I served at Camp Comanche, Tuzla, Bosnia. I've had a hard time with the VA. I'm not surprised VA gives you runaround.
What about the registry for those who served at fort Mcclellan? PACT ACT TITLE VIII--RECORDS AND OTHER MATTERS (Sec. 801) The VA must conduct an epidemiological study on the health trends of veterans who served at Fort McClellan at any time between January 1, 1935, and May 20, 1999.
@@Jerryman1963 thank you! I attended training there back in 1995 and just months after returning, I became symptomatic with an unexplained heart condition that I suffer from still today. I have no family history of condition and I had no symptoms until after leaving Fort McClellan.
@@harveyrobinson6827 my ptsd is rated at 70 with alcohol abuse syndrome, anxiety and depression all secondary after initial ptsd diagnosis. But since I go to work everyday that I can they will not make it 100 percent. But that all changes in April when they take away the can work clause. Have been waiting for judge for my back injury’s.
I can live with PTSD but I have many problems with the toxic side, I take over 20 pills twice a day. Shortness of breathing, weakness, tinging of the feet, numbness of the hands and legs. Sugar diabetes, Parkinson's, Heart DISEASE, IBS, uncontrollable blatter, and more. I'm over 300% on these and no compensation.
@@harveyrobinson6827 cigarettes, chewing tabacco, alcohol consumption, over eating, lack of exercise and 20 pills twice a day will do that to you. Drop 100 pounds and you be cured. I have never been to a burn pit in my 4 years, and I occasionally experience shortness of breath, tingling feet, numbness of hands and feet, and a long list of other ailments that everyone has throughout their lives. We are humans, not robots. DNA is a major factor for all of us. Trying to credit the rooster crowing every morning for making the sun rise is an argument that many vets use to justify their claims. Also, in my local VA clinic they replaced normal chairs in the waiting room with chairs that are almost 3 feet wide. What a disgrace when we reward bad behavior.

I am a 78-year-old Vietnam Veteran. At 70 I had to have my pancreas removed because it was in the early stages of cancer. I filed a claim on the advice of VA doctor. The claim was denied. I refilled after getting a supporting opinion from my surgeon at Mass General. The claim was denied again. Pancreatic cancer is now a presumptive condition in the Pact Act for Iraq and Afghanistan but not Vietnam. Thanks VA!
Did you re-file? I ask because since you filed a number of years ago and were denied, filing again even though it is not a presumptive disease, you might be successful. Also, you may get retroactive pay to the date of your first filing or to the date the PACT Act was signed. After 3 1/2 years of denials even though I went through a VSO, I finally got an attorney, Katrina Eagle in San Diego, and my DIC claim was approved in 7 months, even though diffuse gastric adenocarcinoma is NOT considered a presumptive disease.......yet. It should be, as should pancreatic cancer. The carcinogens in Agent Orange and burn pit smoke are the same: dioxin and benzene. ALL GI cancers are approved for burn pits, and gastric and pancreatic cancers are GI cancers. That makes no sense to me, and needs to be changed for the AO vets. Good luck!

I was on Swift Boats operating in the Cau Mau Península area of South Vietnam in 1969. This is the area that got heavy doses of Agent Orange. In fact, Admiral Zumwalt's son, who was on the same boats in that area, later died as a result. So, I put in for consideration. I've had some skin cancers. And I lost my gaul bladder a couple of years ago and my kideys are going south. I don't know if any of this was caused by my exposure, but it might be. I guess I will just wait and see what the VA thinks. I haven't got many years left. I hope they decide before I'm toast.
I want to add that if you have been denied most likely it’s not the rater fault. It is the C&P examiner that either did not correctly write all details or they just did not listen to the Veterans in the exam. I have had 3 cases where this happened one was for my migraines on 2 different appointments the same C&P examiner lied on my records. I explained that I have migraines. 3 or 4 days a week she put in her notes that I have a migraine every couple months. First time it was set at 10 percent second about she said the same thing in her notes. But I included my civilian doctors records after the fact. And it was raised to 30 percent should actually be 50. Next was for tinnitus on hearing test I pushed the button 4 times. Examiner asked when do you hear the ringing the most I told him when it’s quiet he said it’s not tinnitus and checked the box on his paper for no hearing lose and service member said hears ring most when quite. VA eaters can only go off of what is in the regulations and does it meet that criteria. If you have been seen and denied I suggest going to VA clinic and requesting you treat and diagnosis records from ROI. Get all your doctors notes and when you re file send copy’s of all that in. That is what I was told by a VA appointment scheduler. To do in reference to my cases and then call your congressman.
VA rating specialist also use their own bias and hate towards veterans and their country to make flawed decisions. There are communists that work at VA and VAMC
Oh, I know dang good and well that the evaluators made clear and concise notes to the positive, stating my ailments were directly caused by exposure and other service related/connected issues. I was denied every one of them initially. The VA said I took too long to start complaining about headaches/dizziness/sleeplessness/aches/breathing issues etc. I had initially submitted my AD Service medical records, where I was complaining about the symptoms before I even EAS'd, as well as my VA Medical records for over 20 years. They denied ALL of my claims. It Absolutely IS the "rater's" fault. They deny well over 90% of the initial claims. I and many other Veterans have had to seek assistance from law firms that handle VA claims specifically.
Agreed. Such examiners should be reported and negative reviews should be given about them. I had an examiner like that, the smirk on her face made me convinced that she was going to be negative. When I asked for a copy of my C and P paperwork, it turned out that I was right.
@@raphgate1496 I had the same C&P examiner for migraines twice both times she lied. And was telling me baby don’t worry I will fix everything and nope she said in her report that I get migraines 1 time every couple of months when I explained they happen atleast 4 times a week.
Right? I had no idea we could get copies of our C&P's. It looked like a 3rd grader with no medical background half-filled it out. No labs or diagnostic tests were listed, none of my complaints or symptoms. She had the chronic kidney stone surgery info on the C&P paperwork for the surgical repair of the thigh and knee from concertina wire... A nurse practitioner that looked about 26-years-old...
I’ve lost all confidence in the VA the pact act lol I’ve gone from sinusitis bronchitis Pneumonia now asthma and I get denied now I’ve gone to the same C&P exam multiple times for the same issues and to also have the same X-rays done and multiple PFT pulmonary function test when’s enough enough and I get no help from anyone when you call to ask why
@@gruenpunktI get bronchitis every year during COVID I quit smoking and my lungs filled with hard mucus couldn't cough it out I have a war injury to my spine I dried heaved blew out my back I was bedridden for three days went to VA said I had COVID gave me some stuff didn't work sparked up a cigarette and in a hour I was coughing it up so every November it acts up for years lasts a whole month due to the cold air
@@marknason589 Talk to your pulmonologist about Budesonide through a nebulizer. It made a world of difference to me. Also, research Bronchiolitis. It is different than bronchitis.
@@marknason589Have you considered quitting smoking? I’m not trying to be flippant. Smoking combined with other exposures causes multiplicative damage to your lungs. Plus chromosomal damage is additive as well. You can take only so many hits to your chromosomes before the self repair mechanisms are overwhelmed. I’d rather be alive and well than get a disability check from the VA.
Was told by DAV rep that veterans were having their percentage rating cut affecting their ability to support those depending on them. The ball is now in your court.
If you have presumptive, file supplemental to include Diagnostic Codes (DC) located in schedule of rating for a match and percent you may be entitled to. Submit a lay statement of your medical condition/disability based on location and exposure, request the percent stated in DC. Provide any epically records that reinforce, articles, and if presumptive, clearly state that. vA is not going to lead u at all, I found out the hard way, tell them what you are entitled to, why, when, how, etc., dates, places toxins. They know and should be Reaquesting a TERA Letter from DOD, which keeps records on all toxic chemicals, fuels, oils, solvents, paints, lead, fire fighting form for each members occupation!

I applied for the Pact symptoms a long time ago. Once they approved the Pact Act it was easy as pie because I was getting treatment for most of the symptoms!!!
No it’s not but you have to go slow and easy with VA. I guess mine was easy because my Pact act related symptoms were put in around 2009 so I wasn’t one of the people who woke up 1 day and jumped on the band wagon.
I love that the process worked/works for you! However, not everyones story is as simple or easy as yours. For 40 years, every appointment, every complaint, every diagnosis, every prescription, every conversation, & every mission recorded does not automatically qualify a veteran for assistance. Interesting thing about combat related, chemical warfare, top secret missions, & crypto clearance, even after 50 yrs the government rarely/barely acknowledges the damages that wreaked havoc on our bodies & minds. True but pointless if you didn't file on time. Not only do I qualify and have several presumptive and active conditions, but I've also been denied twice even after submitting medical records with detailed surgical procedures. Here's what many people don't know. If you file during active duty or shortly after retirement, you have an excellent chance for an approved claim. If you file for disability years after retirement regardless of what the PACT Act implies, it's nearly impossible to get approved. Of the plethora of information that's out there, the most important is to file immediately.

Keep trying, I made the mistake of being to docile at appts, now I go straight to the issue, “ because of toxic exposure,” I have the following medical condition…, iilnesses…, nightmares…cancer…. Make the C&Pbwrite down exactly what you need them to know, and yes, some of them seem like they have other things to do, but refocus them on your issue, your pain, your diagnosis, and how it is disabling.
I am really glad they are finally doing this but it is not enough. I served in Thailand and operated in Cambodia. I was not exposed to burn pits there. I was exposed while on deployment in the states. Now I have asthma and emphysema. Our whole division was deployed for months at the Yakima Firing Center. What about these guys?
I serve in Vietnam in Cam Rahn Bay and DucPho where there were burn pits in both places. I suffer with COPD. However nothing is ever mentioned about this. I later came down with Prostrate cancer I was awarded service connected. from other ailments that was the result of service in Nam but nothing about burn pits. I realize that being awarded 90% there isn't more to look forward TO RECEIVING.
We were all set up from the beginning. The VA is such a big machine, it is out of control. Yes there are folks there trying to help us, but redtape and the run arounds are too much. VFW, VSO's and the like are limited in how much they can help. If you have a strong case, it would be worth you time trying to find an experienced team to help you. There really is no rhyme or reason why some get approved and some don't. If you find someone to help, get everything in writing upfront, and make sure(as best as you can) it will be worth it in the end. Stay strong and fight the fight, (4 yrs and counting).
VA called me trying to get me to go to "community care" so I can be seen in the community, instead of a VA doctor and what not. It sounded good so I did. Ended up going to the emergency room, they couldn't really help me and got me a doctors appointment like **4** days later, which was impressive. Turn's out the VA does NOT approve of that. They wont allow anything unless it goes through your primary doctor, THEN it has to be viewed by a VA doctor to get a 2nd approval. I guess it's better then seeing a different doctor in the VA system every 6 months lol.
The registry means nothing as she said it’s research it gets you no closer to getting connected The info is not shared through the Va. you Do have to do something if service connection is what you seek You have to provide proof if you want to be connected This is the biggest problem I have with the system The veteran associates everything to being service connected and the VA wastes time, money and resources simplifying processes that is the least of their problems.
No listen current diagnosis of anything on the list and your deployment records is all you need. If you are being told anything else they are lying. And also 2 service members are during the government right now to reverse burden of proof back to the service members favor. If it goes right it will help a lot of vets.
Just like this, the other person said you don't need to connect time in service. Just the medical conditions listed, and you had to have served in the area of time. They denied me, and once I appealed, I got it. I was straight denied and with no exam before I appealed.
@@macsway2002 That's the issue at hand. What if the reacords don't list the areas of deplyment or have wrong deployment dates? I hounded the Whitehouse until after 2 years the Pentagon added a letter to my VA folder with a NEW listing of semi-classified information to supercede the listed info and got the ball rolling again. Not everyone has a folder with a golden ticket. I have exactly 28 pages in NARA of my service records that are mostly redacted. That was all that was declasified, and let me screwed for life. OH, and those records were released in 2021, 30 years after I left the Marines. Before that there was nothing.

Don’t give up, just revamp ur claim, you have a year from initial claim to provide supplemental. List everything you were exposed to, you inhaled, touched while performing your military occupation. If water was contaminated, you drank, washed your body and clothes in it if you lived on base in dorms and housing. Jet fuel fumes, lead paint on military equip and vehicles. You have to draw the picture and connect the dots, because they won’t, but u know, as we all do, what we were exposed to. Read Schedule of Rating VA, Diagnostic Codes (DC), Board of Appeals VA decisions, these items will help ppyou craft your Supplemental. You can file over and over again, with new evidence, information and proof. Request you epically records from your private provider and VA, song canreview and send in supporting docs. I remember working on the air field in vietnam and cleaning out toilets and pulling out the tubs and putting fuel in them and setting on fire ..man throat and eyes burned like hell when the wind change as those helicopter kept in and out .when i got back to the states .i was getting dizziness and out of breath.. i reported this to no avail

Entered Korea in1953, left in 1954. The Pack Act is just one of many benefits the Korean veteran is not qualified for. Have talked to the VA many times with the same results. (it don't apply to Korean Veterans). We had burn pits all over the place. Short list of problems that no one in my family has ever had, left kidney removed, gallbladder removed, clots in lungs, triple heart by pass, sinus polyps operated on 5 times, liver cysts, C Pap machine, now possible of pancreatic insufficiency.

What about Vets (76-83) exposed to thick black smoke of waste burn-offs (latrine/Honey Pots) in the field? Does this fall into the Open Pit (Pact Act) category? As a Medic we had to be present during each of those burn offs.
Me too and I was sick for 5 days. I even threw up paragart. Thank God I recovered. My brother is buried somewhere in Arlington and died As a result of Agent Orange and died with Parkinson’s disease.

According to a report from the VA Inspector General's Office over 80% of PACT act related claims for hypertension have been denied or awarded 0% compensation. Why doesn't someone address that issue?
I deployed to Somalia in 1992 and returned January 1993. My End of Active Service EAS was February 22 1993. My unit 3rd Battalion 9th Marine Regiment had many take leave upon our return to Camp Pendleton CA. So they did not begin updating Service Recird books until after I was out of the Corps. I applied under the PACT ACT as I have Cronic Sinusitis and Cronic Rinitus only to be denied as the VA has no record of me being in Somalia. I have submitted a supplemental with four "buddy" Letters. One from my wife, one from a LCpl formerly in our platoon and two Staff Sergeants who were in my Platoon during the deployment to Somalia and several years prior. I also sent the letters to the Marine Corps to get my DD214 corrected. The VA has had the Letters for months now and no response.
You need to call a law firm that deals with the VA claims/denials/appeals. I had to go that route, even though I had submitted the documents in the initial claims. They do not care, and it appears that they simply deny all claims initially only to see if the Veteran will submit an appeal. So far I have gone from around 45% up to 80% and we are still fighting.

Under the hypertension (high blood pressure) is a presumptive condition for those that served in specific areas where Agent Orange was used. I served in two of the areas (Thailand and Viet Nam) which is documented by my service record. I filed under PACT and was approved for hypertension disability, with 0 % compensation. OK, I was a firefighter in the military and have been exposed to millions of gallons of AFFF. It seems the only things they associate with it is cancer while independent studies have shown a lot more like miscarriage, high triglycerides, diabetes, non cancerous nodules, heart conditions, and the list goes on. The VA wont even test you for the presents of PFOA, and PFOS. It is frustrating as hell. My daughter have suffered from ovarian cancers, my wife a miscarriage and they were exposed by me coming home covered in the crap. Ive had a different type of cancer than they view, had pre cancerous polyps removed from my colon and nonthif this is covered.
Submit supplemtal for Chronic Residuals, look at diagnostic codes for symptoms and changes to your anatomy due to surgeries etc. just because the cancer is inactive does not mean you don’t have remaining medical condition pertaining to the cancer, do some research in the Schedule of Ratings, it will tell u the percent of disability that you may still be entitled to.
Can subsequentl deployment information be added now? I put in the information from my first sixth deployments when I initially registered, but I have been unable to reopen the file and add the information from my subsequent to deployments.
I filed a claim for my husband, under presumptive conditions and the PACT for his Colon Cancer/Bladder cancer death. It was denied because his exposure to hazardous chemicals was not during time of war? So the PACT act only applied to those who served during time of war.

The VA Burn Pit interview kept changing on me and cancelling my appointments, and finally just sent me a letter that said they didn't do Burn Pit interviews any longer, so go see your civilian Doctor. This has been a 'Hide and Seek' operation the whole time. I'm disgusted with chasing this program, and have just gave up. Probably what they wanted

I'm Desert Shield /Storm and I was denied everything I put in for 18 years ago, I have access to the medical care, but I got absolutely shit in disability even though it's all in my Army medical records. Hell I even gave the VA a copy a FILM (no digital back then) picture of the burn pits right outside of our camp (12 Evac Hospital), and they still denied me. We dumped and burned EVERYTHING from outhouse shit barrels, chemicals, body parts, plastic and only God knows what else. This was 18 years ago, I got depressed and gave up trying because at the time you only got one appeal and if it got denied you were toast forever. I'm still depressed just thinking about having to deal with the whole V.A's B.S process all over again. I really don't want to deal with the VA clown show, it really bother me dealing with bureaucratic B.S!

I too, disappointed with the VA. I believe many of my health issues are service connected. Also, my grown children have many of the same issues. Sure would be nice if the government would at least help my grown children, and their children understand their health issues. Sometimes even having proof, gets you denied.
Has anyone looked into covering deployed civilian federal employees? Kuwait had burning oil wells and raining oil in 1991 before the wells were capped. Same goes for the issues in follow-on deployments with the exposure to chemicals.
If you can get anyone to contact you on claims it would be a miracle to get new information and yes I am suffering from PTSD and other issues am working with mental health issues such as flashbacks at night and not being able to sleep. I am a typical U S soldier with Gulf War Syndrome but like Agent Orange in Vietnam the nation does not want to help veterans but will bend over backwards to help an illegal alien.
We burned a lot of crap (urine and feces) during Desert Storm. My unit was exposed to Sarin gas from an Iraqi cache that our engineers blew up. We were down wind ! We were exposed to radioactive dust climbing around the Iraqi tanks we had destroyed. Not last of all and certainly not least of all, we constantly drenched with or heavily exposed to FRH (fire resistant hydraulic) fluid . I guess that just wasn’t enough for VA

Recently evaluated under ‘PACT’ act; was awarded additional compensation but an equivalent amount was taken from my retirement check! No change in overall monthly allotments. What a bait & switch, worthless waste of time!

Cancer is presumptive for toxic exposure, 100% rating entitlement during active cancer, surgery, chemo, radiation and other treatments, in schedule of ratings, but they won’t tell u that, look up diagnostic codes and submit lay statement describing current treatments, 100% eligibility under specific diagnostic code (for up to 6 months after last treatment/procedure.

I have been to 31 appointments since may. Since enrolling in VA in 2007 I’ve had 11 failed surgical procedures, and over 1300 pages of medical records. Take it upon yourself to read your primaries notes and most of the time they do not coincide with what you just told them. It’s a business, and we are nothing more than a disposable product. I have been deemed unemployable, and underwent three different cancer screenings this year. The marrow in my spine, with not one operative disc, is deteriorating and the fluid that leaks from your discs is toxic to the bone and soft tissue surrounding it. I get a whopping 10%. My friend was an Army tanker and gets more for shin splints from operating foot pedals for loading the big gun.

Why are veterans who served in Europe during the Chernobyl disaster not included? There are vets who were there and had brain tumors, thyroid issues, and other related issues who continue to be denied service connection related to their service time.
I suffer from Sarcoidosis which is a respiratory issue, no a family history or not within the typical demographic that gets it. Told by pulmonologist that could be related to my days in AF working on high recon aircraft fuels (special fuel in the 80's living in England). Jet Fuel is toxicity that causes respiratory issues being exposed to it. Filed with VA, told not enough individual effected on the National VA Registry yet to be noted as an issue. If you have respiratory issues and worked closely with Jet Fuel's, especially High Attitude Recon aircraft, go get checked out by the VA and let's make the accountable for what we are suffering with. In the VA Study for the PACT Act it discusses exposure to Jet Fuel and respiratory issues, but they focused on burn pits, they need to expand that exposure to Jet Fuels and not limit it just to the Gulf War. Living in England at the base, there was quite a bit of chemicals in the shops that we were exposed to.

There’s enough research that shows a strong likelihood that being exposed to human waste contaminates triggers autoimmune responses and conditions due to the way our bodies naturally fight infections. Once our bodies create antibodies to human waste, our immune system starts attacking ourselves. Kinetic and chemical agents aren’t the only thing making us sick. Biological contaminants do, too.

What a joke, after the bill passed in DC, I submitted my claim for hypertension "after careful review by the VA," despite taking 2 or 3 meds for control I was denied (did not meet their interpretation of hypertension). This decision was made despite that I served in and around Pleiku VN in 69-70. Apparently AGENT ORANGE doesn't count. And I am not the only one who feels this way. Maybe VN service doesn't count any longer!
Yep! if your HTN is controlled with meds then you get 0%- even if your numbers, by all medical criteria are considered "poorly or uncontrolled", it doesn't fit the VA's criteria. It pretty much has to be stroke-level.

High anxiety! What a mess! All I got was a downgrade for an exam that didn't happen. We will teach you to complain. LOL Also they fail to properly record your BP. They keep taking it until they get a low number. The trick I discovered too late is to always say yes when you have a problem. Just because you are not having it today or this week doesn't mean you do not have a problem. They record how you enter a facility. i don't even bother anymore, i can't get past 90%. Went to the Va and was basically told no on anything and everything. Also, they insisted i moved past my point of pain, said i had full range of motion, although i was in major pain during the visit and about 3 weeks after. was in from 88-09. deployed 93, 95, 200, 2002. nope im just some old guy in pain and they dont care.

But, I cannot be used in a VBA claim. And I doubt highly, without submitting an application and going through the physical, “You’re in”. When speaking with the VA and a VSO, they say the registry has nothing to do with your VBA claim.

Hi, 11b20 who had LZ Center as main support base. It had burn pits for human waste and all other waste. But does not qualify as due the burn pits in the Mideast. Can this be looked into?

How come the retention pay ran out after 1 year I work at the va in FES and we got 1 st one last year and now they said we don’t have the money the coast guard got there’s already this year and our nurses got their bones but our service chief said the money dried up

I'm a vet and served in Korea from 77 to 1980. The Pact Act needs to go far enough. If you file a claim, it will most likely go nowhere. We have been left out. Some people will win their claim, but not many. I did the same thing you did. I came down with bladder cancer 7 years ago, had surgery at the VA, and the cancer is gone. I have a lot of friends I served with in bad condition with all sorts of problems and will die before they admit the problems caused by spraying herbicides and insecticides. Have you looked at this? You could have COPD. Or chronic respiratory diseases. Get enrolled in VA medical. Tell drs about the issues you have. Get an examination on each one them. It takes time to get it rolling. I watched RUclips and learned a lot.

I tried to upgrade my disability from 10 % for tinitus a few years back. I got tested and got excuses left and right. I am dealing with it as best as I can. Sometimes I can barely notice it and fortunately for me once or twice a month I have to read lips to make out what is being said. I served in Nam for the 1st Bde 101st Abn from 66 - 68. I also served for the 1st Cav as a Bradley Master gunner from 1985 until I retired 1994. God has been good to me and my family.

10% is the max for tinnitus. Most times you get 0% for some hearing loss and they give you hearing aids to solve hearing loss. I don’t know the chart yet you have loose significant hearing and word comprehension to get a higher rating than zero for hearing loss. There are secondaries tied to tinnitus. Example are headaches and mental health.

Tinnitus, just an FYI, may help, may not. I finished out the Nam war in 1972. Then many years later, I received by my own excertion, tinnitus from braking 150 ft pound torque wrenches while in the Air Force Reserves in 1992. I did not go for the treatment that was told would need to be done. I did not want to loose my retirement. so I pushed on.
Was not easy. 18 years later, the pain started easing up. I now have full use again. I do have hearing lose, from all the aircraft I worked on. But can not get help with that either. Fight on, so I learnt work-arounds there also. Fight on, do not give in, or give up.
Per 38 CFR 4.87, Diagnostic Code 6260, the maximum benefit allowed BY LAW for Tinnitus is 10%. A hearing loss diagnosis would be a separate.

79 year old Vietnam Veteran. I was in Air Force worked in Air Freight, load and unload all kinds of things. Yes, we loaded barrels of agent orange at least twice. Many airplanes still had residual agent orange stuff. Or whatever it was. I was young 19 yrs, didn’t know any better. We had body waste burn pits ( shit houses) that were burned everyday. Hey I applied, still waiting . Maybe after I die they will look at my stuff.

79 year old Viet Vet here too (Navy). I was deployed to a Thai airbase which is covered by Pact Act. Diagnosed with prostate cancer in 2008 (covered by P.A.). Since cured but still have some residual issues from chemo/radiation treatments. Like to hear from anybody with a success story.
@@sallypeterson6101 I have a success story. I was in from '95 - 2000, and was exposed to all sorts of toxic goo throughout my hitch. I was initially denied, even though I had submitted copies of my AD Medical records, as well as the VA records. I had to reach out to a law firm that deals specifically with VA and VA claims. They have been fighting for me and getting the denials appealed. So far I am up to 80%, from around 45%. We are also working on getting my current ratings increased.

I receive treatment from them for my PTSD. I can't approach their building without my anxiety going through the roof. All of my sessions are conducted by VTC. Physically being in that building make me feel they are not there to assist or help you. it seem that their priority is to protect the government by preventing you from trying to rip them off.
I’m a Vietnam vet. My barracks for 151/2 months was maybe 200 yards from a human waste burn pit where they also burned old uniforms and ALL other disposable waste. I even have a slide photo of the pit burn I turned in with a claim. I’ve had asthma for at least 45 years, now COPD. I’ve applied for PACT act and the evaluation says I have COPD and was given a disability of 0%. I have an appeal pending for 4 months. Wish me luck!!!

Hey, that's the same rating they gave me for HBP after a year of paperwork to prove to them that their previous records of my other disabilities was correct.
Does anyone find it strange that according to the PACT Act that burn pits were not used between the end of the Viet Nam War until post 9/11? I am a veteran who served in Beirut, Lebanon back in 1982-1983. We had burn pits that were actually 55 gallon drums cut in half. They were used as a latrine but were burned off regularly using diesel fuel. It wasn't just human waste in those drums when they were burned off. There were other things that were burned off as well, just like in the burn pits that are shown in anything talking about burn pits. Yet, evidently, those weren't a hazard like those pits used in pictures about the PACT Act. I guess the VA gets to have input in legislation so they can pick and choose which veterans they are looking out for. That seems to be the case in disability ratings and such. There are those that have a condition they are rated at a high rate for. Others with the same condition, and sometimes worse, are denied disability. Only after fighting for years is disability granted, sometimes. The favorite thing to use to deny a disability claim is saying that it is not service related, when it is documented in the veteran's medical records. There are even some that were denied disability for presumptive condition from Camp Lejeune water. The line there is that to acknowledge the veteran was there, that the veteran was exposed to the toxic water, but that the condition (that is on the presumptive list) isn't service connected. Want to know why so many veterans don't trust the VA? There is a good clue for you.
If you have been repeatedly denied for a condition, even a non-presumptive condition, even though you had help with a VSO, I suggest you hire an attorney. (Not sure if you have filed and have been denied, but you get the idea.) After 3 1/2 years, even though I had the help of a highly-qualified VSO, I hired an attorney, Katrina Eagle, who had the case settled in 7 months for a non-presumptive condition related to my husband's exposure to AO in Thailand. VSO's do a fabulous job, and mine had the paperwork all in perfect order, said my attorney. Makes no sense why getting an attorney works, but it did for me. There are other VA accredited law firms as well, and Google will help you with that if you so desire. I totally understand why so many veterans do not trust the VA.

For those of you who weren't aware, the PACT Act was expanded in March of this year to include veterans who were exposed to toxic contaminants INCONUS and not just deployed overseas or at Camp LeJeune. Please contact your VA for a TERA (Toxic Exposure Risk Assessment) consult. Some of the toxins we were exposed to INCONUS make the Middle East look like Candyland. If you have any questions about any of your duty stations' contaminants, you can research the Agency for Toxic Substances and Disease Registry for specific sites and get the Public Health Assessments that list the specific EPA contaminants, etc. I had no idea that NAS Cecil Field was put on the CERCLA/EPA National Priorities List in 1989 as a Superfund Site (the same year and list as LeJeune)- this is a list reserved for sites with hi-cut contaminants on a massive scale. What pisses me off is that the Navy knew about it in 1989 but didn't let anyone know; It was only made known after it was BRAC'd in 1999 and the City of Jacksonville took over the area. Twenty-five years later, millions of dollars in clean-up, and the land there can only be used for industrial sites or "hiking trails". Did you know that up until 1993 the Department of Energy stored enough nuclear warheads in Cecil Field's Yellow Water Weapons Area to decimate the Western Hemisphere, smack dab in the middle of the most populous city in Florida? We're not talking about the middle of the desert. All the info is out there if you just know where to look. I'm just a pissed off retired nurse with a computer.
The "expansion" only means you qualify for the VA's "healthcare". No presumptive conditions for CONUS (except LeJeune)

and have a very rare cancer, (goblet cell adeno carcinoma) so it falls under the PACT act. I got to go from fifty to a hundred percent. The tumor ruptured my appendix or else I would not even have know I had cancer. So they took out half my colon. More scars and after the
first week everything was pretty much back to normal. So ya this is totally the exposure thing. I appreciate that there wasn't more hassle.

I was exposed to JP8, JP9, depleted uranium used as counter weights on C-141 aircraft. Also, performed sanding, painting, fiberglass and carbon repairs on C-141 & C-17. Served 20 years and have ringing at times in my ears. Currently 60% disability for lower back injury during my service. Looking for information and support for 100% disability. Ty for your service to all the veteran brothers and sisters. Also, if you haven’t had the seven tier test done for Lyme through a holistic doctor, I highly recommend it. Two tier test is joke. I was diagnosed with Lyme this year and getting SOT therapy treatment. Please do your own research and god bless.

But if you're a young crew chief that's definitely a spot you've frequented. Not sure where the DU would be located on a 141, probably wingtip/flight control area would be my guess. I know the old C-130 'A' had DU on their emergency exit door. JSTARS also had some DU and the such around the aircraft. Some of the older aircraft, their flight instruments contained tritium and radium. Could do you in eventually if exposed for "X" amount of time.
What about those of us that were exposed to hazards working on the flightline sometimes bathing in JP-8 and using those fire extinguishers in the 90's?

how many times did you actually put out a fire? And fire extinguisher on the flight line used to be CO2 cylinders on large wheels.
actually all the stuff for that is covered since october of 2022. You have to tell them your mos or if you where a fire fighter. They are granting the cancers and breathing issues with that all the way back to ww2.

Also I was inventory guy in POL and had to breathe all those fumes in every day when I had to measure the tank levels.

@@sharonjackson5368 Fire fighting foam......right. Everyday for 4 years you sprayed foam, right? Or was just that one time when you were trained how to use it. That foam is generally fired from a turret operated by someone, that is completely shielded from contact with the foam, inside the truck. When I think of VA claims for disability I think of a transit bus accident when pedestrians outside of the bus rush to get inside the bus before the police show up.
I originally signed up for the registry in 2009 as we knew what we were exposed to wasn’t good. Had a PFT while still AD, retired in 2018 and had another. If you are a smoker, yes it works against you and your ongoing care, smoking fucks you up and it’s not discernible between hazardous exposures. Don’t be surprised if you get denied because of this. My buddies that smoke are the only ones getting denied for this. Now, if you’re still reading, the registry isn’t just limited to burn pits. Many exposures can be claimed as long as you are claiming it legitimately; meaning that it’s verifiable on training/deployment records. I was one of the first in the program after the PACT act was signed and it’s been very upfront. It’s the VA and it will take a while but they get it done if you are patient. Just be honest and don’t try to lump every other issue you have into it. Sleep apnea and all that other shit. Sure it could be a result but trust the process. I’ve had nothing but great service, slow yes, but great results and a diagnosis that I can work with now and know how to deal with. And again, if you smoke/vape whatever… knock that shit off and reapply if you’ve been denied. If you have questions, I probably won’t reply but maybe I will if I see a notification. And remember, not all VA treatment centers are the same, stay the course and don’t bullshit then and you’ll get what you need.

If you smoke remind VA in Lay Statement that Presumptive condition has nothing tondo with smoking, it doesn’t matter, you have proof of medical diagnosis, under presumptive, your entitled. I smoked 30 years, and they threw that In my face, but presumptive condition, proven, trumps smoking.
Tell your friends to keep trying, previous decisions even state that smoking cannot be the reason for denial of presumptive diagnosis.

But since I go to work everyday that I can they will not make it 100 percent. But that all changes in April when they take away the can work clause. Have been waiting for judge for my back injury’s.

@@harveyrobinson6827 cigarettes, chewing tabacco, alcohol consumption, over eating, lack of exercise and 20 pills twice a day will do that to you. Drop 100 pounds and you be cured. I have never been to a burn pit in my 4 years, and I occasionally experience shortness of breath, tingling feet, numbness of hands and feet, and a long list of other ailments that everyone has throughout their lives. We are humans, not robots. DNA is a major factor for all of us. Trying to credit the rooster crowing every morning for making the sun rise is an argument that many vets use to justify their claims.
Also, in my local VA clinic they replaced normal chairs in the waiting room with chairs that are almost 3 feet wide. What a disgrace when we reward bad behavior.

I am a 78-year-old Vietnam Veteran. At 70 I had to have my pancreas removed because it was in the early stages of cancer. I filed a claim on the advice of VA doctor. The claim was denied. I refilled after getting a supporting opinion from my surgeon at Mass General. The claim was denied again. Pancreatic cancer is now a presumptive condition in the Pact Act for Iraq and Afghanistan but not Vietnam. Thanks VA!
Did you re-file? I ask because since you filed a number of years ago and were denied, filing again even though it is not a presumptive disease, you might be successful. Also, you may get retroactive pay to the date of your first filing or to the date the PACT Act was signed. After 3 1/2 years of denials even though I went through a VSO, I finally got an attorney, Katrina Eagle in San Diego, and my DIC claim was approved in 7 months, even though diffuse gastric adenocarcinoma is NOT considered a presumptive disease.......yet. It should be, as should pancreatic cancer. The carcinogens in Agent Orange and burn pit smoke are the same: dioxin and benzene. ALL GI cancers are approved for burn pits, and gastric and pancreatic cancers are GI cancers. That makes no sense to me, and needs to be changed for the AO vets. Good luck!

I was on Swift Boats operating in the Cau Mau Península area of South Vietnam in 1969. This is the area that got heavy doses of Agent Orange. In fact, Admiral Zumwalt's son, who was on the same boats in that area, later died as a result. So, I put in for consideration. I've had some skin cancers. And I lost my gaul bladder a couple of years ago and my kideys are going south. I don't know if any of this was caused by my exposure, but it might be. I guess I will just wait and see what the VA thinks. I haven't got many years left. I hope they decide before I'm toast.
I want to add that if you have been denied most likely it’s not the rater fault. It is the C&P examiner that either did not correctly write all details or they just did not listen to the Veterans in the exam. I have had 3 cases where this happened one was for my migraines on 2 different appointments the same C&P examiner lied on my records. I explained that I have migraines. 3 or 4 days a week she put in her notes that I have a migraine every couple months. First time it was set at 10 percent second about she said the same thing in her notes. But I included my civilian doctors records after the fact. And it was raised to 30 percent should actually be 50. Next was for tinnitus on hearing test I pushed the button 4 times. Examiner asked when do you hear the ringing the most I told him when it’s quiet he said it’s not tinnitus and checked the box on his paper for no hearing lose and service member said hears ring most when quite. VA eaters can only go off of what is in the regulations and does it meet that criteria. If you have been seen and denied I suggest going to VA clinic and requesting you treat and diagnosis records from ROI. Get all your doctors notes and when you re file send copy’s of all that in. That is what I was told by a VA appointment scheduler. To do in reference to my cases and then call your congressman.

Oh, I know dang good and well that the evaluators made clear and concise notes to the positive, stating my ailments were directly caused by exposure and other service related/connected issues. I was denied every one of them initially.
The VA said I took too long to start complaining about headaches/dizziness/sleeplessness/aches/breathing issues etc. I had initially submitted my AD Service medical records, where I was complaining about the symptoms before I even EAS'd, as well as my VA Medical records for over 20 years. They denied ALL of my claims.
It Absolutely IS the "rater's" fault. They deny well over 90% of the initial claims. I and many other Veterans have had to seek assistance from law firms that handle VA claims specifically.
Agreed. Such examiners should be reported and negative reviews should be given about them. I had an examiner like that, the smirk on her face made me convinced that she was going to be negative. When I asked for a copy of my C and P paperwork, it turned out that I was right.
@@raphgate1496 I had the same C&P examiner for migraines twice both times she lied. And was telling me baby don’t worry I will fix everything and nope she said in her report that I get migraines 1 time every couple of months when I explained they happen atleast 4 times a week.
Right? I had no idea we could get copies of our C&P's. It looked like a 3rd grader with no medical background half-filled it out. No labs or diagnostic tests were listed, none of my complaints or symptoms. She had the chronic kidney stone surgery info on the C&P paperwork for the surgical repair of the thigh and knee from concertina wire... A nurse practitioner that looked about 26-years-old...
I’ve lost all confidence in the VA the pact act lol I’ve gone from sinusitis bronchitis Pneumonia now asthma and I get denied now I’ve gone to the same C&P exam multiple times for the same issues and to also have the same X-rays done and multiple PFT pulmonary function test when’s enough enough and I get no help from anyone when you call to ask why
Go to your State Veteran Service Officer (VSO). They love working these cases with Veterans. It brings benefits back to the state.

@@marknason589Have you considered quitting smoking? I’m not trying to be flippant. Smoking combined with other exposures causes multiplicative damage to your lungs. Plus chromosomal damage is additive as well. You can take only so many hits to your chromosomes before the self repair mechanisms are overwhelmed. I’d rather be alive and well than get a disability check from the VA.

If you have presumptive, file supplemental to include Diagnostic Codes (DC) located in schedule of rating for a match and percent you may be entitled to. Submit a lay statement of your medical condition/disability based on location and exposure, request the percent stated in DC. Provide any epically records that reinforce, articles, and if presumptive, clearly state that. vA is not going to lead u at all, I found out the hard way, tell them what you are entitled to, why, when, how, etc., dates, places toxins. They know and should be Reaquesting a TERA Letter from DOD, which keeps records on all toxic chemicals, fuels, oils, solvents, paints, lead, fire fighting form for each members occupation!

I applied for the Pact symptoms a long time ago. Once they approved the Pact Act it was easy as pie because I was getting treatment for most of the symptoms!!!

No it’s not but you have to go slow and easy with VA. I guess mine was easy because my Pact act related symptoms were put in around 2009 so I wasn’t one of the people who woke up 1 day and jumped on the band wagon.
I love that the process worked/works for you! However, not everyones story is as simple or easy as yours. For 40 years, every appointment, every complaint, every diagnosis, every prescription, every conversation, & every mission recorded does not automatically qualify a veteran for assistance. Interesting thing about combat related, chemical warfare, top secret missions, & crypto clearance, even after 50 yrs the government rarely/barely acknowledges the damages that wreaked havoc on our bodies & minds. True but pointless if you didn't file on time. Not only do I qualify and have several presumptive and active conditions, but I've also been denied twice even after submitting medical records with detailed surgical procedures. Here's what many people don't know. If you file during active duty or shortly after retirement, you have an excellent chance for an approved claim. If you file for disability years after retirement regardless of what the PACT Act implies, it's nearly impossible to get approved. Of the plethora of information that's out there, the most important is to file immediately.
That's why I am not bothering to register as far as burn pits.

Keep trying, I made the mistake of being to docile at appts, now I go straight to the issue, “ because of toxic exposure,” I have the following medical condition…, iilnesses…, nightmares…cancer…. Make the C&Pbwrite down exactly what you need them to know, and yes, some of them seem like they have other things to do, but refocus them on your issue, your pain, your diagnosis, and how it is disabling.
I am really glad they are finally doing this but it is not enough. I served in Thailand and operated in Cambodia. I was not exposed to burn pits there. I was exposed while on deployment in the states. Now I have asthma and emphysema. Our whole division was deployed for months at the Yakima Firing Center. What about these guys?
I serve in Vietnam in Cam Rahn Bay and DucPho where there were burn pits in both places. I suffer with COPD. However nothing is ever mentioned about this. I later came down with Prostrate cancer I was awarded service connected. from other ailments that was the result of service in Nam but nothing about burn pits. I realize that being awarded 90% there isn't more to look forward TO RECEIVING.
We were all set up from the beginning. The VA is such a big machine, it is out of control. Yes there are folks there trying to help us, but redtape and the run arounds are too much. VFW, VSO's and the like are limited in how much they can help. If you have a strong case, it would be worth you time trying to find an experienced team to help you. There really is no rhyme or reason why some get approved and some don't. If you find someone to help, get everything in writing upfront, and make sure(as best as you can) it will be worth it in the end. Stay strong and fight the fight, (4 yrs and counting).
VA called me trying to get me to go to "community care" so I can be seen in the community, instead of a VA doctor and what not. It sounded good so I did. Ended up going to the emergency room, they couldn't really help me and got me a doctors appointment like **4** days later, which was impressive. Turn's out the VA does NOT approve of that. They wont allow anything unless it goes through your primary doctor, THEN it has to be viewed by a VA doctor to get a 2nd approval.
I guess it's better then seeing a different doctor in the VA system every 6 months lol.
The registry means nothing as she said it’s research it gets you no closer to getting connected The info is not shared through the Va. you Do have to do something if service connection is what you seek You have to provide proof if you want to be connected This is the biggest problem I have with the system The veteran associates everything to being service connected and the VA wastes time, money and resources simplifying processes that is the least of their problems.
No listen current diagnosis of anything on the list and your deployment records is all you need. If you are being told anything else they are lying. And also 2 service members are during the government right now to reverse burden of proof back to the service members favor. If it goes right it will help a lot of vets.
Just like this, the other person said you don't need to connect time in service. Just the medical conditions listed, and you had to have served in the area of time. They denied me, and once I appealed, I got it. I was straight denied and with no exam before I appealed.
@@macsway2002 That's the issue at hand. What if the reacords don't list the areas of deplyment or have wrong deployment dates? I hounded the Whitehouse until after 2 years the Pentagon added a letter to my VA folder with a NEW listing of semi-classified information to supercede the listed info and got the ball rolling again. Not everyone has a folder with a golden ticket. I have exactly 28 pages in NARA of my service records that are mostly redacted. That was all that was declasified, and let me screwed for life. OH, and those records were released in 2021, 30 years after I left the Marines. Before that there was nothing.

Don’t give up, just revamp ur claim, you have a year from initial claim to provide supplemental. List everything you were exposed to, you inhaled, touched while performing your military occupation. If water was contaminated, you drank, washed your body and clothes in it if you lived on base in dorms and housing. Jet fuel fumes, lead paint on military equip and vehicles. You have to draw the picture and connect the dots, because they won’t, but u know, as we all do, what we were exposed to. Read Schedule of Rating VA, Diagnostic Codes (DC), Board of Appeals VA decisions, these items will help ppyou craft your Supplemental. You can file over and over again, with new evidence, information and proof. Request you epically records from your private provider and VA, song canreview and send in supporting docs. Review presumptive condition information, Inthink we all have more than 1 condition!

I remember working on the air field in vietnam and cleaning out toilets and pulling out the tubs and putting fuel in them and setting on fire ..man throat and eyes burned like hell when the wind change as those helicopter kept in and out .when i got back to the states .i was getting dizziness and out of breath.. i reported this to no avail

Entered Korea in1953, left in 1954. The Pack Act is just one of many benefits the Korean veteran is not qualified for. Have talked to the VA many times with the same results. (it don't apply to Korean Veterans). We had burn pits all over the place. Short list of problems that no one in my family has ever had, left kidney removed, gallbladder removed, clots in lungs, triple heart by pass, sinus polyps operated on 5 times, liver cysts, C Pap machine, now possible of pancreatic insufficiency.
I was stationed in Johnson Island and never got check for over exposing this Island don't exist now but we were stationed there processing all types of ammunition and other items, Is filing for this same process?

What about Vets (76-83) exposed to thick black smoke of waste burn-offs (latrine/Honey Pots) in the field? Does this fall into the Open Pit (Pact Act) category? As a Medic we had to be present during each of those burn offs.

You most likely showered and bathed init as well if the water on the base was contaminated, include your full body exposure on all claims.

According to a report from the VA Inspector General's Office over 80% of PACT act related claims for hypertension have been denied or awarded 0% compensation. Why doesn't someone address that issue?
I deployed to Somalia in 1992 and returned January 1993. My End of Active Service EAS was February 22 1993. My unit 3rd Battalion 9th Marine Regiment had many take leave upon our return to Camp Pendleton CA. So they did not begin updating Service Recird books until after I was out of the Corps. I applied under the PACT ACT as I have Cronic Sinusitis and Cronic Rinitus only to be denied as the VA has no record of me being in Somalia. I have submitted a supplemental with four "buddy" Letters. One from my wife, one from a LCpl formerly in our platoon and two Staff Sergeants who were in my Platoon during the deployment to Somalia and several years prior. I also sent the letters to the Marine Corps to get my DD214 corrected.
The VA has had the Letters for months now and no response.
I was with Heavy Guns 2/9 during that deployment that sucked balls. I just applied for these similar ailments.
You need to call a law firm that deals with the VA claims/denials/appeals. I had to go that route, even though I had submitted the documents in the initial claims. They do not care, and it appears that they simply deny all claims initially only to see if the Veteran will submit an appeal. So far I have gone from around 45% up to 80% and we are still fighting.
Did u get a medal for that deployment? That may be proof if it’s on your awards statement.

Under the hypertension (high blood pressure) is a presumptive condition for those that served in specific areas where Agent Orange was used. I served in two of the areas (Thailand and Viet Nam) which is documented by my service record. I filed under PACT and was approved for hypertension disability, with 0 % compensation. Can anyone explain why.

OK, I was a firefighter in the military and have been exposed to millions of gallons of AFFF. It seems the only things they associate with it is cancer while independent studies have shown a lot more like miscarriage, high triglycerides, diabetes, non cancerous nodules, heart conditions, and the list goes on. The VA wont even test you for the presents of PFOA, and PFOS.
It is frustrating as hell. My daughter have suffered from ovarian cancers, my wife a miscarriage and they were exposed by me coming home covered in the crap.
Ive had a different type of cancer than they view, had pre cancerous polyps removed from my colon and nonthif this is covered.

Yes I am on the list, got stage 4 throat cancer, nearly killed me VA said it was service connected but since I lived I 0 % for it.
Submit supplemtal for Chronic Residuals, look at diagnostic codes for symptoms and changes to your anatomy due to surgeries etc. just because the cancer is inactive does not mean you don’t have remaining medical condition pertaining to the cancer, do some research in the Schedule of Ratings, it will tell u the percent of disability that you may still be entitled to.

I filed a claim for my husband, under presumptive conditions and the PACT for his Colon Cancer/Bladder cancer death. It was denied because his exposure to hazardous chemicals was not during time of war? So the PACT act only applied to those who served during time of war.

The VA Burn Pit interview kept changing on me and cancelling my appointments, and finally just sent me a letter that said they didn't do Burn Pit interviews any longer, so go see your civilian Doctor. This has been a 'Hide and Seek' operation the whole time. I'm disgusted with chasing this program, and have just gave up. Probably what they wanted

I'm Desert Shield /Storm and I was denied everything I put in for 18 years ago, I have access to the medical care, but I got absolutely shit in disability even though it's all in my Army medical records. Hell I even gave the VA a copy a FILM (no digital back then) picture of the burn pits right outside of our camp (12 Evac Hospital), and they still denied me. We dumped and burned EVERYTHING from outhouse shit barrels, chemicals, body parts, plastic and only God knows what else. This was 18 years ago, I got depressed and gave up trying because at the time you only got one appeal and if it got denied you were toast forever. I'm still depressed just thinking about having to deal with the whole V.A's B.S process all over again. I really don't want to deal with the VA clown show, it really bother me dealing with bureaucratic B.S!

I too, disappointed with the VA. I believe many of my health issues are service connected. Also, my grown children have many of the same issues. Has anyone looked into covering deployed civilian federal employees? Kuwait had burning oil wells and raining oil in 1991 before the wells were capped. Same goes for the issues in follow-on deployments with the exposure to chemicals.
If you can get anyone to contact you on claims it would be a miracle to get new information and yes I am suffering from PTSD and other issues am working with mental health issues such as flashbacks at night and not being able to sleep. I am a typical U S soldier with Gulf War Syndrome but like Agent Orange in Vietnam the nation does not want to help veterans but will bend over backwards to help an illegal alien.
We burned a lot of crap (urine and feces) during Desert Storm. My unit was exposed to Sarin gas from an Iraqi cache that our engineers blew up. We were down wind ! We were exposed to radioactive dust climbing around the Iraqi tanks we had destroyed. Not last of all and certainly not least of all, we constantly drenched with or heavily exposed to FRH (fire resistant hydraulic) fluid . I guess that just wasn’t enough for VA

Recently evaluated under ‘PACT’ act; was awarded additional compensation but an equivalent amount was taken from my retirement check! No change in overall monthly allotments. What a bait & switch, worthless waste of time!

Cancer is presumptive for toxic exposure, 100% rating entitlement during active cancer, surgery, chemo, radiation and other treatments, in schedule of ratings, but they won’t tell u that, look up diagnostic codes and submit lay statement describing current treatments, 100% eligibility under specific diagnostic code (for up to 6 months after last treatment/procedure.

I have been to 31 appointments since may. Since enrolling in VA in 2007 I’ve had 11 failed surgical procedures, and over 1300 pages of medical records. Take it upon yourself to read your primaries notes and most of the time they do not coincide with what you just told them. It’s a business, and we are nothing more than a disposable product. I have been deemed unemployable, and underwent three different cancer screenings this year. The marrow in my spine, with not one operative disc, is deteriorating and the fluid that leaks from your discs is toxic to the bone and soft tissue surrounding it. I get a whopping 10%. My friend was an Army tanker and gets more for shin splints from operating foot pedals for loading the big gun.

Why are veterans who served in Europe during the Chernobyl disaster not included? There are vets who were there and had brain tumors, thyroid issues, and other related issues who continue to be denied service connection related to their service time.
I suffer from Sarcoidosis which is a respiratory issue, no a family history or not within the typical demographic that gets it. Told by pulmonologist that could be related to my days in AF working on high recon aircraft fuels (special fuel in the 80's living in England). Jet Fuel is toxicity that causes respiratory issues being exposed to it. Filed with VA, told not enough individual effected on the National VA Registry yet to be noted as an issue. If you have respiratory issues and worked closely with Jet Fuel's, especially High Attitude Recon aircraft, go get checked out by the VA and let's make the accountable for what we are suffering with. In the VA Study for the PACT Act it discusses exposure to Jet Fuel and respiratory issues, but they focused on burn pits, they need to expand that exposure to Jet Fuels and not limit it just to the Gulf War. Living in England at the base, there was quite a bit of chemicals in the shops that we were exposed to.
Sarcoidosis is actually an autoimmune disease. You might be able to get your claim approved by using that pathway.
I went to the VA to apply for toxic PFAS chemicals exposure. They put in my medical records I did not request evaluation for toxic exposure according to the PACT Act and that I should come back in 5 years and try again. The VA employees lie to you and don't test you.

Let me know when they’ve added the autoimmune disorders to the burn pit registry list of conditions. There’s enough research that shows a strong likelihood that being exposed to human waste contaminates triggers autoimmune responses and conditions due to the way our bodies naturally fight infections. Once our bodies create antibodies to human waste, our immune system starts attacking ourselves.
Kinetic and chemical agents aren’t the only thing making us sick. Biological contaminants do, too.

What a joke, after the bill passed in DC, I submitted my claim for hypertension "after careful review by the VA," despite taking 2 or 3 meds for control I was denied (did not meet their interpretation of hypertension). This decision was made despite that I served in and around Pleiku VN in 69-70. Apparently AGENT ORANGE doesn't count. And I am not the only one who feels this way. Maybe VN service doesn't count any longer!
Yep! if your HTN is controlled with meds then you get 0%- even if your numbers, by all medical criteria are considered "poorly or uncontrolled", it doesn't fit the VA's criteria. It pretty much has to be stroke-level.

My husband got approved for a presumptive condition due to burn pits. However he got 0% disability for it because the colon cancer polyp was removed. So no compensation for giving him cancer in the first place?

High anxiety! What a mess! All I got was a downgrade for an exam that didn't happen. We will teach you to complain. LOL Also they fail to properly record your BP. They keep taking it until they get a low number. The trick I discovered too late is to always say yes when you have a problem. Just because you are not having it today or this week doesn't mean you do not have a problem. They record how you enter a facility. So, if you are trying to strengthen your muscles by not using a walker or wheelchair you will be zapped.
i don't even bother anymore, i can't get past 90%. Went to the Va and was basically told no on anything and everything. Also, they insisted i moved past my point of pain, said i had full range of motion, although i was in major pain during the visit and about 3 weeks after. was in from 88-09. deployed 93, 95, 200, 2002. nope im just some old guy in pain and they dont care.

@@jmackinjersey1 if you are deemed unemployable by SS you can get an automatic bump to 100%, as long as you have a 70% rating.
However, if you are 18 and joined but are stressed out by the military lifestyle and want a sex change and then want out.... you'll get 100%
But, I cannot be used in a VBA claim. And I doubt highly, without submitting an application and going through the physical, “You’re in”.
When speaking with the VA and a VSO, they say the registry has nothing to do with your VBA claim.

Hi, 11b20 who had LZ Center as main support base. It had burn pits for human waste and all other waste. But does not qualify as due the burn pits in the Mideast. Can this be looked into?
if you served in any of the gulf war theathers, it is now covered to include the air space. make sure to check your 2-1 for assignments that its listed.
How come the retention pay ran out after 1 year I work at the va in FES and we got 1 st one last year and now they said we don’t have the money the coast guard got there’s already this year and our nurses got their bones but our service chief said the money dried up
