One of the grounds for declaring Delegated legislation ultra vires is if parent Act is ultra vires, but in Hamdard Dawakhana case only section 3(d) was held ultra vires and not the Act. Then how is this related to this ground?
It's in control of both legislature and judiciary. And legislature means parliament and state legislative assembly. So in gist it could be held that this control is exercised by lok sabha, rajya sabha and vidhaan sabha.
PM is the executive head so yeah before order/ rules comes in existence they must've been through the PM . And talking about SC and HC this is what this video is all about ie. Judicial control by applying doctrine of ultra vires and to held the provisions/ rules unconstitutional and make them dysfunctional.
When through the various provisions of an Act, the legislature delegates the law making power or legislative powers to the executive, the Act through which the powers are delegated is called as Parent Act and the law made by the executive by virtue of those provisions is called as delegated legislation.
