Dershowitz admits to receiving massages on Epstein's island, but insists that he always kept his underwear on.
Which is the exact opposite of what the interviewer did.

I've seen it reported that exactly that was discussed in Braggs office - they were arguing whether Stormy should be charged. Then the Orange hatred nipped that in the bud.
And if he entered into an NDA with her, that's completely legal. I guess you could call it blackmail, but it's not really.
And if you look up extortion, it doesn't really fit what she did, either. That would be more akin to what J. Bratt (Florida documents case prosecutor) did to Walt Nautas lawyer (threatening his petition for judgeship with Biden).

I did a ctrl-f of the indictment. The word "tax" didn't come up. That would suggest he didn't claim any of the money (Cohen's legal fees, OR the payment to Stormy) as deductions.

It's a crime to kidnap someone, it's not a crime to pay the ransom. It's a crime to extort someone. It's not considered a crime to comply with the extortionist's demands.
Because the kidnapper or extortionist is assumed to be the criminal, and their victim is assumed to be acting under duress.
Michael Avenatti, currently serving more than 20 years (14, once you consider concurrent sentencing) represented Stormy during this hush money settlement.
He helped Stormy extort Trump out of $130k in exchange for a nondisclosure agreement, then helped her violate that agreement by negotiating an $800k tell-all book deal. THEN he committed forgery, identity theft and wire fraud to steal nearly $300k of her book advance payments.
He also attempted to extort Nike out of $25m. And then he defrauded four of his other clients, including one who's paralyzed in a wheelchair, out of a total of $7.6m in settlement money.
Oh, and he owned a coffee business on the side, and over the years deducted $3.2m in payroll taxes from his employees' pay checks, but instead of forwarding it to the IRS, put it all in his own pocket.
So yeah. Who's the victim here?
The IRS? Nope. If he'd fraudulently claimed any of it as a deduction, the word "tax" would appear in the indictment.
Shareholders? Nope. He paid through a solely held corporation.
Stormy? Nope, she got her hush money.
Avenatti? Nope. He got his cut, and then some, out of Stormy.
Cohen? Nope. He was reimbursed for the payment, and paid for his services.
Campaign donors? Nope. Trump didn't use campaign money.
The FEC? Nope. As long as there was ANY other reason to pay the hush money (like protecting his wife and son), it's not a campaign expense.
The voters? Nope. Even if he'd used campaign funds, he wouldn't have had to disclose the expense until months AFTER the election.
Who's the victim here? Trump. He got extorted by Stormy and Avenatti. He paid $130k in exchange for an NDA. Then the people who took his money very publicly violated that agreement, and profited off that violation.
Who committed fraud here? Last I checked, if you take money in exchange for silence with the intent of violating that deal for hundreds of thousands of dollars, YOU are the fraud. But we're supposed to feel bad for Stormy? And Trump is the criminal?
Give me a break.

Deviating from points would be a surer indication of non-adherence to the truth, than sticking to them. I have a friend with bad TDS. Whenever I ask him what actual crimes Trump has committed (this guy insists Trump has committed a long list of crimes) and press him on the specifics, his argument always comes down to something like, "OK fine, so maybe Trump literally said X, but what he _really meant_ by that was Y." These people with TDS always seem to think they can read Trump's mind and that this mind-reading ability of theirs should constitute some kind of legal standard.
I think Democrats have a different mindset. Because they have such a long history of voter fraud, they're used to euphemistically using the term "find" to refer to practices such a creating fake votes in a smokey back room of some big city election office. Since Republicans don't have a history of voter fraud and therefore don't share the terminology, they just mean find something that's lost when they say find.

The charge isn’t paying a blackmailer. That’s legal. The charge is how Trump recorded it - as a business expense. If he had paid it via personal funds he wouldn’t be in legal trouble.
@Teddy McGillicuddy the issue is that it seems the district attorneys office can't actually prove he paid it out of business funds. They have Cohen saying he paid off the blackmailer. And we have payments from the Trump org to Cohen. Who was an attorney on retainer for them. It seems the payment amounts from Trump Org don't match the payment to the blackmailer. Couple this with Cohen's history of perjury and this case seems terribly weak.

There seems to be a growing consensus that it's no accident that these charges are so glaringly deficient. Bragg apparently could not find a way to back out of his campaign promise, but also knows it would be impossible based on the facts in evidence to get a conviction that wouldn't be vacated upon appeal. It appears that he's constructed a case that he's hoping will be dismissed before he would ever be required to attempt to prosecute it.
You can almost feel the air getting pulled from their lungs when he answers their questions.

Contrary to popular belief , he is actually not one of the top Constitutional lawyers in the USA . Just go and check the information in the top Legal publications that are available online. You will see names such as Erwin Chemerinsky, Neal Katyal. Laurence Tribe, Kathleen Sullivan, David Cole, Akhil Amar and others . To my knowledge none of them has said that AD is correct or that it is not constiutional or an abuse of the system. Now perhaps it is because they feel it shoud be left for due process or perhaps it is because none of them have just released a book where the premise is that Trump is a victim .

Dear PP, no he gave his legal opiniion which is what others have done but with different conclusions. This is why the USA has due process. I do note that he has often been wrong in past predictions on Network appearances including on the matters before the Court in the Mar Del Lago investigation. in addition, he had his own pesonal lawsuit against CNN dismissed by the Court without even getting to trial . He is a great legal mind but he is not infallible. Again this is why it is before the Court to decide.
@@robertriteman3227 You have far more trust and faith in the Legal system than I do. If Trump sees a Manhattan Jury he will very likely be convicted regardless of the strength of the case IMO I think that's a very real possibility and even Dershowitz admits this on his podcast.
I also watched his podcast and some of his other podcast. I note that I hav been e a trial lawyer and Appellate Counsel for 33 years so I am fairly well informed on the process . Now since you have watched the Podcast then you know he his main argument is that the case is not valid based on Constitutional law . He failed to tell the audience that is a matter that can be determined prior to Trial on a motion to the Court. If he is correct then the Case is dismissed and there will be no trial . It is not the only thing hat he omitted to tell the viewers of the podcast ( which I will address below). .Now I note that the fact that the electorate in Manhattan voted overwhelming for Joe Biden is not an indicia that a Jury cannot be selected that is capable of reaching a decision based on the facts established by the evidence and by the supporting legal arguments. To use the example of Alan Dershowitz he states that his condemning of the indictment is based on the integrity of the Justice system and that the public should accept that he does not support Trump and that he voted for Biden. Yet at the same time, he argues that Trump cannot get a fair trial because the electorate voted. against him . Accordingly he is not willing to give the citizens of Manhattan the same status as himself . What makes the citizens of Manhattan any less objective that you or myself just because many of them voted for Biden.!!!! I do note that it is convenient for those wanting a change of venue to omit in their arguments that the Trump defence team will have a significant number of “peremptory challenges “ to the Jury pool as well as “challenges for cause”. For Dershowtiz or any Legal talking head to not mention jury challenges is not present a fair and balanced picture . So go ask yourself why Dershowitz did not address that in his podcast or in his other appearances. Is it because he has a book that he had ready before even the Indictment was brought ? Is it because he was legal counsel for Trump in 2020 ? Is it because he was a legal consultant to the legal counsel for the GOP in Arizona in trying to challenge the election voting machines ? Now I do not say it is any of those but I say it is just as unfair to assert that a Jury in Manhattan is not going to follow the evidence and the Law because some of them voted for Biden.

Secondly, since he defended Trump in past, was an Epstein Island guest, and lied to keep a cold blooded murderer in OJ from prison. He is spinning as he always does. Dershowitz himself has proven to be unethical throughout his career….so saying Bragg did ethical violations so therefore Trumps crimes don’t hold weight, is preposterous.

Perhaps you missed that the Dems scored a big victory in Winsconsin the same day and in Michigan the next day. The cases will not get tossed. Due process will take place . Yes but that is the entire reason for proceeding is tht the system involves the Rule of Law . A Grand Jury heard evidence that persuaded them that there was a prima facie case that required an indictment . Keep in mind that Trump had legal counsel there to represent him and even had a witness of their own. Due process will take place and perhaps he will be found not guilty after all the evidence is heard or perhaps he will be convicted. To not have proceeded would have actually been more political as it would have been saying " DJT and his supporters are more important that the Rule of Law:". So this is part of the system which comes first.
And he shouldn’t be mistreated due to the hate people have for him. He’s constantly guilty since 2015 and has proved his innocence over n over which isn’t right president or not he should be treated fairly.
First, you need to inform yourself as what exactly a Grand Jury is and what it's role is in the legal system. So far Trump has been treated fairly as he had lawyers represent him at the Grand Jury, he was free to have witnesses appear on his behalf ( at least one did) , his lawyers got to examine the witnesses called by Bragg, and Trump had the right to give evidence himsself ( but chose not to give evidence). The Grand Jury had to decide if a prima face case and had been and vote to determine if an indictment should be issued. They did vote in that manner. He will continue to be treated fairly because there will be a Jury and his lawyers will again have the right to call witnesses and examine the Prosecution witnesses, and Trump will have another chance to give his own evidence. This is all part of the Rule of Law and Due Process. He may be found not guilty because at trial the test is not a prima facie case as the Prosecution will have the burden of proof on the basis of a reasoable doubt. Keep in mind that numerous people who the public considered to be guilty for a crime have been founnd not guilty ( example- OJ Simpson) . as if he is found guilty then it will be his choices and actions. Keep in mind that the Trump Organization and its CFO were convicted in December 2022 of Tax Fraud crimes . i note they did not appeal which means they effectively have admitted they were treated fairly. The fact that half the country may dislike or hate Trump will not be what convicts him as if he is convicted it will be because of his own conduct and actions. @@CelesteAnn

Trump’s campaign simply could’ve just paid a fine if that was the case. Obama’s 2008 campaign paid a $375k fine. Hillary’s 2016 campaign paid a $100k fine last year regarding the Steele dossier.
Clearly , you must be the designated loser in each fight because it was the not same issues nor the same jurisdicaiton . You need to inform yourself before you make a claim but then again that is likely why you do not use your real name as then there would be a record of your being wrong. In the end, due process will take place and perhaps he will be convicted , perhaps he will not . Perhaps Dershowitz will be correct in his position but if he has been wrong in his predictions before and his own personal case was thrown out by the Courts without even getting to trial. If this is not permitted under the Constituion then the Judge is the person who decides that issue. If that fails then he will face a Jury with the possible results of conviction, a hung jury, or an acquital .

Ah but over the past few years his arguments have failed in the Courts. In fact he personally sued CNN and the Court dismissed the case and did not let it go to trial . No offence but it is easy to be impressed if you are listening to someone like AD and it is not your field. Contrary to popular belief , he is actually not one of the top Constitutional lawyers in the USA . Just go and check the information in the top Legal publications that are available online. You will see names such as Erwin Chemerinsky, Neal Katyal. Laurence Tribe, Kathleen Sullivan, David Cole, Akhil Amar and others . To my knowledge none of them has said that AD is correct or that it is not constiutional or an abuse of the system. Now perhaps it is because they feel it shoud be left for due process or perhaps it is because none of them have just released a book where the premise is that Trump is a victim . @@Chimchimchu

The thing is when Trump was elected he literally said "Hillary has been through enough" and didn't pursue it. And she actually had serious issues with that server. So, I'm not ready to concede that both sides behave the same. What is probably true is that a true outsider on the Left would get treated like Trump by the exact same people doing it now.
