  • Last Tuesday, Metro Council passed a resolution to continue the city's involvement in the an equitable sharing program. The program allows Metro Police to keep the proceeds from assets seized from individuals suspected of criminal activity. But should Nashville be involved in Civil Asset Forfeiture? Ben Hall sits down with one of the sponsors of the resolution, Metro Councilwoman Tanaka Vercher of the 28th District, and Metro Police Captain Michael Alexander to discuss why this program is needed.

    They are still doing this. I was pulled out of my car by a Tennessee Highway Patrol for "following to close" (I was not...just had out of state plates) and asked questions like what I do for a living, how much I make, and if I had cash in my car....this was yesterday and the third time they have done this in the last 5 years...last time it was because "my tires touched the white line"...no ticket, did not even ask for my proof of insurance, just snooping for cash. Always in Tennessee.

    Dishonest explanation of civil asset forfeiture! In his examples he makes it sound like it requires a criminal case-it does NOT! That’s why it is called CIVIL asset seizure!!!! It CAN happen on an incident with a criminal arrest, but it does not HAVE to!!! Total BS!!!!

      The police officer talks about criminal asset forfeiture when the question was about civil asset forfeiture.

      @@whitsend11 no police can lie that your property house car money assets were involved in a crime even though you are innocent and claim what you own as legally theirs, they don't have to charge you with a crime just take whatever you have in siezure you bank account and clean out whatever money you even though you have proof it is yours

    It's funny you see a law enforcement officer like this supporting and talking about the program, and my first thought is wow I didn't know he was a criminal SOB.

    What about those times when the police "confiscate" a citizens money but DO NOT arrest or charge the citizen with a crime/violation or even write the citizen a ticket? Hmm?
    "This money we're taking from you could be used to buy drugs."...or it could be used to buy a car because the seller of the car made it clear to me that I have to show up with cash in hand or he is going to sell it to the next person with cash...or this cash could be spread all over the floor of my hotel room where I am going to get naked and cover myself in chocolate sauce then roll around all over my money. If you, the cop, believe that I am going to use my money to commit a crime AND you have more than a hunch or just following department protocols (e.g. PROOF, PHYSICAL EVIDENCE, SOMETHING TO HOLD UP IN COURT FOR THE JUDGE TO SEE), then you have to arrest me and charge me with a crime...if not, then what I intend to do with MY property is none of YOUR business! I might reduce all $50,000 to one dollar bills, make little paper airplanes with those dollars then shove them up my nose. Again, my property, none of your business. Am I under arrest? No? Then I, and MY PROPERTY are free to go."

    Personally, I think that these two are very suspicious and are involved in theft and money laundering themselves. We should seize their assets and make them go to court and prove that their personal assets are innocent and pay for the preceedings using their own time and resources just like we have to.

    The law enforcement officer here is talking about how there's always a rest, and prosecutions, before they take the property, okay then that's not civil asset forfeiture it's easy enough to do criminal forfeiture in that case. Civil asset forfeiture allows them to take it without any evidence, and no arrests or charges for a crime.

    i hope they are not doing this still, i plan on buying me a vehicle, and because of shit like this and the rip-offs by dealerships, i have to go to a private seller with cash. makes me mad ill have to tell the seller of a car, to go to their bank with me, just so i can get the cash money out of a atm and into a their hands so they can deposit it, and he can give me the keys and title at the bank.
    traveling with huge amounts of money, even if its small amounts of dollar bills, results in theft of property.
    and lets be real here, no chief is gonna organize training of officers in the new law, too much profit motive here.
