I've been writing songs for 50+ years. My advice to all songwriters is to copyright every song you create. Keep the demos and anything related to the creation of your songs . Don't let the crooks steal your work !!!
Every song is copyrighted the moment its put into a fixed format each in recording form, lyric form, etc. There is no registration or legal filing that has to be made. FIXED FORMAT being the key

That just enables one to bring suit. The copyright holder still has to sue the offender and have the financial resources to do it. The entire system has to change.
I just checked and Spotify removed Marico Charlotte I think. Actually, Old Capital Square Dance Club is now the first result when you search for Marico Charlotte (the rip off artist)! They did the right thing.
I don't think Spotify is really capitalizing on anything here. They lose money when paying a fake musician. They don't gain anything. It would be in their best interest to find ways to prevent this from happening.

This was a great chance to highlight a local bands work.. at the end of the story, saying their name again or giving links would have been “the right” thing to do. As a musician myself, I am definitely biased, but I think a lot of people in the comments seem to be missing the point. Regardless of what you think of the band's music, they got ripped off. It's clearly not about the money lost for them - everyone knows spotify pays jack. They seem like a bunch of good, honest fellas who just wanna spread their creation with the world. It's akin to a painting, story, or invention being passed off as someone else's when they had nothing to do with it. Makes me worry for the bands and artists around me. I understand that Rock and Roll was built on stealing or whatever, and that there's only so many notes on a fretboard or in the chromatic scale. However, this is blatant theft. Happy that these dudes came out about their story and that spotify seems to have resolved it.

In a way we already have that. Thats where the ISRC & ISWC codes come into play from your music distributor and Performance Rights Organization (as well as your copyright if registered with copyright.gov). In a court setting the main things a legal team will look for is who published the piece of music first via the ISRC / ISWC and the "Likeness" of the altered content. At the end of the day, assuming that the artist produced the piece of music themselves, the artist maintains the original recording copyright even if not registered to the other agency's listed previously.
this is actually a massive problem with specifically Spotify, because their business module is simply that they incentives labels and artists to upload more so Spotify can reap the benefits. So there's not only stolen songs, but fake songs and artists. Currently the big issue is AI images with the same song over 10,00 tracks and artists. Spotify does not invest in an outreach team as far as im aware of, artists submit music with little to no contact and the deal is done. You can image where and how this can be manipulated where there's not double checking when it comes to uploading to a fortune 500 company's public catalog for the whole world to see and pay a monthly fee alongside
I'd heard the fake band theories before AI, mainly about the ambient electro stuff where an "artist" would have tons of listens and placement in playlists but no information or presence anywhere else. Automatically generated slop is only gonna get worse and keep taking more money from real musicians.

I used to work for a big corporation that existed for the purpose of scamming bands and artists. These corporations are called "rmajor labels" and they've been doing it for a long time. I hear the small ones can be just as bad, unless it's called Dischord or some similar rarity.

I am an independent producer and artist myself as well as a degreed audio professional from Full Sail University. There are a few flaws with this covered story to note, streaming royalty rates as of right now are between $0.003-$0.005 per stream as set from the royalty courts. Also, Spotify's response is a generic response that can be found on their website FAQ's and was published well before the incident being covered. Although this still does not take away the bigger issue at hand as far as music being stolen from this group of artists, I feel most of us would appreciate a more accurate investigative story. The bigger music streaming platforms such as Spotify, Apple Music, and RUclips Music does do a pretty decent job of detecting altered content however these services are typically on a month to two month delay before issuing royalty payouts or DMCA takedowns.
I appreciate both of what you’re saying, but to me the best case scenario would be if the streaming landscape changed just a little for independent artists. I have a full time day job, so I’m not dependent fully on music
I wish they would crack down on all the people who illegally sample . I’m not talking about the people who sample properly I’m talking about the hacks that take a song and just add some reverb and a hi /lo pass and call it a sample without changing anything to the song.
I agree with your first point, but the degree to which we've normalized "proper" sampling as a valid choice ethically and creatively has laid the groundwork for all of this abuse. Many popular performers are just autotuned blathering over someone else's sampled backing track. We should never have accepted that. Low standards hurt all valid artists.
Spotify "free" streams at max 160 kbps & 320kbps for "Premium". Here's some info regarding audio resolution from Sony electronics website... "CDs resolution (1,411 kbps) is over 4 times higher than that of MP3s/Spotify (320 kbps).... the higher the bitrate, the more accurately the signal is measured. Bitrate has a direct impact on sound quality. When an original recording is compressed into an MP3 file, a lot of information is lost. A lower bitrate could translate to a softer bass response or weak-sounding drum cymbals, or it could blur the attack and decay of a plucked guitar string. A lot of the details that artists and mixing engineers work hard to put into a recording are diminished or disappear entirely in an MP3/Spotify file.

What is astonishing about this and important to note is that it is not just the song, but the recorded performance that is being stolen. This is different than someone re performing a song as passing it off in part, or entirely, as one's own material (eg., Jimmy Page claiming Jake Holmes' Dazed and Confused as his own). What's so bad about this is that the thief is stealing not only from the songwriter(s) but from every musician on the track and anyone involved in it's production.
Also when you search for Marico Charlotte it takes you to the old capital Spotify page. I would have to imagine that the KMOV story and inquiries had something to do with that.
What if there was a toa for submitting songs to Spotify that said “you agree that the submitted song(s) are your own, if it is not, a charge of 10x your revenue will be made every hour until the end of the year.”
It's copyright infringement. If I can't download a television episode or a movie without paying for it, then these people shouldn't be allowed to rip off musicians. Protect the artists.
gossh i've seen this happen to so many people, and seen so many stories about and examples of this. a few years ago, this same thing happened to Cary Huang's brother, and the process to get his music back was quite lengthy and painful.
Cheating, stealing, and lying seem to be the new norm in every form of entertainment. The internet moves so fast that the fake band likely made their money, will disappear, and steal from the next. When money is involved some people will go to any extreme to get it.

When you WRITE a song, your lyrics are IMMEDIATELY yours by law, and the melody is your IMMEDIATELY by law! These guys are unaware and are likely NOT on a P.R.O. (ASCAP, BMI, etc.) for all their streaming royalties. They also should do RUclips Content ID on all their tracks they upload, when using a Distributor, to RUclips. Stealing songs like that, is absolutely illegal and punishable by great fines in America. But if you don’t care to get on a PRO (performance rights organization) and Content ID your songs, and register your lyrics with the copywrite office, you’re susceptible to these scammers
It’s not even limited to music. I’ve had graphic design work stolen and sold by others on tee shirt websites. But, as was reported, I’d have to continuously file takedown notices with each and every website I find my designs on. It’s a huge issue.

It makes sense. Think of any song with less than a thousand listeners. Change the title and sound a bit, and nobody will be the wiser, the chances of one of those thousand catching it, or the artist, is slim to none. There's so much music its impossible to keep up with what is new, much less rehashed or just a ripoff.

25 years ago a lot of times we would go out and play a gig for like $100 each. Later, I went on the road, was fortunate enough to make a good living and have what they called a “ career”. However, after becoming burned out on that, and settling down, I see that lots of times people are still playing gigs for $100, just like in the late 90s. The difference between the 90s and now is, we used to be able to sell a lot of CDs at $15 each, Obviously this is a thing of the past and we rely on streaming services, that only pay fractions of pennies. then you have the progress of AI to contend with, along with the misuse of such in other countries, which allows this to happen. it’s kind of like those Robo calls for your car warranty. here we are, putting a man on the moon is old news and technology, but somehow things like stealing material from a honest band can’t be stopped? I have to call BS. theft is always a very violent and personal thing, but there is a difference in someone getting his or her wristwatch stolen, and getting his or her words stolen; stealing someone’s art, is identity theft on the most primal level, and should be stopped.
The problem is the service is reactive, so people will always get away with it. The best tools for those at the top but at the bottom everyone has no power. But we all chose this for convenience, so it’s a consequence we created.
This happened 80 yrs ago or so. Song catchers .. would travel many parts of try county to listen to others music and then go record it in Nashville or NYC or Chicago .. etc😊
Tidal, the highest paying streaming service pays $0.01284 per play. All other streaming services pay much less. This lady talking about 5 cents a play has zero clue what she is talking about.
I was in a band in the 90's where our "song writer" would go around town to see local bands, record their music and then pass it off as his own after a couple minor changes.... we found out when we were rehearsing at a studio and this dude popped in and started yelling at us about stealing his music. I thought he was nuts at first but turns out he was 100% correct. Stealing music is super common, this is nothing new, just a new way to do it.

as a full time musician this is horrifying that people are now scamming bands and artists... not cool at all
I used to work for a big corporation that existed for the purpose of scamming bands and artists. These corporations are called "rmajor labels" and they've been doing it for a long time. I hear the small ones can be just as bad, unless it's called Dischord or some similar rarity.

I am an independent producer and artist myself as well as a degreed audio professional from Full Sail University. There are a few flaws with this covered story to note, streaming royalty rates as of right now are between $0.003-$0.005 per stream as set from the royalty courts. Also, Spotify's response is a generic response that can be found on their website FAQ's and was published well before the incident being covered. Although this still does not take away the bigger issue at hand as far as music being stolen from this group of artists, I feel most of us would appreciate a more accurate investigative story. The bigger music streaming platforms such as Spotify, Apple Music, and RUclips Music does do a pretty decent job of detecting altered content however these services are typically on a month to two month delay before issuing royalty payouts or DMCA takedowns.
That is outright theft. Spotify needs to do everything in their power to mitigate this
They have no real motivation to because they’re making money at it. What needs to happen is a lawsuit with them as a co-defendant.
I appreciate both of what you’re saying, but to me the best case scenario would be if the streaming landscape changed just a little for independent artists. I have a full time day job, so I’m not dependent fully on music

I wish they would crack down on all the people who illegally sample . I’m not talking about the people who sample properly I’m talking about the hacks that take a song and just add some reverb and a hi /lo pass and call it a sample without changing anything to the song.
I agree with your first point, but the degree to which we've normalized "proper" sampling as a valid choice ethically and creatively has laid the groundwork for all of this abuse. Many popular performers are just autotuned blathering over someone else's sampled backing track. We should never have accepted that. Low standards hurt all valid artists.

the higher the bitrate, the more accurately the signal is measured.
Bitrate has a direct impact on sound quality. When an original recording is compressed into an MP3 file, a lot of information is lost. A lower bitrate could translate to a softer bass response or weak-sounding drum cymbals, or it could blur the attack and decay of a plucked guitar string.
A lot of the details that artists and mixing engineers work hard to put into a recording are diminished or disappear entirely in an MP3/Spotify file.
That is why analog will always be my top choice.

What is astonishing about this and important to note is that it is not just the song, but the recorded performance that is being stolen. This is different than someone re performing a song as passing it off in part, or entirely, as one's own material (eg., Jimmy Page claiming Jake Holmes' Dazed and Confused as his own). What's so bad about this is that the thief is stealing not only from the songwriter(s) but from every musician on the track and anyone involved in it's production.

What if there was a toa for submitting songs to Spotify that said “you agree that the submitted song(s) are your own, if it is not, a charge of 10x your revenue will be made every hour until the end of the year.”

gossh i've seen this happen to so many people, and seen so many stories about and examples of this. a few years ago, this same thing happened to Cary Huang's brother, and the process to get his music back was quite lengthy and painful.
This is great reporting. Small bands deserve to be heard for their songs and not need to be protected from bots. Good luck to the band.

Cheating, stealing, and lying seem to be the new norm in every form of entertainment. The internet moves so fast that the fake band likely made their money, will disappear, and steal from the next. When money is involved some people will go to any extreme to get it.

When you WRITE a song, your lyrics are IMMEDIATELY yours by law, and the melody is your IMMEDIATELY by law! These guys are unaware and are likely NOT on a P.R.O. (ASCAP, BMI, etc.) for all their streaming royalties. They also should do RUclips Content ID on all their tracks they upload, when using a Distributor, to RUclips. Stealing songs like that, is absolutely illegal and punishable by great fines in America. But if you don’t care to get on a PRO (performance rights organization) and Content ID your songs, and register your lyrics with the copywrite office, you’re susceptible to these scammers
I love that Spotify’s response was to let you know that if the streams are fake they care, but not if the music is stolen and the streams are real.
It’s not even limited to music. I’ve had graphic design work stolen and sold by others on tee shirt websites. But, as was reported, I’d have to continuously file takedown notices with each and every website I find my designs on. It’s a huge issue.

It makes sense. Think of any song with less than a thousand listeners. Change the title and sound a bit, and nobody will be the wiser, the chances of one of those thousand catching it, or the artist, is slim to none.
There's so much music its impossible to keep up with what is new, much less rehashed or just a ripoff.
The oddest thing about all this is that HOW IS THIS BAND NOT Popular in the main stream, they are amazing, so much better than the crap thats out from poular people. Dude writes amazing stuff!

25 years ago a lot of times we would go out and play a gig for like $100 each. Later, I went on the road, was fortunate enough to make a good living and have what they called a “ career”. However, after becoming burned out on that, and settling down, I see that lots of times people are still playing gigs for $100, just like in the late 90s. The difference between the 90s and now is, we used to be able to sell a lot of CDs at $15 each, Obviously this is a thing of the past and we rely on streaming services, that only pay fractions of pennies. then you have the progress of AI to contend with, along with the misuse of such in other countries, which allows this to happen. it’s kind of like those Robo calls for your car warranty. here we are, putting a man on the moon is old news and technology, but somehow things like stealing material from a honest band can’t be stopped? I have to call BS. theft is always a very violent and personal thing, but there is a difference in someone getting his or her wristwatch stolen, and getting his or her words stolen; stealing someone’s art, is identity theft on the most primal level, and should be stopped.

I was in a band in the 90's where our "song writer" would go around town to see local bands, record their music and then pass it off as his own after a couple minor changes.... we found out when we were rehearsing at a studio and this dude popped in and started yelling at us about stealing his music. I thought he was nuts at first but turns out he was 100% correct. Stealing music is super common, this is nothing new, just a new way to do it.
