      +Pippin Well, I do not see how words have anything to do with physical consequences. They are on a different level and it is very hard to control. Is her being fired without legal process the right amount of punishment.. can I just think of the right punishment for speech I don't like? No, of course not, the Justice system must figure these things out, and they have to follow the first amendment.
      A bit of a rambling comment, but it boils down to: The lady saying something about Warmbier hurts no one physically. Her being fired does hurt her and the people around her. It's disproportionate, and the Department of Justice would've ruled so if this had gone via the route it should have taken, the legal route.

      +Pippin A In principle I think that is wrong, yes. The security around the president is good enough to dismantle your plans if you actually tried. However I see that this is less practical than a ban, which also makes that less people make this threat.
      But you do see how this is an instance where an individual says he will resort to violence HIM/HERSELF. This is a special case, as it probably also would for the Department of Justice.

      I was just watching some stand up from Patton Oswalt and he was making that point about anti-gay people having only one actual complaint which is that they don't like the idea of it/what they imagine is going on.
      I think he did a great job explaining the crux of the problem and what's actually driving homophobic behavior vs what justifications are being used for it.
      I'm not sure how often I hear people use the bible to justify good things rather than to justify behavior they seem to know is totalled f-ed up. It seems like it's always an excuse for discrimination or some level of human rights being taken away. Or just as an excuse for why it's ok to be prejudiced. What a shame those people don't choose better parts of the bible to live by like one of the many things Jesus said about not being judgemental, being kind and just not being a total dick in general lol.
      It's sad religion is so often used to cause pain instead of to spread what immense value kindness has

      Because value system are often backed up by their mere existence, and the explanation for why it works is rarely needed if it works. If you have a value system, odds are you got it from observing other people passively, and they too got it the same way, you don't have to justify your values, even though you maybe should, you just have to act them out.
      And honestly who are you hurting by just refusing to serve gay weddings, it's not hard for them to just go to another shop. The whole thing is a service that the man offers, he can deny anyone for really any reason as long as it's his labour and his responsibility, you can't force him to change his values, because you can't force him to be anyone else than himself.

      What if the cake guy disapproves of someone's choice of mate because, say, she has buck teeth? Or because she's Jewish and he's Catholic? Or because they're Scientologists? Or because they're Middle-Eastern and probably Islamic? Are those things okay, too? What if he decided not to make cakes for people who were too old, on the grounds that he finds it "icky?"
      What if the intended bride dominates the cake-selection process, and isn't submissive enough to her man? That's even a biblical reason to be against them as a couple.
      Is it up to someone who provides a service to the public to pick and choose only certain people from that public he supposedly serves?

      They said that Trump supporters didnt recognize it as the Constitution, but I just saw somebody (some idiot?) saying that the posting of the Constitution was a subtle call for revolution by NPR. You can play "Fuck The Police" any day you like....but if you do it in public on the day of the Rodney King verdict, it may take on a different context to passersby and those within earshot. While Im sure that Jim Jeffries knows A TON about the nuances of the American founding documents, this MIGHT just be another "bash Trump and his supporters" show where some immigrant (Jefferies, Bee, Noah, Oliver, etc) is fed lines to read by coastal liberals. MIGHT.

      @yonderTheGreat The thing is, a business does not have the right to discriminate against protected classes which include race, gender, religion, age, political affiliation or sexual preference. They could have refused to make the cake for no reason, but they clearly pointed out that they were discriminating against gay people. I also believe that this was taken to court, and the baker was ordered to bake the cake.
      Refusing service to a Klan member or Nazi is perfectly legal, as they are not protected groups.

      Along the same lines, every atheist and open-minded Christian has read and analyzed the Bible thoroughly. Fundamentals rarely know anything about it except whatever quote taken out of context that supports a bigoted belief that they already held. Of course it's easier to canonize something that you've never read, because then you can never question it.

      @@andrewjohnson6716 back in my student politics days, we used to 'composite' motions that had been submitted to get them ready for debate; only rule was we had to use the words of the existing motions and amendments, but that meant we could completely change the meaning of a motion by careful editing. It's a bit like how some god-botherers treat the bible with their selective editing and taking everything out of context...

      Republican here. All the First Amendment says is that government cannot censor your speech, provided it's within the confines of the law. You are not protected from any public or private consequences of what you say. NFL players kneeling? No problem! Government can't do jack. Are they fair game to be shit on by fans for doing so? Yup. Are they fair game to be fired? Yup, they're private employees.
      Everything in the Bill of Rights is a restriction on government. And it's beautiful.

    The obvious answer if you're a baker (any baker, not just the bigoted idiots) is to draw up a list of the things you will put on a cake. Then post that and tell customers you don't do custom lettering; they have to pick something on the list. It should be an expansive list, including several nice wedding phrases, but no custom phrases and no names. That's what I would do, and I'd be happy to make a cake for a gay wedding. It keeps things simple; they always get complicated when customization enters the picture, no matter what you're making or selling.

    The thing people forget about the wedding cake thing is that it's a public business. That means that, no, you can't refuse service to anyone for any reason you please. There are specific cases that are protected by law: you can't refuse service on the basis of religion, race, sexual orientation, age (as long as they're over 18 or 21, depending on the nature of the business), and a few other categories. Refusing service for any reasons beyond that is fair game, however. Choice of employer and political affiliation, for example, aren't protected classes.
    It's the same reasoning behind saying that a business can't refuse service to black people.

    Second Amendment advocates always bring up responsibility. They are the ones who will verify that the right to own a gun comes with responsibility each time they reply with 'why should responsible gun owners be penalized because criminals irresponsibly use guns?'
    Well, how do you check responsibility? It is pretty much given then that irresponsibility must have consequences. The very word comes from return action. Consequences.
    So why is it that Congress has outlawed the tracking of gun sales. Almost all guns are manufactured legally. Yet somehow down the line they become 'illegal...' but only once they get deadly. In most cases, the owner purchased it still technically legally, but then used it either to commit suicide, or murder. And yet nobody is held responsible.
    If the government issues a license to drive to a known alcoholic, the clerk, the manager, the statesman who voted for the law will all be fired. With guns, no license needs to be issued, just a background check, and if that person commits murder, having been known as mentally unstable, or a domestic abuser, who is held responsible? Nobody! Sometimes not even the murderer because of the 'insanity' plea. Certainly none of the sellers.
    'Oh I'm sorry, my client didn't know that robbing a bank and shooting anyone in the way was wrong. He was insane. He only posted six or seven times about loving to shoot at people. If anything, that proves they are insane. Let them off the hook. And that means you should not discriminate against them for wanting to buy more guns. They need all the protection they can get!'

    I have made this exact point when arguing in comment sections of videos wherein other comedians are b*tching that their rights are being violated. They complain that PC culture is going too far, and point to examples when people have lost endorsement/book deals or shows. They bring up freedom of speech, but other than Jeffries, I don't think most comedians understand what it means. The freedom of speech pertains to the government, in that they cannot arrest or beat you for expressing yourself; it does not mean that you get to say whatever you want without consequence... the consequences are just social, not legal. The rest of us also have free speech, and if we don't like the way that you express yourself, we are free to express our dislike. We also have freedom of association, and can choose not to associate with you in any private way (including business dealings like endorsements, just not public services).
    For example, the KKK should have the right to express themselves by holding a rally. However, the rest of us also have the right to express ourselves by protesting the rally (having a counter-rally). If I see you being part of the KKK, I am free not to have you as my spokesman for my company, not shop at your store (boycott), not to invite you to be a member of my private club, and not have you over for dinner. Those are all examples of a social cost, as opposed to a legal cost, like having the police beat you or arrest you because of something you said (or a sign you were holding read). I think this is a reasonable balance. You get to say whatever you want without the government getting involved, but so do the rest of us. Unless you are a business open to the public, you also do not have to have business dealing with anyone. If you want to, you can also stop socializing with someone. All of this just seems to be other people expressing their rights, but when it happens to a comedian or pundit because of something they said, all of a sudden it is about their freedom of speech being infringed upon.
    Maher might be on the wrong side of this issue, but Jeffries isn't. Sure, I would agree that people are a bit too sensitive in my opinion, and that "trigger warnings" and "safe spaces" seem ridiculous to me, but that is others expressing their freedoms. I do not have to obey trigger warnings or go to safe spaces, so let others do what they want... it is kind of like how I view religion- as long as you don't force others to be involved, feel free to do whatever you want. If they were banning material rather than providing warnings about content, then I would have a problem; or if they wanted to make everywhere a "safe space", again I would have issues with that. To me, though they seem ridiculous, I can find parallels that already exist when it comes to religion- their safe spaces are called churches, and they demanded rating systems for TV and movies to advise parents who want to shield their kids. I also disregard those ratings and avoid those churches, so why wouldn't I do the same with trigger warnings and safe spaces?

      +Dangerous Joy How did you get that from what I wrote? I am for parental warnings and trigger warnings. I will disregard them, since I am an adult who may choose to do so, but I have no problem with the audience being warned so that they can avoid content that they won't like, or protect their kids. If anything, I like them because they also help me find what adult content I want- I am way more likely to go to a movie that is rated R than I am to watch a G or PG one. If a comedy show/movie has a warning that cancer, rape, AIDS, or domestic violence will be featured/discussed, I am more likely to see it, because I consider anyone who can make such dark subjects funny to be a master. For instance, Tig Nitaro made me laugh about her cancer, and Jim Jeffries and Louis CK both have great jokes involving rape. I love the talent it takes to find humor in horrible stuff, but if you had a love one die of cancer or had survived a rape, I of course have no problem with you being warned and avoiding their stand-up, or shielding you kids from such subjects. So long as you don't try to stop me from watching them, I have no problem with it. I actually appreciate them trying to inform their audience- some may use it to steer away from adult/dark subjects, but people like me will use them to find those adult/dark subjects. Seems like a win-win.

      +Daneelro Children are of course their parents responsibility, and that is where the forcing comes into play. A parent making their kids go to church or religious school is different than a religion forcing an adult, or even a kid, to attend. I may not like parents teaching their kids falsehoods, but that is their right. If the religion itself was that one forcing the kid, or adult, to take part, that is totally different, and that is where I would have a problem. I was forced to go to church and Catholic school, but the Catholic church didn't force me, my parents did. That was how they chose to raise me, and was their right. As an adult, I now no longer attend church; I am now going back to school, and have avoided religious schools. That is my choice, and so long as I am not forced to participate, I have no problem with others choosing to attend church or religious schools, or parents forcing their kids to do so.

    We had a similar cake baking case in the UK. A northern Irish gay couple wanted a wedding cake, the baker was happy to make it, BUT refused to ice a pro gay marriage slogan. Now it went through the courts who found in favour of the couple, but there is a great deal of unease about the decision being tyrannical. The baker was not discriminating by refusing service, only by refusing to ice a slogan he did not morally agree with. There’s been an appeal which was refused, but there is also a judicial review on the cards as the case could force a gay baker to ice a cake with anti homosexual biblical quotes, or a Jewish baker to ice SS runes.

    I am a RN and they had us sign a document in which it details subjects that are not allowed on our social media because my words may insulted a patient or family member of that patient. It is their company and they don’t want specific subjects or topics represented by their employees. It’s fine with me, if one day I choose to say something shitty, i still can, but I may not have a job in the morning.

    Wasn't the cake thing years ago? Shouldn't we just make a law specifically for such a scenario. The bakery got a lot of internet heat, that should be punishment enough. It's not like they have a monopoly on wedding cakes either.

      This small business did this and people bring it up years later. I read they moved out of the town and set up shop elsewhere under a different name.
      Chic-fil-la has opened two new spots in Columbus Ohio (not a large city). I doubt Chic is hurting that much long term.

I can only speak from my own experience but a lot of my gay friends were not at all happy with chic-fil-a and still joke about it from time to time. I dont go there myself, thats all i can control but i dont go out to eat at that sort of place anyway so i wouldnt call it much of a sacrifice.
      Someone having done something i dont like before doesnt make me okay with people doing it again. Who knows why this story has caught as much attention as it did? Maybe because chic-fil-a doesnt really have any way of knowing you're gay when you ask for tendies unless you are literally making out with your boyfriend in line, anything to do with marriage makes divulging that information necessary.
      I just don't see how this is really an example of inconsistency on the part of the LGBT+ individuals and allies if they are upset about it, if that is in fact what you are getting at. It doesn't sound like thats what you mean but just saying.

      Case by case basis, which is how legal matters are resolved in this country. For instance, the classic answer is you can't yell "fire" in a crowded theater. You can't use speech that directly endangers lives; you cannot legally encourage anyone to commit a crime. That slippery slope argument simply does not hold (just as it doesn't hold for any subject).

      uegvdczuVF I see your point, but if you open a business selling goods to the public, you should be willing to serve the public regardless of who they are or what they believe or how they conduct their personal life. You are there to provide a service to all who walk through your door. Now if you wish to open a private business that only caters to members only and people must pass muster under your rules, then fine. You can discriminate all you like. But to blatantly open your doors to the general public, you cannot discriminate just because you choose to do so. We as a nation already went through this with the Civil Rights Act where public businesses wanted to discriminate against blacks and refuse them service. Same thing.

    Hate speech doesn’t legally exist, it is simply speech which you find offensive. What constitutes as offensive differs from person to person, and therefore cannot be defined. It’s dangerous to punish people for a crime which cannot be objectively defined.

    Some of these arguments presented have been done to death and the free speech arguements always wins. Red skins thing, they surveyed thousands of native Americans, the vast majority don't care, I think the Native American community has more to think about that a fucjing sports franchise's name. The gay wedding cake thing, well I don't want to force anyone to do anything they don't want to do. I don't agree with them, and people who hold these views will see less business as a result. So I don't care, you're free to think and say what you want, doesn't mean people will listen or respect you, free speech is completely free, stop trying to peg it back

      About the cake shop, it's a shop, a public shop. so this meams if a gay couple wants a cake, legally he is obligated to make the cake as a shop keeper, now if it was just some random dude walking in the street then yea he can say no to baking a cake for random people

    Freedom of speech is part of all democracies and not unique to the US (even if 'muricans believe so..). ALL democratic countries share that part in their constitutions.
    Now, since it's part of the democratic process, it also implies that YOU CAN'T FUCKING USE IT FOR NON-DEMOCRATIC PURPOSES! If you want to be part of democracy, you'll have to follow the rules. It's that simple. So, no, freedom of speech doesn't mean you can go on a racist rampage and claim you have the right to do so. Racism is against the law in any democratic country worth the name of it.

      These are not compatible statements. Freedom if Speech includes the freedom to be racist. If you ACT on that racism through hate crimes or discrimination in housing or hiring you can be punished for your ACTIONS, but not for your speech.

      The United States is NOT a democracy, and it's not supposed to be. We are a federal Constitutional republic. A pure democracy is mob rule, where the majority can simply vote away the rights of the minority.

      Absolutely, all speech has a consequence. I'm talking about government censorship of speech. Any employer can fire you or refuse to hire you for what you say, schools can expel you for saying anything, and a business can refuse service to you. That's 100% fair game. The idea behind freedom of speech is that it protects all speech (with the exception of egregious illegal actions) from government censorship, even unpopular speech that could be considered offensive, distasteful, etc. The problem with hate speech laws is that there is no hard-line concrete standard across the board, and you would have to turn to government to regulate speech. That is the antithesis of America's founding. If I found a business that refused to serve Asians, I would gladly take my business elsewhere, spread the word of the policy, and let the discriminatory business fail. We believe that once the government has the power to censor speech from one end of the spectrum, then you have given it the ability to censor everyone. There is no such thing as a right to not be offended, as absolutely anything can be deemed offensive, and the lines become arbitrary. Simply put: We have the right to hoot, holler, and swing our fists as much as we want, but that right ends at the tip of another person's nose.

    The wedding shop owner has every right to refuse service and run the business as they see fit. Just because you exist does not mean you are entitled to be served. If they truly believe it is against their religion to be gay they have a right to refuse service to their potential customers hedonistic lifestyles.
    Freedom of speech, press, RELIGION, petition, and assemble are guaranteed rights in America - and forcing the owner to go against their religion is infringing on their rights.
    If anything the customer should find someone else - that is the great thing about capitalism - competition.

      Nick Voncloft Your rights end where someone else’s begins. Freedom of religions means you can believe in whatever you want. It doesn’t mean you can break laws or violate someone’s rights. I can believe I should kill people for religious reasons, but I would still go to jail for killing someone. You have the right to believe whatever you want. You do not have the right to force your beliefs on other people or discriminate against them. Also, the religion says nothing about not being gay. So, it’s not really following religion to discriminate against gay people, especially since the religion says to treat everyone equally and with respect.

      No, he does not. Business owners are not free to refuse service to anyone they like. There are laws against discrimination in this country and businesses have to follow them. Don't like it? Go spend a year in an actual theocracy and see what life is like. Otherwise, you'll just have to put up with that pesky Bill of Rights. Frustrating, I know.

      There's a big difference between "I believe this thing and though you don't, you have to respect that", and "you are this thing, and I believe that, in an ideal world, what you are shouldn't exist, but you have to respect that". You can have opinions and beliefs, but when your beliefs are founded on cruelty towards others -- infringing on the rights of other people -- that's the line. If you want freedom of speech, it's your responsibility to know the difference. I'm just letting you know, because I don't think you do.

      Jason Montgomery Um what's your point? In this scenario the atheist group is at fault, since the your disbelief at god shouldn't be affecting your professional career. And it's the same other way around.
      Believing in something doesn't give you the right to not do your job without factual reasonings. Gay people are born that way and that baker isn't born with a bible. He serves hetero black, asian, Hispanic etc. couples and he even made weeding cakes for fucking dogs, so yup he's discriminating. Last time I checked you can happily be a dick but please in your own time while not effecting others.
