    well you do need a lawyer. why? because Texas labor code 214.004 is not enforced by the state of Texas, thereby giving employers free reign to fire any employee they want to for misconduct iany time they want to...without the consequences of violating law to go with it.
    who am i? well i've always been too smart for my britches.and investigated the matter on my own because law enforcement would not help me. including the travis county d,.a. they claimed no law was violated. without even considering the evidence i had accumulated as a guide.
    because i was fired for misconduct twice in the same month (automatic disqualification for UI benefits), and actually received my UI benefits both times because the employers could not prove out the misconduct. for me it was too much. i had to investigate the matter even though no one would help me. what happened to me, i believe, has raised the value of this case exponentially.
    Texas Labor Code 214.004 was enacted to prevent employers from MISREPRESENTING the reason for termination to deny UI benefits illegally. FRAUD!!!!!!
    the criminal model is the supervisor submits fraudulent paperwork to fire an employee after demonizing the employee toi upper management.behind his back. defames his character. the employee is complaining the supervisor is lying violating company policy. .the employer backs the supervisor and approves the termination. the employee knows that its fraud and requests the UI benefits.
    at ui benefits determination time, the employer cannot prove out the misconduct. the employee receives the UI benefits. that's it. TWC is done.
    but not so fast, TWC doesn't refer the Employer for prosecution for providing false information to deny UI benefits illegally, like it does to employees who obtain those same UI benefits illegally.
    THIS IS A 14TH AMENDMENT VIOLATION OF THE EQUAL PROTECTION CLAUSE. .
    Using Open records requests to TWC, i requested the count of employees fired for misconduct yet received ui benefits for YEARS 2016, 2017, 20128, 2019, 2020. those counts TOTALED OVER 600,000 EMPLOYEES.
    the count of employees fired for misconduct fraudulently, YET obtained them IN 2020 ALONE, was 248,000 employees.
    the count of employees fired for misconduct fraudulently, BUT DID NOT GET THEIR UI BENEFITS, is one i do not know how to obtain in a reasonable manner.
    TWC refused to provide the counts for years 2021 ,2022, and 2023 without a charge of $600.00 whereas the counts were provided to me free of charge before. now they knew what i was doing with those numbers. and were attempting to discourage me.
    but since the state of texas will not hold employers accountable for violating that labor code, those numbers for 2021,2022, and 2023 are higher than 2020.
    I REQUESTED THE STATISTICS ON TEXS LABOR CODE 214.004, AND WAS TOLD THERE ARE NONE. THAT LABOR CODE HAS NEVER BEEN ENFORCED AND EMPLOYERS ARE FIGURING IT OUT. IT WAS ENACTED 30 YEARS AGO!!! 1993..

    this is a high value case. and because of the actions taken against me for my attempts to rectify the matter, i got a story that will beat that hot cheetos movie by far,
    When you watch the video, the feeling you should experience at the end will make you sick when you the entire state of texas is suffering. i don't want to spoil it for you. but i need representation in this matter. ASAP i don't know how to value a case. but my gut feel is its the millions.
    there are very few opportunities the Lord brings us as his servants.. Then you must have the courage, the intellect, and the heart to act upon them to meet the Lords needs. For me, it was.... if not me then who???
    being a marine helps me a lot. i was 60 years old when i started this investigation. next month i will be 64.
