    You'd have to think that after a lawyer tries something like that, the judge will never trust anything he says again.

      The whole schlameel smells fishy..
      No signatures
      Chase calls in the loan even though the defendants have been faithful to escrow....why?
      No taxes being paid from escrow?
      This couple is being shafted from multiple directions from the sounds of things...predatory lenders?

    His wife owns the title company? Ha - someone needs to look into her business real quick! Get her license revoked for her shady business practices if it turns out to be true, of course.

    Attorney came in without the property tax bill or insurance invoices. Did he think he could just say "we're a multibillion dollar bank, give us the escrow now." ?

      That argument is based off of the claim that the plaintiff is carrying all the costs and burden.
      The defendants are paying monthly into the escrow they are handing over their money as well.

      Plaintiff’s attorney wants to be paid. That escrow money would have been a nice chunk of change. The attorney even admitted that the escrow money would cover costs of the property and “other expenses”. The attorney was the other expense.

      The reference to tax and insurance was just clutching at straws when the judge didn't seem inclined to grant the request. It was never a strong argument. "We shouldn't have to wait while they drag this through the appeal courts to get our money" is not an unreasonable argument and might have been enough. The judge wasn't convinced, though, so he started adding additional arguments. The additional arguments you didn't lead with are always going to be fairly weak.

    We all need a Judge Simpson in our lives. I always feel better after watching him calmly pull pieces apart, figure out the puzzle, put them back together properly, be gentle and compassionate when called for, and thunderously righteous while dispensing judgment when called for. And his sense of humor is always so welcome. What a fabulous human being! I just wish there were more Judge Simpsons in this world, but am certainly grateful for this one and the role model he is. 💜

    Slick attorney. They figured if they get the money, then they're in control, the defense will then have the burden. Snake lawyers will do and say anything to win. Ethical, nooo

    The plaintiff’s attorney wants payment for his services. Otherwise he should know that until the case is closed no money should be released from escrow. Pretty sly of the plaintiff!

    I have no idea what the plaintiff is saying,but I completely agree with the judge, the question I have is why the defendants aren’t living in the house

      the defendants are well off and fell on hard times. this is over a family farm or something it appears. they seem to have multiple properties and took a mortage loan out on this one to float them

      @1504What I heard the defendant say was that they family built the house in cash so no mortgage. One of their sons had to have multiple heart surgeries so they took out a mortgage on the house to pay for the medical bills. Their bank was WaMu but Chase bought them and he said Chase were selling those lendees' properties with no reason/explanation/notification. They met this Tutu dude (plaintiff) who said he'd help them get it back or made up an agreement towards the title of the house/property but he never showed up when he was supposed to to sign the agreement and the plaintiff's wife is the company that has the title.
      They were basically swindled and have been trying to get it back.

      There are a lot of channels like this now, the ones that are going to win long term will create playlists so we can come back and follow the cases until the end as they are updated.

    There are several moments when the plaintiff's atty trashed his own argument (at least in the visible eyes of Judge Simpson), but my favorite was when he said that his client needs the money for "other purposes" ... as in: purposes unrelated to the property in question. Yeah, that's definitely how this works.
    With that said, claiming that property tax in that area is around $1000 per acre per year (with 30 acres x 4 years getting us to $115k) was, as demonstrated by the judge, laughable. Pull some numbers out of your butt ... go home with your tail between your legs.

    What this attorney doesn't seem to understand is that the money in escrow will be used to cover any and all costs after litigation is complete. They're paying on a property they're not even able to live in. Want to prevent vandalism guy? Let the home's residents move back in and maintain the property.

    If, and i mean IF, the costs of carrying the loan are higher than the amount of money the defendants are paying each month, plaintiffs' attorney should have been prepared to prove that, not just allege it.

      Last time in Judge Simmons court, he lied about being out of state and then tried to act confused when the other lawyer pointed his lie out.

    If the plaintiff is paying the property tax I can see the court disbursing the money upon receiving documentation in the interests of fairness. But outside of that there’s no reason to disturb the status quo pending the appeal.
