  • Lecture video about the case Securities & Exchange Commission v. Chenery, 332 U.S. 194 (1947)(Chenery II), which addressed agency Discretion to Use Adjudication Rather than Rulemaking. This is for both my Administrative Law class and my Statutory Interpretation & Regulation (Leg-Reg) class. NOTE this video actually explains BOTH Chenery I & Chenery II (the case went to the Supreme Court twice, but only Chenery II is in the casebooks in my courses). Understanding the basics of Chenery I makes it much easier to grasp the import of Chenery II.
