    Outside of a standard lease agreement there is no definition of tenant in Alabama. What we would do is ask the question "do they live here?" Most answer that question honestly because they don't know the implications.of that answer. If your buddy comes and stays for a couple nights then one will not answer that way. They will say "he just stayed here a couple nights". Most issues we see is where someone has tried to help someone and they are tired of it and want them gone. They let them stay 6 months and then think since they don't own, pay rent or names on the lease then they can make them get out anytime. The new squatter law has now made it even more problematic.

      Here is CA, and we try to determine if the person is a considered a gratuitous guest. If so, then they are out. The DA came in and provided us with some insight on what to ask/look for to determine this. Is the guest paying for anything (food, utilities, toiletries, etc), some quid pro quo agreed upon, does it appear the guest lives there (clothes in drawers or are they in a suitcase in the corner of the house, do they have personal property throughout the house or have their own room, etc.
      The DA said if it's not obviously a gratuitous guest situation, then tell them to go to the courts and evict so that the liability is on the courts and not us.
