    I have an issue with suppressing anything in plain view being tossed at a murder scene when an officer has exigent circumstance. Train the officers to take photos as soon as they are sure they are out of danger. I often don’t side with law enforcement but with absolute proof of murder they should be given allot of leeway to gather evidence in plain view.

    If your in the place with lawful and legitimate purpose, responding to an active crime scene seems to fit the bill here, than taking pics, without otherwise disturbing stuff seem kosher. I assume those dept's with bodycams are taking 20-60 pics per second anyways. Adding other people sans warrant unless you can dictate some sort of exigency , such this blood is running down the drain we need to do X to protect the evidence, etc, does seem to muddy the waters a bit. Still think you'd probably be ok if it was the CSI just taking pics in areas you could otherwise be anyways. Then your just dealing with training issues. I think documenting otherwise plain view evidence as quickly as possible would be valid.

      As long as CSI is not taking pictures of anything not originally in “plain view” then everything should be fine. But if there was something viewed not seen originally, then it’s a search and that may have negative consequences.

      @@BluetoGold Yup I can agree with that. If the officer was there and looking, but not moving stuff around, then the camera is just documenting, with objective precision, what was seen.

    This his graft and cutting corners begins...subtle, harmless, and well meaning but still accepting special treatment because of who knows who. There goes your credibility out the window. Compromised. You are for sale.Worst of all you don't recognize it or you don't cate, or both. Judges like anything that covers their asses first, legalities take a distant second.
