- My thoughts on the Boston Marathon bombing and the house searches in Watertown. All I'm asking is to respect people's constitutional rights. Everyone has the right to privacy and the right to a fair trial. Innocent until proven guilty is how it's suppose to work.
My thoughts are with the families that were affected by the tragedy. So sad.

Well said. I'm from Boston. Lived in that neighborhood. I'm sickened by our reaction on every level. When I see a boston strong bumper sticker I want to puke.
I don't like to subscribe to too many youtube pages, and though I've enjoyed many of your videos in the past, something held me back from subscribing. I now know what it was. A severe lack of awesome dinosaur shirts in your videos. You remedied that problem in this video, which prompted my immediate subscription. Bravo, and I hope to see that sweet shirt in more vids. Great points. I too, am disgusted with people who say the government should be allowed to just go through and search door to door pulling people out of their houses without a search warrant.
I'd like to see Julie Borowski and Michelle Bachman square off in a presidential debate.
Correction, I'm not sure about everywhere else but in Texas where I live there is no law requiring background checks or a permit to own guns or any regulation at all except to carry it on your person outside your home and vehicle (concealed carry permit).
I love the way you talk about these issues. I often worry that people get turned off of libertarian views due to the information overload. Thank you!

I've leaned not to argue with 'crazies' who haven't done anything in their lives and are dependent ON this system for everything they eat and drive and use and live-in every day ... so bye bye crazy ...

I was thinking the same thing!!! I have an alarm in my house and if any doors or windows are opened while it is armed, it will make a very loud sound. So, when they come knocking at my door, I would simply open the door, go out, close it behind me and tell them that he is not inside my house and there is no need to search but if they insisted, they are free to obtain a warrant and come back to search if they feel inclined to do so. End of story.
I hate to think what a cop hyped on adrenaline would do if, while illegally searching a house, encountered an armed homeowner? I hadn't heard of the door to door searches...
It's also amazing how these two guys with no military experience managed to shut down the entire city of Boston and avoid detection with 25,000 LEO's pursuing them. Only reason they caught the younger brother was a vigilant citizen who saw where he was hiding. Now imagine a small group of professional soldiers had done this. The ensuring chaos would be unimaginable.

Good to know, there are still people with some sense in them. I read an interesting comment in the news lately. It was called something like "we react to the word terrorism like Pavlov's dogs" (Pavlov made experiments with dogs, teaching them conditioned reflexes). And the author compared the terrorist attacks in 1996 in Atlanta during Olympics (which far more significant than a marathon in Boston) and the current one in boston. Civil liberties are about more than something as mundane as privacy (though I still like my privacy). They are about protecting the people (including criminals) from the federal government, our founders made the bill of rights to protect people such as themselves (rebels/smugglers) from the government because they realized that eventually the government would become oppressive and individual people would require recourse outside the law.
Whenever you talk about civil liberties remember that it is always a struggle of liberty vs tyranny (which is only possible through government), that is why the Bill of Rights was written to give individuals rights AGAINST the federal government.
Also remember that if you are ever willing to compromise certain rights (like the 2nd amendment for example) for the interest of "public safety", someone else may be just as willing to suspend your 4th or 5th amendment rights (or god forbid 1st) for "public safety".

The point of a trial by jury is to ascertain if a person is guilty or not. But once they are convicted, then they are relinquished of certain rights depending on the crime.

Well said girl. I also disagree with some lawmakers calling for the suspect to be declared an "enemy combatant" and therefore judged by military tribunal. He's an American citizen and all of his rights as such should be protected. Try him in federal court and let the evidence speak for itself.
in a VERY recent conversation with an indiviual that LIVES in Boston, I was saying the SAME THING.. this individual was insulting and belittling me for speaking against the police in Boston for going door to door, she said 99% of the house to house searches were consentual, I'd NEVER let the police in my house without a warrant, the police are not your friends and 99.9999% of th time they show up it's not to help you

I've been saying the same thing to so many people. The rule of law isn't just something to do when it's convenient. Every citizen has the constitutional right to a fair trial. People just can't get that through their heads.

Okay, now I have to ask: How would you have handled the search for the bandit? What would the cops have done if I refused a search w/o a warrant? How do we balance the 4th Amend. with needs to stop a crazed bomber? :)

How does allowing them to search your house help to catch this dude?
Takes about 15 minutes at best to get a search warrant. Now multiply that by 200 or so.
I don't understand why anybody would want to put that kind of roadblock in front of the police. They're after a guy that has killed 4 people, blown the legs off 10 others, injured many more and was just throwing explosives at them.
These are circumstances where the perpetrator has to be apprehended asap and that's why there are provisions in the law that allow them to do that without warrants.

One clarification though, officials were not invading peoples' homes by force. They politely asked homeowners if they could search the premises. I know this because of some friends who live in Watertown. He refused them entry and they were on their way.
Dear Julie, I'm not sure they showed restraint when arresting the surviving suspect. The resident who reported his position noted that he was lying in a pool of blood, meaning he was already injured.
After some movement of the tarp, police poured a large volume of gunfire onto the boat, stopping only when the SUperintendent called for a ceasefire.
Upon arrest it was noted he was unarmed

I consider myself a conservative and I definitely agree with everything you've said. In fact, it's what I've been preaching on facebook the last couple days. Thanks for putting up the good opinions!
For the most part I agree. however, these searches were not as you say "medicine cabinet", "drawers", "Google searches" etc. They were searches conducted only in areas of a home where a human could physically hide. Rooms, under beds, closets, and they were quick searches because of how dense the area is. When a terror suspect is in the area and there's a locked perimeter, these searches seem reasonable to me. Hell, he could've been in someone's basement without the homeowner's knowledge.

The Supreme Court has upheld the Public Safety Exception to Miranda rights. The suspect isn't being questioned for prosecuting information, but to provide information leading to the immediate protection of the public good (like finding set bombs that could be stopped before they explode). Any information used for the public exception can't usually be used in court for prosecution. See New York vs. Quarles.

Being read Miranda or not does not change your rights. He has them ether way. In this case though, the feds think getting him to talk is key an are willing to have his statements thrown out or court because the info is more important now than it will be in his trial... I have big issues with a lot that happened in that town over the last few days but Miranda is not one of them. Now if later a judge lets his statements be used in court, then it becomes an big issue...

I've heard both. Some say they forced themselves in. Some say they asked and left if the person said no. So I don't know. Just disturbing the number of people online who think that it's no problem for police to search houses without permission.
Broadcasting my internet browsing history versus checking my house to see if a known terrorist is hiding there are two totally different things. The exigent circumstance allowing for the search are more than justified for such action.

Okay, I was mad at you for an earlier post. When you stated that you were glad police showed restraint it rubbed me the wrong way. Contrary to popular opinion, we constantly show restraint. We are trained to show restraint. But I would like to go home at the end of the day. So if I am dealing with a life threatening situation (like a suspected killer) I might be a little more cautious. As far as the house searches, I always ask for consent before I search anyones person or property. Good video!
The reason for a right to a trial by jury is due process. This is to ascertain whether or not said person commit a crime and to ascertain what the penalty should be. It is done by a jury of our peers so that government has a much harder time making an accusation mean a conviction. The right to life is not given by anyone save the creator. Now, when you have decided to depend on someone else for your survival you surrender your rights to keep it private.
