    OpenAI accepting tens of millions in public funding under the pretence that they would be open sourced and not for profit, then backstabbing everyone by doing the exact opposite, shouldn't be legal in any way.

      Once OPENAI is open-sourced, the biggest beneficiary would be China, they will steal all the hard work and create more dystopian AI. Just like when Elon open-sourced his technology in exchange for entering the Chinese market without a joint venture from the CCP in 2014, many Chinese electric car brands suddenly appeared in 2015 with the tech from Tesla and now Chinese EVs are flooding the market backed by CCP's massive subsidies, and use unfair trading practices to crowd out genuine car brands around the globe. Open source would mean CCP win again with no effort. In the hands of the CCP, it would be worse than allowing AI tech in the hands of the Western world.

      I'm very split. On one hand I don't want a small number of people like him in control of AGI, on the other hand open sourcing AGI would be like handing out nukes to everyone. I mean what could go wrong.

    The “open” in open AI was for “OpenSource” AI. When the bord decided to make it exclusionary and for profit and open to everyone after Elon left is what this case is about. Elon doesn’t want Microsoft or google to patten or withhold it. One case for this is, if one source gets AI, they can manipulate the stock market and social media to their benefit faster and more intricate than a normal human can comprehend. If everyone has it it’s at least a level playing field.

    The core legal issue wasn't addressed. That is, Musk invested $44 million because of OpenAI's founding document that stated that all work was going to be open-sourced and non-profit. The question is, what legal status does the founding document of OpenAI have in court? Can it be legally interpreted as the equivalent of a contract and, therefore, OpenAI can be sued.
    The next legal question that wasn't addressed: what restitution does Musk want? With any other plaintiff, it would be the initial investment return along with damages. But, Musk may want something more that has him have a say on future projects at OpenAI. That is, what they work on.

    Elon did not only invest 44 million, he also didn't launch his own AI company because of his investment. Sam really screwed Elon.

      The other side of the story is, Elon attempted a coup to take full control of OpenAi but failed. Then in a fit of anger, left the Board of OpenAI and started his own xAI. Now he is suing to get his initial investment money back and force OpenAI to share their technology which will benefit xAI. This is the real intent of this lawsuit.

    It was a long time coming. I think the integrity and fundraising of all nonprofits is at stake here. What if Mozilla or the EFF could become trillion dollar companies while doing the opposite of their written mission, which they fundraised on? How would future donors feel? It would be better for them to fund a PBC and try to influence it through their ownership.

    There are federal, rather tangential, though important, public interest issues . One obvious that the web data is being sort through multiple times using enormous energy, and power,. Should something as transformational be monopolize, but the same couple of companies extending their existing, enormous power, and further stretching the limits away from their original core products either something is a nonprofit, or it is not. I don't believe there is a middle decision here. Either an inductive decision, or decision against the plaintiff...

    OpenAI needs to be checked. Their work is essentially good but they need to watch who ends up using potential AGIs. Its one thing to want AI to be democratically empower humanity, it's another thing when Russia and China start using to commit more crimes against humanity.

    If Elon had a problem with Microsoft he should have raised the issue back in 2019 at the time when Microsoft invested in it. Sounds like there is a problem with the statute of limitations.

      Why do the VAST majority of his employees NOT want to join any of the Unions that keep trying to unionize his shops. Their pay and conditions of work are already better than the union can offer. I would easily say I've heard more positive experiences working for Tesla than negative. Is it a hard job, and expectations are high...sure. However the reward is also very high, with many low level production employees becoming incredibly wealthy...not just the C-suite Guys.
