In some states you have to stay in the house (ie during a divorce) otherwise you loose your legal rights in a settlement. Not sure about Cali but, she should NOT move out because Tom could delay the sale of the home and drag out this issues for YEARS. this happens all the time in divorce> She is doing the right thing by staying in the house and now suing him to sell the house.

It went from 2.07 to 2.83 which would be a nice amount to have but they still have a joint mortgage and Ariana allowed Tom to refinance the house to take out a home equity loan to fund Schwartz and Sandy’s so getting half of what the house is worth doesnt help the fact that she will still owe a lot of money on the home. She messed up big time buying a house with him.

Where I'm from the parter has the right to give an offer and the first right to buy the house. If there isn't an agreement to sell the house to the partner or to a third-party than one side can go to court and demand the celling of the house.
