    Before our country even impose death penalty, we need to make sure first that our judicial system is just, fair, reliable, and not inclined to favor the rich and the powerful which we all know is not the case.

    Many states in the USA still have the death penalty. It doesn't really stop people from committing crimes. No laws or punishments can really do that. Even when there were public hangings, people still committed crimes.
    Lowering crime rates has less to do with punishment and more to do with access to education, jobs, food, housing, and mental health treatment.

    • @mimsydreams
      @mimsydreams 6 лет назад +22

      I grew up poor, yet still better off than some around me. You learn from an early age what motivates people to commit crimes; Most of the time it's driven by not having options for employment or thinking there's nothing else out there for you.
      For example; To a kid whose parents have dead-end jobs that pay minimum wage, and access to food is always an insecurity, selling drugs seems like an easy way to help mom and dad out and put food on the table. That kid isn't really thinking about the consequences or about going to jail; He's thinking he's helping his family and maybe will have access to brand name clothes and shoes so he can finally fit in with his friends.
      But another kid that has access to after-school programs and summer job programs, he's not thinking about selling drugs. He already has options to help his family and mentors who help him think about the future (college, career, etc) instead of the here and now.

      @stuka80 6 лет назад +30

      Punishment for crimes is not to prevent crime, its main purpose is to punish the offender for the benefit of the victim. Whether that is justice or revenge is subjective. But lets not pretend that in society, people who are found guilty of heinous crimes are sentenced to life in prison for some sort of higher ethics or virtue like crime prevention or justice. It is for the benefit of the rest of society and more specifically for the victim and their family. Serial killers, rapists, etc are beyond saving and all they'll do is rot in prison at the cost of the rest of the law abiding citizens who have to pay to have those prisoners housed and fed. Better to kill them and be done with it.

      If the recitivism rate of a certain crime is high, how would death penalty in such a case *not* decrease crime. That people wouldnt commit crime due to the presence of death penalty is a strawman.

    • @mimsydreams
      @mimsydreams 6 лет назад +3

      Most criminals that re-commit are doing so with crimes that are never punished by death; Theft, selling or taking drugs, etc. And unless they are a serial killer, most murderers don't keep murdering. It's usually a one time thing; trying to get rid of an ex, rage killing, etc.

    As a Filipino, I disagree with the reimposition of the death penalty because it fails to consider its irreversible nature and that human justice is susceptible to human failure. Even in a developed justice system, judges might have a wrongful evaluation, and innocent people can be executed. What more in a flawed justice system? Regarding the use of illegal drugs, the government should see this problem as a severe health issue rather than a criminal one and thus establish more rehabilitation centers and facilities to treat the drug users. Then to reduce crime, the government should focus more on addressing the evident causes of criminality in the country, such as poverty and social injustice, instead of enabling inhumane punishment to instill fear in criminals, which is proven to be ineffective.

      As a Filipino as well, I agree with reimposition of death penalty. Countries with death penalty still can't eradicate crime completely and what say a country with very lax law on serious crime, it will be a crime paradise. Death penalty is only imposed on criminals that did very serious crime, with lax laws criminals wouldn't think twice in commiting crime because it's so easy to get away with. If you're a victim say, your close relative (Mom, sister, daughter) was raped and murdered, and you can just let the criminal just get away with few years jail time? I still believe in the justice system of an eye for an eye. I firmly believe those people with such a big heart & compassion to criminals haven't been a victim yet, once an unfortunate incident befall them, they will confirm think otherwise. Too often they think for the criminals, but what about the victims? Don't the victims deserve justice?

    Growing up in America, being full Filipino and growing up in the states. I feel like the death penalty should only apply to those that has committed a high crime, like killing somebody or killing multiple people that has gotten away with it, that’s been caught finally. The death penalty should not be applied to those that kidnap anybody nor to those that did drugs, unless it’s a high drug bust like meth or any of those high class drugs. for example, marijuana in the states is slowly becoming legal to many of the states here in the United States & drug charges are lifted if it’s just weed (marijuana). So that being said, the death penalty should only apply to those that has killed somebody. BUT sometimes those that committed those crimes here in the states, some only gets a life sentence. It’s a very hard debate, it just depends who you ask. I myself is a Christian, but there should at least be a law that if someone has taken a life, they should pay for it.

    I see some flaws in the practice, but I don't entirely disagree on bringing it back. I think most people view it as an act of taking a person's life, which is technically correct, but seeing it that way might actually lead someone to misunderstand the punishment, making them think it's wrong.
    Well, although it may involve taking away someone's life, it's not just about killing a person; it's about discouraging the citizens not to participate in the acts this person did. If we use the death penalty to deter others from not doing the crime, it will instill fear in their minds, and may think twice when they find themselves in situations where they are tempted to commit such acts.
    However, we must also think about the people we put in charge of taking care of the punishment. We must choose someone responsible, as this is something that could be easily abused. Right now, both the Filipino police and government are pretty much messed up. The Philippines is not yet ready for the punishment. We should at least do something about the cops and the officials before actually putting execution back in business.

I think that will shed a lot of light to the whole negative propaganda by both the western & Philippine media. As far as safety, it all depends where you are in the country. If you go to the ghetto/extremely poor neighbourhood, safety could be an issue however, majority of the Philippines is safe. A lot of foreign visitors can attest to that. It’s the media that overdramatises everything and blows it out of proportion and portrays the country like it is infested with all criminals. They finally have a President who have the guts to clean up this whole mess and he is left with drug lords, addicts, & corrupt officials. You need a President like Duterte to clean up such a mess and straighten everyone up and defend & protect the people so that the next generation can thrive and live fully & peacefully.

    We all know how crappy our Justice System is. Here in Ph, justice is for the rich people only. Rich people are capable of doing everything to cover up their crimes and blame it to other people who have lesser power than them. There's a lot of people being convincted for the crimes they never did so if Death Penalty Bill will be passed, imagine the lives of people who are/who will be falsely accused for a crime they never did. Not only their decent lives with their family will be ruined, but also their lives will be taken away from them.
    We should also pay attention on strengthening and fixing our Justice System. What would make us different from a true murderer if we agree on Death Penalty? We don't agree on Death Penalty not because we feel guilty or afraid of something we've done in the past. We don't agree because we're afraid that you or your family or friends might be falsely accused too. We always take things emotionally when in fact we should take things rationally. Let's think about our moral values too. We should learn to try putting our feet on other's shoes and see their perspectives.

      it would be interesting hear what crimes you think warrant a death penalty. I personally think the death penalty is pointless and illogical. Regardless of what we've done in our life, we're all humans but more so it's an easy way out for the criminal. A rapist, murderer, child molester should face his/her consequence for committing such atrocious crimes. Killing them will not make this happen. Just to provide money for their family (except most drug dealers only want money and power and to feed their addiction). But let's not forget that all crimes are not just because of poverty. Poverty has nothing to do with rape, vengeance, hatred towards someone that leads to murder or killing just for fun.
    So for me, it would be OK to bring back death penalty but only for those who committed crime just because they wanted to do it and not because they had to. For me, death penalty will serve as a deterrent from people who wants to commit crime. I'm speaking for those families who has been victimized by crimals and for those soldiers and policeman laying their lives on the line just to protect people who think otherwise. A lot of innocent people get killed each day. It is sad to think that our country hasn't done much to serve justice. I am for death penalty, for those criminals who are so evil and dangerous to be left in prison.

    Death penalty is a serious deterrent to heinous crimes. Although, like the concerns raised from a previous comment below, if the judicial system is corrupt and/or incompetent, it may well be implemented against the less fortunate and under-privilege. So many things to consider from law enforcement to jurisprudence. As a matter of principle, death penalty should be reinstated.

  • @brettsessums718
    @brettsessums718 6 лет назад

    Excellent variety of answers! Interesting! The death penalty should be reinstated in the Philippines! However Duterte needs to have an independent judiciary monitor the capital punishment cases and death row inmates deserve several times to appeal it! Duterte is right to try to get the crime situation under control but he thinks political opposition and people speaking out peacefully against him is a crime! Due to those reasons Duterte does not need to have the final say so as to who gets executed!

    what will happen is that people of the poor or working class will be the ones to receive the death penalty while politicians and rich people will be able to get away with their crimes even though they deserve it more

    Honestly, as a Filipino as well. Death penalty should not be legal. Why? A-side from religious aspect... It's because the penal system of the Philippines is VERY VERY DEFECTIVE. Given our country's distorted justice system with powerful and very greedy politicians many people will definitely just be framed up. Being blamed and set up by crimes they did not committed. Poor people will be more miserable. It's very risky and Filipinos should consider this aspect as well. Their are punishments in law that balanced with the crimes committed. That should be enough. Also having a criminal suffered long than taking his life away will be more appropriate. Now, going to biblical or religious aspect. Thou shalt not kill. Life is precious and only God has the right to take away life and also in Romans 12:19 God said " avenge not yourself but rather give place unto wrath, for it is written:VENGEANCE is mine, I will REPAY, said the Lord"

      People use drugs to relieve pain? Is that how the vast majority of drug addicts are in the country? Wow! How amazingly naive that statement is!
      Have you or any of your family member, in any way, direct or indirectly, been victimized by a drug addict.
      One of my family was a victim of a drug addict. It is our 82 year old grandfather. The suspect, a known drug addict in the neighborhood, was so desperate for money, barged into my grandfather's home & tried to steal valuables. My grandfather tried to resist but he ended up with a broken right arm, countless bruises & his left eye had to be surgically removed!
      How did he get such critical injuries? The suspect used a huge machete when he did the crime. Put yourself in his position. An 82 year old senior citizen, going through that kind of heinous attack.
      On top of the great physical pain he had to endure not just from the incident, not just from how hard it was for him to undergo his treatment & therapies, my grandfather had to endure the effects of psychological & emotional trauma.
      I'm even discounting the fact that all of us had to shoulder the exorbitant hospital bills, medicines & professional services from physical & occupational therapists as well as psychologists.
      Just imagine if any of your family members that mean so much to you, might be killed, raped or be a victim of any other crimes committed by drug addicts, can you still say you do not support death penalty?
      A vast majority of these addicts will not change no matter what. Putting them in prison will only hinder them for a few years. After getting out, do you think they can find jobs to support themselves?
      Anybody applying a job in the Philippines need to present police clearance. Good luck getting that if you have a criminal record.

    • @maricrisr.
      @maricrisr. 6 лет назад +5

      Please read the article I have linked. I am not here to convince anyone but it is just facts that death penalty does not prevent crimes. It also has been scientifically proven that drug addiction is a disease. It is a mental disease and as such should be treated in a rehab. We can look to what Portugal has done and see that using scientific data and helping the recovering drug addicts have helped their country reduce dramatically the amount of their citizens becoming addicted to drugs.
      I do have a cousin who is a drug addict and after much digging we found out that cousin was abused as a child so we all pitched in together and and put him in rehab and now he has a healthy life and job and family.

    The Justice System in the Philippines is Faulty. I do believe that we should "Kill the Crime not the Crimal." At the same time
    Religion should not play a part in the affairs of the state. The Philippine Constitution Article II Section 6 states, “The separation of Church and State shall be inviolable.” The state and church are separate beings so their matters should not collide. It will only be a hindrance and make the case harder to be solved if the Catholic body involves themselves. Also in Catholic teachings, the Bible actually gave many examples on executing criminals for their crimes.

      I agree. For drug ADDICTS. But not for pushers. Those are two very different people. The problem with drugs in the Philippines is that it's not a domestic problem. The vast majority of the illegal drug trade is controlled by Chinese triads. And these are very very bad people. They are also responsible for organized crime - kidnappings, assassinations, fraud, smuggling, human trafficking, etc. I would be more lenient towards small-time drug dealers who sell pot, for example, but not these people.
