    I just had a hearing with a judge(over the phone because of Covid-19) in October & just got my denial letter a few days ago . I was also represented with an attorney who did not represent me at all (My opinion) He was the 3rd attorney assigned within the law firm that I chose & the only contact I had with any of them was the 3rd attorney 3wks before my hearing by a phone call about 10 minutes long explaining very little of the actual hearing phone call. I immediately typed in RUclips on how to answer questions for a disability hearing & all your videos came up . Needless to say I learned more from watching your videos than my attorney on how to answer questions that would be asked. This video I just watched made me realize (I’m not sure why I do run across this one before) that I will need to do the nerve test because that is what my main complaint is from , spinal stenosis , I had symptoms overnight in 2018 with my back & all of a sudden I couldn’t walk on my own so over months of therapy, MRI’s, etc. I had a spinal laminectomy on L3,4,5 & s1 which got me off the walker but now I have heaviness & weakness in both legs & tingling & sensation numbness in the lower part of my legs & feet. I also have fallen ( multiple times) because of my legs being heavy & weak. Thank you for me seeing this video tonight which means I need to have the nerve test done. My doctors have offered the test but stated it won’t fix anything & said it is very painful. Looks like I need this done so a judge can see that my pain is legit & hopefully I can find a good, local , attorney that will fight for me .

    I’ve had neuropathy in my hands and feet almost from the beginning of my MS diagnosis. I’m so used to it, it didn’t even occur to me that it is an MS symptom. It has gone from a consistent 4 to now a level 8 constantly. This gives me good insight into answering this question effectively without sounding like a whiner.

      You make a good point - sometimes you get so used to your symptoms that you forget how much they might impact you in a work type situation. But you have to mention everything that impacts you.

I just received a letter from SSI for the first time in over 10 yeaRS, I never even knew there would be any reviews at all, and it scared me when I saw it. but your videos have helped me understand I clearly do fit in the Disabled category ! I get bad flares at least once a week that puts me curled up in my bed for a couple days. I got reprimanded at work because I have a hard time concentrating and following through with what I need to do because I'm hurting 24 7. It doesn't get better only worse and had to get a walker. I also have degenerated disc. He is absolutely right about a emg. I have been and still am driving a public transit bus (I can't afford to quit because I would lose my house and still have a teenage son to support...single/divorced) for 36+ years. I had a work related injury in 1997 that resulted in herniated discs (L3-4, L4-5, and L5-S1) and was rated as 45% disabled 5 years later. Reports show herniated discs and spinal stenosis and sciatica on right side. In 2014 I suffered another work related injury to my left shoulder and neck due to seat belt shoulder straps that lock up. That injury resulted in partial tear of the rotator cuff, adhesive capsulitis, herniated disc in cervical spine and nurses/doctors can no longer detect a BP or pulse in my left arm. All my employer would recognize at first was a "strained/sprained" rib! The "light duty" my employer put me on had me standing on or sitting on concrete surfaces 6-7 hours per day which resulted in burning/pins and needles pain in both feet. I paid out of pocket for some time just to keep working. When treatment was approved it was short lived and then they completely denied the claim. When claim was accepted it was only for the frozen shoulder and torn rotator cuff. So for a long time I received no treatment and now treatment is cut off. That was my second employer at the same job, same buses, same facility but just under contract instead of the public entity. Now I have third employer, same everything. Seats are severely worn and crooked which has resulted my in pain being on the left side with my hip going out. I have not filed a claim yet as this employer just took over in July 2017 and I can't afford to lose my job. I am limited in the medications I can take because of this being a "Safety Sensitive" job. I currently make $25.50 per hour. You speak of being able to work in an entry level job which would mean minimum wage of about $10.00 per hour and most likely be either sitting or standing which still means I would be in pain just making a lot less money...not enough to survive on. My pain levels are constant at 5-7 and when driving a bus 8-9 or 10 on my worst days. I have been missing a lot of work which is another reason I fear losing my job...BUT, it takes so long to get Social Security Disability I would definitely lose my house. Suggestions? I am 59 1/2 years old.

    This is very good advice as I went through this getting my disability. But not no mention for those who may have pain but still fit the ability physically to work. I wanted to work but no one would ever hire me because of my back injuries and surgical implants in my lower lumbar and cervical spine. A person can be able to work but pose such a risk for employers that they become unemployable. This was my case I was only 36 when I had my accident and spine surgery was successful other than the constant pain and stiffness that comes with that surgery. But as soon as you disclose to an employer that you have had spine surgery you become a risk and can become a liability to their buisness. Therefore no one would in right mind hire a person with certain types of injuries this needs to be discussed concerning SSDI.

    I was hit by a truck in 2021, and the pain and swelling I go through daily. I have 2 screws in my ankle. My tibia and fibula and ankle was broken. The pain is so severe, I walk like a 90 year old at times. I cry and scream it get so bad. My doctor said I have neuropathy due to my injury. The truck ran over both legs and ankles. The pain is pins and needles, electric shock feeling, and now I experience a feeling as if someone is taking a knife and slicing my foot and ankle. My left leg goes out on me daily, and it has a permanent dent at my lower leg. Disability think people want to be disabled. I was walking to the store, when I was hit by a truck. I didn't ask for any of this. And the anxiety, depression and PTSD is worst. I am on several medications. I got a disability lawyer at my reconsideration stage. I hope for an approval.

    1:50 Incorrect. An EMG will be totally negative if the damage is totally sensory nerve and/or located in the nerve root ganglion. An EMG only tests motor nerves which can be perfectly fine. An EMG would only show problems if you can't move. Also a visual scan won't show anything if the damage is microscopic in the nerve channels such as sodium channel in the ganglion such as in fibromyalgia. You would have to cut out a part of the persons neck probably to test for that and run tests on it. Or do an autopsy. In the future better tests could be made, but right now they are very limited in what you can do clinically to a live patient in a commercial, non-research setting. Some of those tests exist which are less invasive perhaps, but you can't access them.

    Been to see four Neurologists for PN. They’ve all described it as idiopathic. Had the EMG done twice and shows nothing. This latest Neuro states it’s Small Fiber Neuropathy and said I could get a nerve biopsy done. SFN will not show up in EMG. It’s a very slow nerve undetected by the EMG so I’m scheduled for the nerve/skin biopsy next month. It will show the die off nerves. Neuro says it will get worse over time. Yay! :( This test is helpful where the EMG is inconclusive. I also have post-operative hypothyroidism due to a thyroidectomy for cancer and thyroiditis, liver inflammation which I will be getting a biopsy of that too, edema, venous insufficiency/Varicose Veins, depression, migraines, osteoarthritis, Leukoaraiosis. Looking to see if I have Autoimmune Hepatitis hence the liver biopsy. Everyday is a struggle. I filed for SSI & SSDI last October. Went through all the denials so now I’m just waiting for the scheduled hearing appt date.
    As for how this effects my capacity to work: Neuropathy is consistent all day burning and piercing pain, distracting to say the least, doesn’t matter if I’m standing or sitting. Standing and walking is exhausting. Feet cramp up and often have to remove my shoes. I’ve tried Gabapentin to no avail. It is worse at night when trying to get off to sleep which often doesn’t happen so I another reason for my Insomnia. The only thing that works is 2.5mg Oxycodone before bed. But now, thanks to the tweekers had made it virtually impossible to get a refill for. So on top of the Neuropathy is my restless legs and venous insufficiency/Varicose Veins which causes swelling and extreme difficulty in sitting and standing. That’s just one aspect of how this disease robs my work life not counting my personal activities. Exercising, walking or riding a bike, is necessary and does help some with the leg swelling but its a major mental and physical hurdle just to get out there and do because of the pain I have to endure. I use to be at athletic performance. So depressing :(

Nationally, initial applicaitons are approved at around 33%, recon 10-12% and hearing about 50%. So recon appeals have the lowest approval rates. A cynic would say that SSA does this to save money and to discourage claimants.

My entire life changed so much from who I use to be, it really feels like I am just barely hanging on; however, I didn't get to say what I wanted to say during my hearing. I did not get to really go into detail about each symptom and how it affects my daily life. I followed instructions from attorney which was to simply be truthful and I answered the questions asked by the judge. Funny. I have neuropathy and tried to get SSDI. Horrible pain. Could not concentrate and do my job well, so I left. Neuropathy dr said I did not want biopsies. Did not think to ask why. My claim was declined. Finally the foot dr did a biopsy on both of my feet. Lord and behold I had severe neuropathy in my smaller nerves of both feet that I was told was hard to treat. Biopsies did not hurt at all, you can't feel the needle whatsoever. Had to get rid of my 5 speed or the neuro dr was going to report me to the DMV. So had to get an automatic car. The biopsy test was very expensive, believe it or not, the brilliant/kind foot doctor wrote it off. Now I know the truth. When in Walmart waiting in line with a buggy full of groceries for only so long I told a worker to take the buggy. I had to get home off my feet and that I would have to come back later. Pain is worse at night keeping you from sleeping. So much for my American rights. The company that did the biopsy had on the report to take alpha lipid acid, which I do. Have been on it now for many years. Does not cure it, but helps it to some extent. I thought about getting an attorney but I hurt too bad to follow up on it.

    • @ssdattorney
      @ssdattorney  2 года назад

      Ginger, neuropathy is one of those conditions that is very difficult to "measure." You have to convince a judge that your experience is one where the pain is so severe that it precludes work. This is probably a case where it would make sense to discuss with a lawyer.

    • @ginger6582

      @@ssdattorney I think it is too late now. I have been with it for 7 years now. Things that I need to do I have to force myself to do in order to get it done. Some things that need to get done are put off for other days when I feel I can handle it. If a judge did not believe me that would only make me more furious. I posted my comment to let people know that it is real and painful. The lack of sleep from moving your feet at night trying to relieve some of the pain. Walking on carpet and it feels cold and wet. I think it is too late for me but maybe others won't let it go by the roadside if it happens to them. If the neuropathy drs, 2 from 2 different offices, would have done their jobs right and did the biopsys right away I would have made myself re-apply for help. But I only had their word plus the gabapentin they put me on, which only made me sick and I had to discontinue. The reason I went to the foot dr. was for a different foot issue. He did for me what the neuropathy drs. should have done. Needless to say I don't see the neuropathy dr's. anymore, I just take alpha lipid acid. Maybe I have helped someone else. Get the biopsys done. Thank you for your response.

    My son in law has CIDP from chemo and it also destroyed his lung function too, now on 4 meds just to breathe. His neuropathy causes him to fall and drop things. He’s 41, can’t return to work. His disability physician he was sent to by social security told him he still hasn’t seen all the effects from chemo yet, told him to get his hearing checked too. He felt he should be approved based on 6 months of chemo and now will suffer the effects for the rest of his life. Sadly he truly wants to work to support his young children. Why is it so hard for him to receive benefits? He should qualify most definitely for his time during chemo, he did 40 hours a week hooked up to IV’s in the hospital so obviously could NOT work as the chemo made him terribly ill. He’s in pain all day and night every day from the chemo induced neuropathy. I hate to see him like this, he tries so hard to hide his pain from my grandchildren, the 2 older ones are deeply effected by his pain and worry about losing him.

      Good question. Not being able to drive would eliminate driving jobs but it would not eliminate simple, entry-level sit down jobs. Not having transportation is not a disability for SSD purposes. I have some questions. I'm at a crossroads. I love my job and love working but it's starting to become crippling. I'm only able to do the work when I take my pain medication hydrocodone and gabapentin. I have carpal tunnel, just had carpal tunnel release in January. Then in March I had a femoral and tibial osteotomy to correct my Miserable malalignment syndrome in my right leg. I depended on a Walker during recovery and really flared my carpal tunnel back to where I started. Now my thumb ligament has popped out and I'm dependent on my wrists braces to function. I dont know if I should have it looked at or wait until I have my left leg femoral and tibial osteotomy. I have a genetic condition that is unknown but related to Ehlers Danlos syndrome. My joints are loose. I've had my right shoulder operated on twice now to stabilize it. I have what the doctors believe to be neuropathy in my legs and possible in my hands. My legs get extremely weak and burn making it so hard to do my job. My hands are starting to lock up as well. So question is would I qualify for disability? Should I wait until I loose complete function of my hand and legs? It's very tough as I dont know if I am "disabled". Just know that I'm getting worse and its starting to progress faster. 😢

That is the only place they might know something. Either way you can't really test for this clinically because all the published tests are only available as part of research studies and it shows different things in different people with a lot of variability.

    Is nerve damage a listing or would you have to meet a listing?

    • @ssdattorney
      @ssdattorney  7 лет назад

      There are some listings that apply for cases of nerve damage (see www.meetalisting.com). However, even if you don't meet a listing, you can win by showing that your capacity to function at work has been so reduced by your nerve issues you would not be a reliable worker.

      Social Security Disability videos thanks for your reply back!
      I have been approved about 3 years ago by ALJ due to mental health conditions secondary.I just had a CDR and was denied and told my condition has improved and I don't agree at all with that decision I Asked for a hearing within the 10days so my benefits could continue.Whoever reviewed my File did not get all my medical records and based there denial on only 3 doctors out of 10 or more that I gave them on the forms.I had a nerve test done and it was positive for nerve damage in my feet legs and I was put on cymbalta for the pain I have.I have type 1 diabetes Graves' disease Lyme disease R/A factor social anxiety major depression I had my whole thyroid removed so my thyroid goes up and down.I anxiety and depression gets worse due to the medical issues I have and the depression and anxiety makes my other conditions worse everything plays off each other.any way I now have this nerve damage in my legs and feet (both) that is causing a lot of burning sensation,Stiffness,Numbness tingling like my toes or feet fell asleep I get a lot of swelling and it feels like something is stabbing me in my feet or toes this discomfort and pain causes me to not be able to sleep good as it's worse at night time taking a shower is very painful to me because of not being able to stand long and bending is not fun due to the stiffness I have to lay down a lot during the day and put my feet up my depression is worse due to the pain and I'll have days I don't even get out of bed.I have days I wish I wouldn't of even woke up to deal with the painful reality of all my conditions.Its just mind blowing that on my CDR I have been denied when nerve damage is a listing and when I was last approved my nerve damage didn't even show up on the nerve study at all but it was still used by ALJ in his findings of finding me disabled but now I have a nerve test showing the damage is real and being treated for this.In your opinion are my chances good for having my CDR denial reversed at the hearing or on appeal to ALJ again?

      I was diagnosed with Peripheral neuropathy due to type one diabetes and I for sure met the B. Marked limitation (see 11.00G2) in physical functioning (see 11.00G3a), and in one of the following:
      Understanding, remembering, or applying information (see 11.00G3b(i)); or
      Interacting with others (see 11.00G3b(ii)); or
      Concentrating, persisting, or maintaining pace (see 11.00G3b(iii)); or
      Adapting or managing oneself (see 11.00G3b(iv)).
      I do meet a couple of the listing a where I have trouble balancing standing but I no doubt met the marked limitations for this listing and with the depression and anxiety I have combined it really cause all the marked limitations and I still got denied on my CDR without them even mentioning this condition or getting medical records from my Nero doc.this is why I am having a hearing.I believe they just stamped denied instead of really looking at my file it's a shame because this is my only income and means of survival and the ones doing the reviews could care less and have nothing happen to them for doing this to the disabled they make your life more of a living hell.
