    WHAT IF, my wife has "DACA without entry" and I am married but I am severely disabled...I can't make the trip with her Nor can I make it on my own? Is our only option to renew DACA for life?

    I came with a visa when I was 8 years old and my visa expired in 2005 and I stayed here until 2012 when I got my DACA. Never left the United States, do I still have to leave the country when I apply for a green card even though I had a legal entry? I entered with a B1/B2 tourist visa.

      No. You came in through customs. If you crossed illegally you might have to go back.

    Hello,
    My wife has DACA and was approved for AP. We just reentered the USA with no issues with AP. She has no criminal history. The only thing is that her parents might have taken her out of country more than once as a child. We are not sure since her mom can't accurately remember. Either way, we are in the process of adjusting her status since I'm a US citizen (and she's my wife of 5 years).....any recommendations to see if she's had multiple re-entries as a child? (such as an FBI background) Again, we are in the process of adjusting status and are worried that due to her parents possibly taking her to Mexico more than once as a child, will affect her adjustment.....Any advice will be greatly appreciated! Thanks for what you do.

    Finally a lawyer that explains, that there is 2 types of Daca recipient, 1 that came illegally and 1 that overstayed their visa, most lawyers failed to explain that.

    Hi , i am from Europe and during my exchange year in the USA a met someone amazing I want to live with . The only problem is that I left and have no idea how to get back over there permanently . He is a daca , so there is no way i can marry him to get a green card since he doesn’t have one either . Do you have any advice for me to get back there really soon , and be able to stay forever?

      Yes it affects , you have to prove to the government that you don’t need anything from them like snap or even money wic and medical .

    Unique Question - What about people who came to the country with a visa but under an alias? Lot of immigrants from Asia, Europe change their last name or DOB to gain a visitor visa. What about those people? Can they adjust their status inside the US? Keep in mind, after their arrival, they assume their birth name and live their live here under their birth name. But records will show they were inspected under different name. That’s confusing. They were inspected but not really? Since it was an alias? But technically, that person was inspected? What’s the answer to that

      I do believe it’s ok as long as you states both names on one of your applications in USCIS because I do know there’s a section that asks about alias’

    Married to a us citizen , have DACA since age16 , entered illegally .. will i still need a waiver if i have not accrued illegal stay?

      I too have DACA, I was brought to the US illegally as a baby. An attorney told me it would take 3-4 years since I entered unlawfully , like I can make decisions at that age but whatever, and I would have to return to Mexico for some time.

      @@sandraschneider1011 try asking because if you came in and got DACA before you turned 18 then you don’t actually have to go out of the country. I’m in the process with my husband for a green card through marriage

    I have a question. My husband is sponsored for green card from work. It is going to be consular proces. My son is a daca recipient. Does he going to get green card together with my husband? He is 18 now. Thanks.

      @howzit3000 Wrong, companies CAN sponsor you for Green card if you choose/able to get green card through work. I'm saying this bc I was on F1 visa and got my residency through my employment. The employer has to "sponsor" your position in the company and let the DHS know that the company has tried to find a qualified candidate for the position but were unable to find a qualified u.s. citizen/current green card holders to fill out the position. DHS is going to ask for proof (proof of job posting/how many ppl applied-candidate's resume who applied for the position etc) and decide if your position and qualifications are needed/eligiable for the benefit of the company. Depending on your position/qualifications you are able to file EB3 or EB2 etc. I've got through EB3 and it took me 2 years to get my green card. Good luck!👍

    If I married to a DACA and she already has a court date to be deported because she got stopped for a DUI is she still going to be able to stay in the United State with a court date coming up for DUI and court date coming up for deportation if getting married would it stop her from getting deported

      Sometimes it is possible, you want to fight the case and hire local immigration lawyer to appear in court with him.

      Try to change the DUI for reckless driving. For DACA it affects DUI and weird for applying for resident it does not.

      If u entered illegally without inspection, then it is very hard... if u overstayed, more possible, but see an immigration lawyer

      @@MipMip1343 H1b Visa is difficult because they have limited number of Visa, it expensive, and likely to denied renewal. As a Mexican born citizen, I should go to TN Visa, because it cheaper, unlimited number, but limited occupations. I major in Management and Marketing. Also, I have a US citizen sister who are about turning 21 in December and they could sponsor me, but since I from Mexico, I will have to want 20 years or more to get a green card

    I have green card and my daughter is 26 years old she’s on Daca can I apply for her to get a green card? Some told me I can’t because she was out of status overstayed before Daca

      Yes you can. It may be a long wait and she will need a waiver, but is possible.

      @@Jeanyuhzz any employer, you need to ask the employer to sponsor you, and show there are no American workers are available. If you have at least bachelor degree or higher, you're likely to get a temporary work Visa like H1B, TN, and more.
